Chapter 6,

Article 2.5,

Section 1157.21, Stops, to update the list of safe stops for commercial vehicles transporting inhalation haz- ards on highways in the state. INFORMATIVE DIGEST/POLICY STATEMENT OVERVIEW Pursuant to Division 14.3, Transportation of Inhala- tion Hazards, commencing with

Section 32100 of the California Vehicle Code (CVC), the CHP shall adopt regulations specifying routes to be used in the trans- portation of inhalation hazards. The CVC requires the CHP to keep information current in regulations, with maps clearly indicating designated routes and a list of locations of inspection stops, required inspection stops, and safe stopping places.

The proposed amendments will not change any inhalation hazard routes and will only update the information of inspection stops, re- quired inspection stops, and stopping places to be used by carriers of inhalation hazards along the designated inhalation hazard routes. The CHP’s field commands conduct annual surveys on inhalation hazard routes and stops to determine if changes are necessary.

After CHP field commands in- spected the locations of listed business establishments serving as safe stopping places, business owners have expressed their willingness to provide their business lo- cation and service information in the CCR by signing the CHP 114, Designation as Safe Stopping Place. Pro- posed changes have received consultation and concur- rence from the State Fire Marshal. This proposed regulatory action will continue to pro- vide a nonmonetary benefit to the protection of the health, safety, and welfare of California’s residents, workers, and environment.

The changes to the applica- tion of the regulation are not substantive and bring the regulation in conformance with existing statute. The proposed changes update and clarify safe stopping places designated for carriers transporting inhalation hazards, and contribute to transportation safety and public health. During the process of developing these regulations and amendments, the CHP has conducted a search of any similar regulations on this topic and has concluded that these regulations are neither inconsistent, nor in- compatible, with existing federal and state regulations.

FISCAL IMPACT AND RESULTS OF ECONOMIC IMPACT ANALYSIS The CHP has made an initial determination that this proposed regulatory action: (1) will have no effect on housing costs; (2) will not impose any new mandate up- on local agencies or school districts; (3) will involve no nondiscretionary cost or savings to any local agency, no cost to any local agency or school district for which Government Code (GC) Sections 17500−17630 require reimbursement, no cost or savings to any state agency, nor costs or savings in federal funding to the state; (4) will neither create, nor eliminate, jobs in the State of California, nor result in the elimination of existing busi- nesses, or create or expand businesses in the State of California; and (5) will not have a significant statewide adverse economic impact directly affecting businesses, including the ability of California businesses to com- pete with businesses in other states.

Benefits of the Proposed Action: The proposed ac- tion updating safe stopping places designated for carri- ers transporting inhalation hazards will continue to pro- vide benefits, including the nonmonetary benefit of protecting public health and safety for residents, work- ers, and the environment by providing a regulatory ba- sis for enforcement efforts as they relate to safety com- pliance ratings. The regulated community is encouraged to respond during the comment period of this regulatory process if significant impacts are identified.

COST IMPACTS ON REPRESENTATIVE PRIV ATE PERSONS OR BUSINESSES The CHP is not aware of any cost impacts that a repre- sentative private person or business would necessarily incur in reasonable compliance with the proposed action. EFFECT ON SMALL BUSINESSES The CHP has determined the proposed regulatory ac- tion may affect small businesses. If a business can no longer meet the requirements for safety, they will be deleted from the list of safe stopping places.

However, due to the very limited number of commercial vehicles transporting inhalation hazards on the designated routes in the state, no foreseeable economic impact is projected for the small business to be removed from, or added to, the list. ALTERNATIVES In accordance with GC

Section 11346.5(a)(l3), the CHP must determine that no reasonable alternative con- sidered by the CHP, or otherwise identified and brought to the attention of the CHP, would be more effective in carrying out the purpose for which the action is pro- posed, would be as effective and less burdensome to af- fected private persons than the proposed action, or would be more cost−effective to affected private per- sons and equally effective in implementing the statuto- ry policy or other provision of law.

The CHP invites in- terested parties to present statements or arguments with respect to alternatives to the proposed regulations dur- ing the written comment period. AUTHORITY This regulatory action is being taken pursuant to Sec- tion 32102 CVC. REFERENCE This action implements, interprets, or makes specific Sections 32101, 32102, 32103, 32104, and 32105, CVC.

