W 1 231 2 41 51 (O-2026-126) ORDINANCE NUMBER 0- 22113 (NEW SERIES) D A TE O F FIN A L PASSJU N 2 6 2 0 2 6 AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN DIEGO AUTHORIZING THE FIRST AMENDMENT TO CONTRACT H2426362-M WITH BROWN AND CALDWELL FOR DESIGN AND CONSTRUCTION SUPPORT SERVICES FOR THE PUMP STATION 2 IMPROVEMENTS AND MODERNIZATION PROJECT AND RELATED ACTIONS. RECITALS The Council of the City of San Diego (Council) adopts this Ordinance based on the following: A.

On June 10, 2024, the City of San Diego (City) entered into an agreement with Brown and Caldwell for design of the Pump Station 2 (PS2) Improvements and Modernization Project (Project) for a period of five years, in an amount not to exceed $2,941,124 (Contract). B. PS2 is the largest and most critical pump station within the City's wastewater collection system. PS2 must provide reliable, uninterrupted service, and any shutdown of PS2 poses potential risks of wastewater system spills.

The Contract included design services for upgrades and rehabilitation, environmental review and studies, evaluation of the existing condition assessment, condition assessments of structural components to identify future upgrade and replacement needs, and construction support services for the Project. C.

The First Amendment to the Contract extends the term for an additional three years to June 10,2032, increases the not to exceed amount by $2,294,011 (First Amendment), bringing the total not to exceed amount to $5 ,235 ,135 , and adds additional scope of work as more fully set forth in the First Amendment which is included in the staff materials accompanying this Ordinance. D. The First Amendment addresses issues discovered during investigations performed under the Contract, such as significant deterioration of concrete and reinforcing steel -PAGE 1 OF 4-

(O-2026-126) beams of the wet well and influent channel which potentially compromise the integrity of PS2 components and could increase the risk of structural failure. To address these conditions, additional structural repairs and reinforcement are required to stabilize the wet well and influent channel, along with design of a full structural framing system to safely support repair activities during construction. A secondary stop log is required to block wastewater and isolate the channel during maintenance and construction.

Physical modeling is also necessary to simulate actual flow conditions and confirm PS2 will operate safely and reliably under the updated design. The Project is expected to extend beyond the originally anticipated Contract term, therefore requiring additional time for construction support services. E. The Office of the City Attorney prepared this Ordinance based on the information provided by City staff, including information provided by affected third parties and verified by City staff, with the understanding that this information is complete and accurate. F. The First Amendment is subject to San Diego Charter

section 99, which provides (subject to certain exceptions) that no contract, agreement, or obligation creating City indebtedness and extending for a period of more than five years may be authorized except by an ordinance adopted by a two-thirds majority of the Council. ACTION ITEMS Be it ordained by the Council of the City of San Diego:

Section 1.The Council approves the First Amendment.

Section 2.The Mayor or designee is authorized, on the City's behalf, to sign the First Amendment. When signed by all parties, the First Amendment will be placed on file in the Office of the City Clerk as Document No. 00- 22113

Section 3.The Chief Financial Officer is authorized to expend an additional amount not to exceed $2,294,011 from CIP L-24000 PS 1&2 Improvements & Modernization (L- -PAGE 2 OF 4-

(O-2026-126) 24000.2 Pump Station 2 Improvements and Modernization), Fund 700009, Metro Sewer Utility CIP, for the purpose of executing the First Amendment, contingent upon adoption of the Annual Appropriation Ordinance for the applicable fiscal year, and contingent upon the Chief Financial Officerfurnishing one or more certificates certifying the funds necessary for expenditure are, or will be, on deposit with the City Treasurer.

Section 4. The Council dispenses with a full reading of this Ordinance before its passage because a written copy of this Ordinance was made available to the Council and the public before the date of its passage.
