RECITALS The Council ofthe City of San Diego (Council ) adopts this Resol ution based on the fol l owing: A.

On January 2,2025, Tatyana Badal ov f il ed a l awsuit against the City of San Diego al l eging personal injuries that arose from her trip and fal l on an uneven sidewal k near 8445 Lake Ben Avenue, San Diego on September 22,2023 (erroneousl y pl ead as 8435 Lake Ben Avenue, San Diego). The suit is entitl ed Tatyana Badal ov v. Ciy ofSan Diego, Case No. 25CU0001 56C (Litigation). B.

In cl osed session on April 6,2026, the City Council by, the fol l owing votes: Yeas, Districts 1 ,2, 3,4, 5, 7, 8 and 9; Nays, none; Absent, District 6; approved the settl ement ofthe Litigation for an amount consistent with the amount set forth bel ow. ACTION ITEMS Be it resol ved by the Council ofthe City of San Diego: 1.

The Mayor or his designee is authorized to pay the sum of $11 0,000.00 from Publ ic Liabil ity Fund No. 720045 in settl ement of each and every cl aim for damages, interest, costs, and fees of any type incl uding attorneys' fees, against the City of San Diego, its agents, and empl oyees arising from the Litigation. -PAGE 1 OF 2- (R-2026-41 7) COR.
