1 IWI 2 =1 ì \D (R-2026-480) RESOLUTION NUMBER R- 316839 DATE OF FINAL PASSAGE JUN 1 8 2026 A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO AUTHORIZING THE SETTLEMENT OF SHOYI & AYAKO MATSUMOTO AND THE CITY OF SAN DIEGO. RECITALS The Council of the City of San Diego (Council) adopts this Resolution based on the following: A. Plaintiffs Shoji Matsumoto and Ayako Matsumoto filed suit against the City of San Diego, alleging inverse condemnation stemming from a failed storm drainpipe on their property at 4030 North Hempstead Circle. The lawsuit is entitled Shoji Matsumoto and Ayako Matsumoto v.

City of San Diego, San Diego Superior Court Case Number 37-2024-00004038- CU-EI-CTL (Litigation); B. In closed session on May 11 ,2026, the San Diego City Council, by the following votes: Yeas, District 1,2,3,5,6,7.8, and 9; Nays: None; Absent: 4, approved the settlement of the Litigation for an amount consistent with the amount set forth below. Be it resolved by the Council ofthe City of San Diego: 1. The Mayor or his desjgnee is authorized to pay the sum of $690,000.00 to be paid from Public Liability Fund No. 720045 in settlement of each and every claim for damages, interest, costs, and fees of any type, including attorneys' fees, against the City, its agents, and employees, arising from the Litigation. -PAGE 1 OF 2-