DEPARTMENT OF PUBLIC HEALTH NOTICE OF INTENTION TO AMEND THE CONFLICT−OF−INTEREST CODE OF THE CALIFORNIA DEPARTMENT OF PUBLIC HEALTH NOTICE IS HEREBY GIVEN that the California Department of Public Health, pursuant to the authori- ty vested in it by

section 87306 of the Government Code, proposes amendment to its conflict−of−interest code. A comment period has been established com- mencing on August 24, 2018 and closing on October 8, 2018. All inquiries should be directed to the contact list- ed below. The California Department of Public Health pro- poses to amend its conflict−of−interest code to include employee positions that involve the making or partici- pation in the making of decisions that may foreseeably have a material effect on any financial interest, as set forth in subdivision (

a) of

section 87302 of the Govern- ment Code. The amendment carries out the purposes of the law and no other alternative would do so and be less burdensome to affected persons. Changes to the conflict−of−interest code include: 1. Add Information Technology (IT) Classifications relat- ing to management and contracting activities. Since the most recent amendment of the Depart- ment’s COIC, which was effective April l5, 2017, the State Personnel Board (SPB) has initiated the Informa- tion Technology Class Consolidation (Consolidation). The Consolidation creates nine new classifications and abolishes the existing classes.

Each of the nine new classes is organized into “domains” based on the posi- tion’s duty statement. The proposed amendment would add the new managerial and supervisory IT classifica- tions, as well as the new specialist classifications on a duty−driven basis. The proposed amendment would as- sign to the managerial classifications, the Supervisor II and the Supervisor I classification (on a duty−driven ba- sis) the existing disclosure categories of 3, 5, 7 and 8. The specialist classifications would be assigned exist- ing disclosure category 8, which is specific to IT.

The proposed new IT job classifications are listed be- low, along with the appropriate state Cal−HR identifi- cation number: 1406 Information Technology Manager II 1405 Information Technology Manager I 1404 Information Technology Supervisor II 1403 Information Technology Supervisor I 1415 Information Technology Specialist III 1414 Information Technology Specialist II 1402 Information Technology Specialist I 2. Consolidate attorney classifications. The existing Appendix A lists each classification (At- torney, Attorney III & IV) separately.

The Department proposes to amend the code to list all attorney classifi- cations as one listing. 3. Clarify Assistant Chief Counsel disclosures. The existing Appendix A lists different disclosure codes for Assistant Chief Counsels and Career Execu- tive Assignment (CEA) positions. The Department pro- poses to add to the Assistant Chief Counsel a notation stating that all Assistant Chief Counsels have the same disclosure codes, regardless of whether it is a civil ser- vice or CEA position and also makes other technical changes.

Information on the code amendment is available on the agency’s intranet site and/or attached to this email. Any interested person may submit written comments relating to the proposed amendment by submitting them no later than October 8, 2018, or at the conclusion of the public hearing, if requested, whichever comes later. At this time, no public hearing is scheduled. A person may request a hearing no later than September 23, 2018. The California Department of Public Health has determined that the proposed amendments: 1. Impose no mandate on local agencies or school districts. 2.

Impose no costs or savings on any state agency. 3. Impose no costs on any local agency or school district that are required to be reimbursed under

CALIFORNIA REGULATORY NOTICE REGISTER 2018, VOLUME NO. 34-Z 1332 GENERAL PUBLIC INTEREST DEPARTMENT OF FISH AND WILDLIFE CESA CONSISTENCY DETERMINATION REQUEST FOR Cottonwood Check and North Drainage Canal Lift Pump Station Projects 2080−2018−010−02 Sacramento and Sutter Counties The California Department of Fish and Wildlife (CDFW) received a notice on August 10, 2018 that the Natomas Central Mutual Water Company proposes to rely on a consultation between federal agencies to carry out two projects that may adversely affect a species pro- tected by the California Endangered Species Act (CESA).

The proposed projects involve the replace- ment of the existing check structure at Cottonwood Creek, and the new construction of a tailwater recovery lift pump station at the North Drainage Canal. Proposed activities will include, but are not limited to, demolition and removal of the check structure, excavation of trenches, in−place casting of concrete walls and other structures, placement of flow meters and buried electri- cal conduit, installation of discharge and intake pipes, and placement of riprap.

