An act relating to county budget officers; amending s. 2 129.025, F.S.; specifying that the county budget 3 officer reports directly to the board of county 4 commissioners; prohibiting such officer from being a 5 member of the executive branch of county government 6 unless otherwise authorized; specifying the powers of 7 certain county entities while acting as ex-officio 8 budget officers; providing that any actions by such 9 officers do not violate specified prohibitions; 10 providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14

Section 1. Subsection (1) of

section 129.025, Florida 15 Statutes, is amended to read: 16 129.025 County budget officer.— 17 (1)(

a) Each board of county commissioners may designate a 18 county budget officer to carry out the duties set forth in this 19 chapter. The county budget officer reports directly to the board 20 and may not be a member of any executive branch of county 21 government, except as authorized in paragraph (b). 22 (

b) Unless the board designates a different officer, the 23 clerk of the circuit court or the county comptroller, if 24 applicable, shall be the ex-officio budget officer for the 25 purposes of this chapter.

The clerk of the circuit court or the 26 county comptroller, while acting as the ex-officio budget 27 officer, reports to the board in a strictly legislative 28 capacity, and any action taken by the clerk of the circuit court 29 Florida Senate - 2024 SB 1520 33-01400-24 20241520__ Page 2 of 2 CODING: Words stricken are deletions; words underlined are additions. or the county comptroller acting as an ex-officio budget officer 30 does not violate any prohibition on that individual also working 31 in an executive branch capacity. 32

Section 2. This act shall take effect July 1, 2024. 33
