EXISTING LAWS AND REGULATIONS Existing l aw, F AC S ection 4 07, p rovides t hat the S ecretary m ay a dopt s uch r egulations a s a re reasonably n ecessary t o ca rry o ut t he p rovisions o f this c ode w hich t he S ecretary is d irected o r a uthorized to administer or enforce. Existing l aw, F AC 8 1006, r equires t he D epartment to a dopt s ampling p rocedures a nd a pprove l aboratories and laboratory testing methods. Existing T itle 3 C CR S ection 4 900 e stablishes t he conditions f or r egistration a nd t he r egistration f ees f or industrial h emp g rowers.

T his a mendment p rovides the n ecessary r egulatory m echanism t o a llow t he laboratory testing of industrial hemp.

Section 4940 S ampling Timeframe and Pre– Harvest Notification for Industrial Hemp This se ction e stablishes t hat s ampling f or T HC concentration s hall t ake p lace n o l ater t han 1 1 calendar d ays b efore t he a nticipated h arvest s tart d ate listed o n t he p re–harvest r eport i nstead o f s ix d ays. Additional s ampling a nd t esting w ill b e r equired f or any c hanges t o t he h arvest d ate t hat r esults i n h arvest activities t o o ccur m ore t han 3 0 ca lendar d ays a fter the s ample c ollection d ate. T he r equirement i n C CR

Section 4940(a)(1), as amended, will allow the sample to b e c ollected e arlier t o a ccommodate t he t imeframe for s ample d elivery a nd l aboratory t esting f or T HC concentration. Furthermore, C CR S ection 4 940(a)(2), a s a mended, will c hange t he h arvest t imeframe f rom 1 5 t o 3 0 d ays. This is n ecessary b ecause t he c urrent t imeframe prescribed b y s tate r egulation is t he m inimum n eeded under i deal c onditions a nd l eaves n o m argin o f t ime for common or uncommon contingencies.

The T HC s ampling p rocess b egins w hen t he registrant s ubmits a s igned p re–harvest r eport t o t heir commissioner a t l east 3 0 ca lendar d ays p rior t o t he anticipated h arvest s tart d ate. T his w ill a llow e nough time f or t he c ommissioner t o s chedule a s taff m ember to o versee t he s ampling t o e nsure t he a ccuracy a nd sanitation o f s amples a nd fi elds ( FAC 8 1006(e)(3) (D)). Section 4944 N otification of Laboratory Test Report This se ction e stablishes t he n otification r equirements for l aboratory t esting r eports. D PM is a t oxic a ir c ontaminant that ca n s ubstantially i ncrease t he r isk o f d eveloping cancer a nd o ther h ealth p roblems s uch a s i ncreased respiratory i llnesses, r isk o f h eart d isease, a nd premature d eath. D PM e missions f rom C HC e ngines are p rojected t o b ecome e ven m ore s ignificant d ue to t he c ontinued o peration o f C HC w hile e missions from other mobile sources are decreasing due to more stringent r egulations a nd c leaner t echnologies.

T he emissions f rom C HC i mpose u ncompensated h ealth and e nvironmental c osts t o t he n earby c ommunities and must be reduced to the greatest possible extent. In a ddition, a s m entioned ab ove, C alifornia is f acing challenges i n a ttaining c ompliance w ith N AAQS f or ozone a nd P M2.5 t hroughout m any r egions o f t he State. Chapter 136, St atutes of 20 17), CA RB cr eated th e Community Ai r Pro tection Pro gram (C APP) to address the en vironmental an d he alth in equities fro m air pollution ex perienced by ce rtain dis advantaged communities (D AC) in th e St ate. Th e CA PP Blueprint contains a lis t of st atewide ac tions th at should be undertaken to ac hieve re ductions in th ese disproportionally bu rdened co mmunities.1 Many CHC operate in or ad jacent to DA Cs, an d em ission reductions fro m th ese ve ssels wi ll di rectly be nefit these communities ex periencing cu mulative ex posure burden.

Additionally, Go vernor Ne wsom’s Ex ecutive Or der N–79–20 directed CA RB an d ot her St ate age ncies to transition off –road ve hicles an d eq uipment to 10 0 percent zero–emission by 20 35 wh ere fe asible. To address this, st aff pro poses pro visions to ac celerate deployment of Ze ro–Emission an d Ad vanced Technologies (Z EAT) to CH C, wh ich in cludes requiring all sh ort–run fe rries to swi tch to ze ro– emissions propulsion an d au xiliary po wer sy stems, and for new ex cursion ve ssels to be eq uipped wi th zero–emission capab le hy brid sy stems.