The Cottonwood Check struc- ture is located east of Powerline Road, north of West Elverta Road, and approximately 2.5 miles northeast of the Sacramento International Airport in Sacramento County. The North Drainage Canal Lift Pump Station is located west of Powerline Road and north of Sankey Road approximately 2.2 miles east of V erona, in Sutter County. The U.S. Fish and Wildlife Service (Service) issued a federal biological opinion (Service Ref. No. 08ESMF00−2018−F−2667−1) in a memorandum to the U.S.

Bureau of Reclamation on August 1, 2018, which considered the effects of the proposed projects on state and federally threatened giant garter snake (Thamnophis gigas). Pursuant to California Fish and Game Code

section 2080.1, the Natomas Central Mutual Water Company is requesting a determination that the BO and its associat- ed ITS are consistent with CESA for purposes of the proposed projects. If CDFW determines the BO and its associated ITS are consistent with CESA for the pro- posed projects, the Natomas Central Mutual Water Company will not be required to obtain an incidental take permit under Fish and Game Code

section 2081 subdivision (

b) for the proposed projects. DEPARTMENT OF FISH AND WILDLIFE FISH AND GAME CODE

SECTION 1653 CONSISTENCY DETERMINATION REQUEST FOR South Fork Trinity River lnstream Salmon Habitat Enhancement Project (Tracking Number: 1653−2018−024−001−R1) Trinity County California Department of Fish and Wildlife (CDFW) received a Request to Approve on August 8, 2018 that the Watershed Research Training Center proposes to carry out a habitat restoration or enhancement project pursuant to Fish and Game Code

section 1653. The pro- posed project involves placing 286 whole conifer trees, with canopy and root structure intact, in 18 discrete lo- cations within the active channel of the river. The pro- posed project will be carried out on a 5.2−mile stretch of the Middle South Fork Trinity River, located near the town of Hyampom, Trinity County, California.

On June 11, 2018, the North Coast Regional Water Quality Control Board (Regional Water Board) re- ceived a Notice of Intent (NOI) to comply with the terms of, and obtain coverage under, the General 401 Water Quality Certification Order for Small Habitat Restoration Projects (General 401 Order) for the South Fork Trinity River Instream Salmon Habitat Enhance- ment Project.

The Regional Water Board determined that the Project, as described in the NOI, was categori- cally exempt from California Environmental Quality Act (CEQA) review (section 15333 — Small Habitat Restoration Projects) and met the eligibility require- ments for coverage under the General 401 Order. The Regional Water Board issued a Notice of Applicability (WDID No. 1A170535WNTR; ECM PIN No. CW−835381) for coverage under the General 401 Order on July 23, 2018. The Watershed Research Training Center is request- ing a determination that the project and associated doc- uments are complete pursuant to Fish and Game Code

section 1653 subdivision (d). If CDFW determines the project is complete, the District will not be required to obtain an incidental take permit under Fish and Game Code

section 2081 subdivision (

b) or a Lake or Streambed Alteration Agreement under Fish and Game Code

section 1605 for the proposed project. In accordance with Fish and Game Code

section 1653 subdivision (e), if CDFW determines during the review, based on substantial evidence, that the request is not complete, the Watershed Research Training Center will have the opportunity to submit under Fish and Game Code

section 1652.

As an initial matter, the board and the California De- partment of Corrections and Rehabilitation (hereinafter CDCR) are two separate, albeit related, agencies. More importantly, each of these agencies is governed by, and has authority over, different divisions of Title 15 of the California Code of Regulations.

Specifically, the board is governed by Division 2 of that title and has authority to promulgate, amend, or repeal regulations under that division. In contrast, CDCR is governed by Division 3 of that title and has authority to promulgate, amend, or repeal regulations under that division. Neither agency has authority to promulgate, amend, or repeal regula- tions contained in the other agency’s division. In this case, petitioner appears to believe that CDCR and the board are a single agency, as evidenced by the petition’s request being addressed to CDCR, but sub- mitted to the board.

Moreover, the specific regulation sections petitioner is requesting to be appealed fall within Division 3 of Title 15 of the California Code of Regulations. Only CDCR has the authority to make any decisions with regard to those two regulatory sections. The board has no authority to consider the petitioner’s request. Therefore, the board DENIES petitioner’s request to repeal the California Code of Regulations, Title 15, Di- vision 3, sections 3521.2(

b) and 3522(a)(
