RECIT ALS T he C ouncil ofthe City of San D iego (C ouncil ) adopts this O rdinance based on the f ol l owing: A .

In January 2 0 1 9, the C ity of S an D iego (C ity) entered into a consul tant agreement (H1 8 6974) with Kl einf el der, Inc., f or prof essional design and construction support services (A greement) in an amount not to exceed $2 , 637,1 1 6 for the L akeside V al ve S tation R epl acement project (Project), with an original term expiring S eptember 2 5,2 0 2 5. B.

O n O ctober 2 3,2 0 2 3, the C ouncil approved O rdinance O-2 1 736, which authorized a f irst amendment to the A greement to extend the term to seven years and four months, and increased the A greement's not-to-exceed amount by $955, 98 3 f or additional design and construction support services associated with-updated water. f acil ity design standards, additional County of San D iego permitting requirements, additional community outreach, and S tate Revol ving Fund l oan appl ication requirements. C.

T he Project is in the construction phase and has experienced del ays f rom material procurement issues invol ving special ized 48 -inch and 66-inch steel tripl e offset butterf l y val ves, construction resequencing required to maintain uninterrupted water del ivery f rom the S an V icente and El C apitan R eservoirs to the A l varado Water T reatment Pl ant, and extended -PAGE 1 OF 3-

T herefore, a second amendment to the A greement is now necessary to extend the A greement through D ecember 1 5,2 0 2 7, at no additional cost to the C ity, to al l ow f or continued design and construction support services (S econd A mendment). D . T he O ff ice of the C ity A ttorney prepared this O rdinance based on the inf ormation provided by City staff (incl uding information provided by aff ected third parties and verif ied by C ity staff), with the understanding that this inf ormation is compl ete and accurate. E . T he Second A mendment is subject to San D iego C harter

section 99, which provides (subject to certain exceptions) that no contract, agreement, or obl igation creating C ity indebtedness and extending f or a period of more than f ive years may be authorized except by an ordinance adopted by a two-thirds majority ofthe C ouncil . Section 1 . T he Council authorizes the Second Amendment.

Section 2. T he M ayor or designee is authorized, on behal fofthe City, to sign the Second A mendment. When signed by both parties, the S econd A mendment wil l be pl aced on f il e in the O ff ice of the City Cl erk as D ocument N o. O O - 22108