Th ere ar e ot her use cases of CH C op erations th at can be tr ansitioned to zero–emission ov er th e co ming de cade. Th erefore, in response to Ex ecutive Or der N– 79–20, CA RB st aff has proposed am endments th at cr eates co mpliance flexibility for in troducing ze ro–emission te chnology into the marine market. CARB may al so co nsider ot her ch anges to th e sections affected, as lis ted on page tw o of th is no tice, or other sections wi thin th e sc ope of th is no tice, du ring the course of this rulemaking process.

OBJECTIVES AND BENEFITS OF TH E PROPOSED REGULATORY ACTION The Proposed Am endments wo uld es tablish mo re stringent requirements fo r in –use an d ne w CH C, expand the regulatory re quirements to ve ssel cat egories that were pr eviously ex empt fro m in –use ve ssel requirements, an d ap ply re porting, in frastructure, and other requirements to fa cilities, su ch as sea ports, terminals, m arinas, a nd h arbors t hat c onduct b usiness with CHC.

Th e Pro posed Am endments wo uld further reduce em issions fro m CH C by es tablishing requirements th at sp ecified cat egories of CH C mu st deploy zero em itting te chnologies. Staff estimated th at fro m 20 23 th rough 20 38, th e Proposed Am endments wo uld re duce cu mulative statewide emissions by ap proximately 1, 610 to ns of PM2.5, 1,680 to ns of DP M, 34 ,340 to ns of NO x, 2, 460 tons of ROG, an d 46 2,330 met ric to ns (M

T) of GH G, relative to baseline conditions. The Proposed Am endments ar e ex pected to im prove California residents’ he alth be nefits, es pecially th ose in communities lo cated ne ar Ca lifornia’s sea ports and marine te rminals. Ma ny of th ese co mmunities are disadvantaged an d be ar a dis proportionate he alth burden due to th eir cl ose pro ximity to em issions fro m CHC (at dock, an d in tr ansit) an d ot her em ission sources including tr ucks, lo comotives, an d te rminal equipment ser ving th e sea ports.

Th ese im provements in health benefits ar e an ticipated to in clude re ductions of 531 premature de aths re duced, 73 hos pital admissions fo r car diovascular il lness, 88 hos pital admissions fo r re spiratory il lness an d 23 6 em ergency room visits. Th e to tal st atewide va luation du e to avoided health ou tcomes bet ween 20 23 an d 20 38 totaled $5.25 billion. Additionally, po tential can cer ris ks ar e ex pected to decrease as ex posure to DP M is re duced.

In addition to re gional an d lo cal ai r qu ality be nefits, passengers on board ve ssels wo uld ha ve th e po tential for substantially le ss ex posure to ai r po llutants, su ch as DPM and NOx. In 2038 without th e Pro posed am endments, in th e San Francisco Ba y Ar ea Ai r Ba sin, abo ut 7 mi llion people, including 0. 5 mi llion pe ople wh o li ve in DA Cs, are estimated to be ex posed to a po tential can cer ris k of greater than 1 ch ance pe r mi llion fro m ex posure to DPM.

Under th e Pro posed Am endments co mpared to a baseline of the Current Regulation in 2038: ● the population we ighted–average can cer ris k would be reduced fro m 12 ch ances pe r mi llion to 1 chance per million; ● the population ex posure to a po tential can cer ris k level of greater th an 50 ch ances pe r mi llion wo uld be eliminated; and, ● the population th at wo uld be ex posed to a potential cancer ris k gr eater th an 1 ch ance pe r million would reduce to 2 million.

In 2038 without th e Pro posed Am endments, in the South Coast Ai r Ba sin, abo ut 15 mi llion pe ople, including 6 mi llion pe ople wh o li ve in DA Cs, ar e estimated to be ex posed to a po tential can cer ris k of greater than 1 ch ance pe r mi llion fro m ex posure to DPM. Under th e Pro posed Am endments co mpared to a baseline of the Current Regulation in 2038:

The f ollowing is a s ummary o f t he k ey p rovisions introduced in the Proposed Amendments. 1. I n–Use and New–Build Vessel Emissions Performance Standards Staff p roposes m ore s tringent e ngine e missions performance s tandards f or N Ox a nd pa rticulate m atter (PM).

V essel o wners a nd o perators w ould n eed t o meet p erformance s tandards b etween 2 023 a nd 2 032 according t o a s chedule b ased o n v essel ca tegory a nd engine m odel y ear. T o m eet t he r equired e missions performance s tandards, v essel o wners a nd o perators could c hoose t o r epower a nd r etrofit e ngines o n i n– use v essels o r o btain a n ew–build v essel.

