sec. 6806 defines a day as “the period of time between any midnight and the midnight following.” For example, if the 45th day falls on falls February 24, 2025, the Notice can state: “the written comment period closes on midnight February 25, 2025” or any date after that. No closing time should be specified before midnight February 25. However, the Notice can state the exact 45th day, without any specified closing time, but in practice, comments must be accepted throughout the entire legal day.

The public hearing should also be scheduled on at least the day after the 45th day or later to allow for the full days to pass. If the 45th day lands on a State holiday, the close of the written comment period should fall on the next business day (or later) pursuant to Government Code
