An act relating to nonprofit agricultural organization health coverage; providing directives to the Division of Law Revision; providing a

short title; creating s. 4 632.701, F.S.; providing legislative purpose; defining the term “nonprofit agricultural organization”; 6 authorizing nonprofit agricultural organizations to provide health coverage; specifying that such coverage is not insurance for purposes of the Florida Insurance Code; providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12

Section 1. The Division of Law Revision is directed to: 14

(1) Revise the title of

chapter 632, Florida Statutes, to read “Fraternal Benefit Societies and Nonprofit Agricultural Organizations”; 17

(2) Create

part I of

chapter 632, Florida Statutes, 18 consisting of ss. 632.601-632.638, Florida Statutes, to be entitled “Fraternal Benefit Societies”; and 20

(3) Create

part II of

chapter 632, Florida Statutes, 21 consisting of s. 632.701, Florida Statutes, to be entitled 22 “Nonprofit Agricultural Organizations.” 23

Section 2. This act may be cited as the “Nonprofit Agricultural Organization Health Coverage Act of 2025.” 25

Section

Section 632.701, Florida Statutes, is created to read: 27 632.701 Nonprofit agricultural organization health coverage.— 29 Florida Senate - 2025 SB 480 18-00843-25 2025480__ CODING: Words stricken are deletions; words underlined are additions.

(1) The purpose of this

section is to authorize nonprofit agricultural organizations to offer health coverage options to their members. 32

(2) For purposes of this section, the term “nonprofit agricultural organization” means an organization that meets all of the following criteria: 35

(

a) Is domiciled in this state. 36

(

b) Is exempt from federal income tax under s. 501(c)(3) of the Internal Revenue Code. 38

(

c) Was created primarily to promote programs for the development of rural communities and the economic stability and sustainability of farmers in this state. 41

(

d) Exists to serve its members beyond only offering health coverage. 43

(

e) Collects annual dues from its members. 44

(

f) Was in existence before 1945. 45

(

g) Is composed of members who, collectively, are residents of the majority of counties in this state. 47

(3) Notwithstanding any law to the contrary, a nonprofit agricultural organization may offer health coverage. Such coverage is not insurance for purposes of the Florida Insurance Code. 51

Section 4. This act shall take effect July 1, 2025. 52
