Section 5 521 p rovides f or a n a pplication p rocess for t he a llocation o f t he t ax c redits. T he a pplication process s hall b e i n t wo p hases. P hase 1 r equires t he applicant t o c omplete a n o nline a pplication. P hase II w ill r equire t he a pplicant t o s ubmit a q ualified expenditure b udget, a O ne–Line S chedule, a F ringe Matrix, S creenplay, n arrative s tatement o r r elocating statement, a financial plan and a diversity plan. Subsection (1)(

A) provides for an attestation for any television se ries t hat is r elocating t o C alifornia f or fiscal years 2021–22 and/or 2022–23. In S ubsection ( 4)(A), d ue t o t he n ew d efinition o f a T elevision S eries t hat R elocated t o C alifornia, t he on–line p ortal a utomatically e liminates t he n eed f or these p rojects t o a nswer q ualifying q uestions w hich pertain t o t he o riginal d efinition o f a T elevision S eries that Relocated to California. Subsection ( k)(8) r equires a r elocating s tatement for a ll T V se ries r elocating t o C alifornia.

T his c lause now i ncludes t he n eed f or t he r elocating s tatement t o include t he q ualifying t erms f or a r elocating T V se ries for fiscal years 2021–22 and/or 2022–23. Subsection ( k)(10) p rovides t hat a ll p rojects a re n ow required t o s ubmit a s ummary o f v oluntary p rograms to i ncrease r epresentation o f w omen a nd m inorities as w ell a s i nformation ab out h ow t hese p rograms a re publicized t o i nterested pa rties; p reviously, t he l owest tier o f I ndependent F ilm p rojects w as e xcluded f rom this requirement.

Subsection ( n)(1) is m odified t o i ndicate, a s p er statutory r equirements, t he a llocation a mount f or all r ecurring T V se ries w ill n ot e xceed t he a mount approved in its previous season. Subsection ( n)(2) p rovides t hat T elevision S eries t hat Relocated t o C alifornia a pplying f or a n a llocation i n subsequent se asons a re ca pped a t t he a mount o f t heir previous se ason’s c redit a llocation l etter o r l etters. The o riginal s ubsection ( n)(2), w hich d iscussed prioritization o f r ecurring T V se ries, h as b een d eleted.

Section 5 522 i dentifies t he e ligibility r equirements for Program 3.0. Subsection ( c)(4) is a n a dded c lause w hich e xplains the q ualifications f or a T elevision S eries t hat R elocated to C alifornia d uring fi scal y ears 2 021–22 a nd 2 022–23. Subsection (

f) a dds a T elevision S eries t hat R elocated to C alifornia o n t he l ist o f q ualified p roductions whose q ualified e xpenditure ca p is a m aximum o f o ne hundred million dollars ($100,000,000).

Section 5 524 p rovides f or t he p rocedures i n allocating the tax credits. In S ubsection ( b), a p rovision t hat d elineated h ow unused c redits f rom p revious t ax c redit p rograms will b e a llocated h as b een d eleted a nd r eplaced w ith a s tatement t hat f or fi scal y ears 2 021–22 a nd 2 022–23, an a dditional fi fteen m illion d ollars ( $15,000,000) i n credits w ill b e g ranted e xclusively t o T elevision S eries that R elocated t o C alifornia a nd se venty–five m illion dollars ( $75,000,000) i n c redits w ill b e g ranted exclusively to recurring TV series.

Section 5 525 set s f orth t he e lements o f P hase I II and p rovides r eporting r equirements f or a p roduction company d uring t he fi lming o f t he Q ualified M otion Picture. Subsection ( a)(5) o utlines t he r equirement t o m ake a financial c ontribution t o f und t he p ilot ca reer pa thways training p rogram. T he c ontribution is b ased o n 0 .25 percent o f t he e stimated t ax c redit a nd p reviously required t he c ontribution t o b e pa id n o l ater t han ten b usiness d ays a fter a cceptance i nto t he p rogram. Subsection ( a)(5)(

B) e xtends t his d eadline t o n o l ater than t hirty b usiness d ays a fter a cceptance i nto t he program. CONSISTENCY AND COMPATIBILITY WITH EXISTING STATE REGULATIONS After c onducting a r eview f or a ny r egulations t hat would r elate t o o r a ffect t his a rea, t he C alifornia F ilm Commission B oard e valuated t his r egulatory p roposal and fi nds t hat i t is n ot i nconsistent o r i ncompatible with existing state regulations.

ANTICIPATED BENEFITS OF THE PROPOSED REGULATION The proposed r egulations w ill provide a program to the m otion p icture i ndustry a llocating t ax c redits f or qualified m otion p ictures. T hese t ax c redit i ncentives will e ncourage p roduction c ompanies r egardless o f distribution o utlet t o fi lm i n C alifornia i nstead o f other s tates, p rovinces a nd c ountries. P rogram 3 .0 is structured t o e mphasize j ob c reation w hen a llocating tax c redits a nd p rovides se parate f unding ca tegories to e nsure t ax c redits f or m ultiple t ypes o f p roductions.

S mall b usinesses i n California d o, h owever, p rovide g oods a nd se rvices t o the b usinesses c omplying w ith t hese r egulations a nd will benefit from the additional filming in California.

RESULTS OF THE ECONOMIC I M PACT A NA LYSIS Adoption o f t hese r egulations w ill: ( 1) f acilitate the c reation o f j obs w ithin C alifornia; ( 2) f acilitate the c reation o f b usinesses w ithin C alifornia; a nd ( 3) facilitate t he e xpansion o f b usinesses c urrently d oing business w ithin C alifornia. A s s tated ab ove u nder Anticipated B enefits o f t he P roposed R egulation, these t ax c redit i ncentives w ill e ncourage p roduction companies r egardless o f d istribution o utlet t o fi lm in C alifornia i nstead o f o ther s tates, p rovinces and c ountries o ffering i ncentives.

P rogram 3 .0 is structured t o e mphasize j ob c reation a nd p rovides separate f unding ca tegories t o e nsure t ax c redits f or multiple t ypes o f p roductions. T he p rogram is e nabling California t o i ncrease t he n umber o f p roductions a nd therefore, j obs a nd d ollars s pent i n s tate.
