(

a) The board shall release any levy issued pursuant to

Part 10.2 (commencing with

Section 18401) on any property in the event of any circumstances deemed appropriate by the board, including, but not limited to, the following:

(1) The expense of the sale process to the state exceeds the liability for which the levy is made.

(2) The Taxpayers’ Rights Advocate orders the release of the levy upon his or her finding that the levy threatens the health or welfare of the taxpayer or his or her spouse and dependents or family.

(3) The proceeds from the sale would not result in a reasonable reduction of the debt.

(4) The levy was issued not in accordance with administrative procedures.

(5) The taxpayer has entered into an installment payment agreement under

Section to satisfy the tax liability for which the levy was made, unless that or another agreement allows for the levy.

(6) The release of the levy will facilitate the collection of the tax liability or will be in the best interest of the taxpayer and the state. (

b) The board shall not sell any seized property until it has first notified the taxpayer in writing of the exemptions from levy under

Chapter 4 (commencing with

Section 703.010) of Title of the Code of Civil Procedure. (

c) This

section shall not apply to the seizure of any property as a result of a jeopardy assessment authorized by

Article 5 (commencing with

Section 19081) of

Chapter of

Part 10.2. (

d) In the case of a levy on salary or wages payable to or received by the taxpayer, in accordance with

Chapter 5 (commencing with

Section 706.010) of Division of Title of the Code of Civil Procedure, upon agreement with the taxpayer that the tax is not collectible, the board shall release the levy as soon as practicable. This subdivision shall not apply if the debt for which the levy is issued has been discharged from collectibility pursuant to

Section 16301.6 of the Government Code, except if the debt is satisfied. (

e) The amendments made by the act adding this subdivision are operative for salary or wages subject to levy on or after the effective date of the act adding this subdivision.
