An act relating to well stimulation; providing a

short title; amending s. 377.19, F.S.; defining the term 3 “extreme well stimulation”; creating s. 377.2405, 4 F.S.; prohibiting persons from engaging in extreme well stimulation; prohibiting the Department of Environmental Protection from issuing permits that authorize extreme well stimulation; prohibiting the department from authorizing certain permitholders to engage in extreme well stimulation on or after a specified date; imposing a specified fine for violations; providing an effective date. 12

Be It Enacted by the Legislature of the State of Florida: 14

Section 1. This act may be cited as the “Stop Fracking Act.” 17

Section 377.2405, Florida Statutes, is created to read: 48 377.2405 Well stimulation.— 49

(1) A person may not engage in extreme well stimulation in this state. 51

(2) The department may not issue an oil or gas drilling or operating permit authorizing extreme well stimulation. 53

(3) The department may not authorize any person holding a permit issued pursuant to this

chapter or rules adopted thereunder to engage in extreme well stimulation on or after July 1, 2022. 57

(4) The department shall fix, impose, and collect a fine of Florida Senate - 2022 SB 208 34-00135-22 2022208__ CODING: Words stricken are deletions; words underlined are additions. up to $50,000 for each offense from any person, firm, 59 corporation, or governmental agency, or agent thereof, refusing to comply with or willfully violating this

section or any rule or order prescribed by the department thereunder. Each day during any portion of which such violation occurs constitutes a separate offense. 64

Section 4. This act shall take effect July 1, 2022. 65