F or e ngines rated l ess t han o r e qual t o 6 00 k ilowatts ( kW), t he Proposed A mendments w ould r equire a p erformance standard e quivalent t o T ier 3 m arine e ngine p lus a d iesel pa rticulate fi lter ( DPF), o r T ier 4 m arine o r off–road e ngine p lus a D PF i f t here is a n a vailable engine m odel c ertified t o t he T ier 4 m arine o r o ff–road engine s tandards b y t he c ompliance d ate o f t he e ngine. S taff is p roposing a performance s tandard t hat is m ore s tringent t han t he U.S. E PA s tandards f or m arine T ier 3 a nd m arine T ier 4 e ngines. I t is i mportant t o n ote t hat i n t he P roposed Amendments t o t he C HC R egulation, C ARB is n ot proposing n ew e mission s tandards f or m arine e ngine manufacturers selling engines in California. 2. E xpanded Vessel Categories Subjecting a dditional C HC v essel ca tegories t o i n– use r equirements w ould a chieve a dditional e mission reductions t hat a re n eeded i n t he a reas w here C HC operate.

S taff is p roposing t o a dd t he f ollowing v essel categories t o t he i n–use r equirements o f t he P roposed Amendments: c ommercial p assenger fi shing v essels (CPFV), c ommercial fi shing v essels, a ll t ank barges, p ilot v essels, a nd w orkboats. I ncluding t hese categories w ill r egulate 2 ,095 m ore v essels o ut o f t he approximately 3 ,159 C HC t hat a re e stimated t o o perate in Regulated California Waters (RCW) in 2023. 3.

Ma ndates for Zero–Emission and Advanced Technologies (ZEAT) The P roposed A mendments i nclude Z EAT mandates w here t echnology is m ore f easible: n ew excursion v essels w ould n eed t o b e z ero–emission capable b y 2 025, a nd n ew a nd i n–use s hort–run f erries to b e z ero–emission b y 2 026. I n a ddition, C ARB staff is p roposing a r egulatory i ncentive f ramework that w ould e ncourage a doption a s Z EAT t echnology advancements a re m ade i n t he m arine s ector.

I f a vessel owner or operator adopts ZEAT early or where not o therwise r equired, a dditional c ompliance t ime could b e g ranted t o o ther e ngines o r v essels w ithin t he fleet. 4. R enewable Diesel The P roposed A mendments w ould r equire v essels to u se r enewable d iesel w hen o perating i n C alifornia beginning o n J anuary 1 , 2 023. R enewable d iesel is a d rop–in f uel t hat is a lready b eing u sed w idely i n diesel e ngines a cross t he S tate, i ncluding t hose i n the m arine se ctor.

T he u se o f r enewable d iesel w ill achieve immediate NOx and PM emission reductions, resulting i n h ealth b enefits f or w orkers a nd r esidents. Additionally, s ubstituting f ossil d iesel w ith r enewable diesel will reduce the State’s GHG emissions and help California achieve its climate targets. 5.

L ow–Use Compliance Pathway The C urrent R egulation p rovides a l ow–use compliance pa thway t hat e xempts e ngines f rom i n– use r equirements i f e ngine h ours d o n ot e xceed a n annual t hreshold o f 8 0 h ours f or d redges a nd b arges, and 3 00 h ours f or a ll o ther r egulated i n–use v essel categories.

T he P roposed A mendments w ould c hange this pa thway t o r eflect t he d istinctions b etween e ngine tiers, i n o rder t o p rovide fl exibility t o s takeholders who h ave a lready up graded t o c leaner e ngines, while c ontinuing t o r emove e ngines w ith t he l owest emissions p erformance s tandards. P re–Tier 1 , T ier 1 , Tier 2 a nd T ier 3 o r 4 e ngines w ill b e e xempted f rom in–use r equirements i f t hey o perate b elow a t hreshold of 8 0, 3 00, 4 00, a nd 7 00 h ours, r espectively.

A lternative Control of Emissions Staff is a lso p roposing t o m odify t he p reexisting Alternative C ontrol o f E missions ( ACE) p rovision. The A CE c urrently a llows a nd w ould c ontinue t o allow vessel owners and operators to comply with the Proposed A mendments t hrough a n a lternative m eans other t han d irectly c omplying w ith t he ca lendar y ear

schedule f or e ngine o r v essel c ompliance. U nder an A CE, a n a pplicant w ould b e ab le t o c omply b y receiving a pproval f rom t he E xecutive O fficer ( EO) t o pursue a n a lternative t hat i ncludes, b ut is n ot l imited to, a ny c ombination o f e ngine m odifications, e xhaust treatment c ontrol, e ngine r epowers, u se o f a lternative fuels o r a dditives, fl eet a veraging, o r a ny o ther m easures that, w hen i mplemented, w ill s ufficiently r educe emissions e quivalent t o t he e missions p erformance standards identified in the Proposed Amendments. 8.
