# 335 // @-4 (R-2026-51 6) RESOLUTION NUMBER R- 316848 JU N 2 6 2026 DATE OF FINAL PASSAGE A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO ADOPTING THE WRITTEN REPORT IDENTIFYING SOLID WASTE MANAGEMENT FEES TO BE CHARGED TO EACH PARCEL FOR FISCAL YEAR 2027, AND AUTHORIZING THOSE FEES TO BE COLLECTED ON THE COUNTY TAX ROLL, AND ALL RELATED ACTIONS. RECITALS The Council of the City of San Diego (Council) adopts this Resolution based on the following: A.

By Resolution R-31 6260 (June 1 6,2025), Council established a cost-recovery fee for City-provided solid waste management services, including waste, recycling, and organic waste collection services (Solid Waste Management Fee), and established a fee

schedule for the Solid Waste Management Fee for Fiscal Years 2026,2027,2028, and 2029. B. The Solid Waste Management Fee was adopted in compliance with

article XIIID,

section 6 ofthe California Constitution, California Government Code

section 53750, et. seq., and California Health and Safety Code

section 5471. C. Under Health and Safety Code

section 5473, the City may elect to collect the Solid Waste Management Fee on the tax roll in the same manner, by the same persons, and at the same time as, together and not separately from, its general taxes, if approved by resolution by a two-thirds vote of Council. D. To collect the Solid Waste Management Fee on the tax roll, Health and Safety Code

section 5473 requires a written report to be prepared each year and filed with the City Clerk, which contains a description of each parcel of real property receiving City-provided solid waste management services and the amount of the fee for each parcel for the year. -PAGE 1 OF 4-

By Resolution R-31 6307 (June 26,2025), Council approved collecting the Solid Waste Management Fee on the County tax roll by a two-thirds vote, and adopted the written report identifying solid waste management fees to be charged to each parcel for Fiscal Year 2026. The Solid Waste Management Fees for Fiscal Year 2026 were collected on the 2025-2026 County tax roll. F.

The City has prepared a written report that contains a description of each parcel of real property receiving City-provided solid waste management services and the amount of the Solid Waste Management Fee to be charged to each parcel for Fiscal Year 2027, computed in conformity with the feés prescribed by Resolution R-31 6260 (2027 Report). The City filed the 2027 Report with the City Clerk fourteen days prior to the hearing and provided notice in compliance with Health and Safety Code

section 5 473.1 . G. On June 23,2026, after providing all required notices, the Council held a hearing to consider the 2027 Report, and considered all objections and protests to the Report. H. The Office of the City Attorney prepared this Resolution based on the information provided by City staff (including information provided by affected third parties and verified by City staff), with the understanding that this information is complete and accurate. Be it resolved by the Council of the City of San Diego: 1 . The Council finds and determines that notice ofthe filing ofthe 2027 Report and of the time and place of the hearing thereon was published in accordance with Health and Safety Code

section 5473.1. -PAGE 2 OF 4-

After hearing and considering all objections or protests to the 2027 Report, the Council finds that protests were not made by a majority of the separate parcels of property described in the 2027 Report, overrules any and all objections to the 2027 Report, determines that each charge described in the 2027 Report is correct and proper, and adopts the 2027 Report. 3. The Solid Waste Management Fees listed in the 2027 Report shall be collected on the 2026-2027 County tax roll in the same manner, by the same persons, and at the same time as, together with and not separate from, the general taxes. 4.

On or before August 1 0, the City shall file a copy ofthe 2027 Report with the County of San Diego Auditor, with a statement endorsed on the report over the City Clerk's signature that the 2027 Report has been adopted by Council. 5. The County of San Diego Auditor is authorized to collect the Solid Waste Management Fees for Fiscal Year 2027 on the 2026-2027 County tax roll.
