An act relating to fees; amending s. 403.71853, F.S.; 2 authorizing the Department of Environmental Protection to charge a fee for reclamation facility permits; 4 providing a limitation for such fee; providing a contingent effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8

Section 1. Paragraph

(

a) of subsection (5) of

section 10 403.71853, Florida Statutes, as created by SB ___, 2023 Regular Session, is amended to read: 12 403.71853 Recycling of covered electronic devices.— 13

(5) RULES.—The department shall adopt rules to carry out this section. Such rules must include all of the following: 15

(

a) Criteria and procedures for obtaining a reclamation facility permit. The department may charge a fee not to exceed 17 $5,000 annually for a reclamation facility permit. 18

Section 2. This act shall take effect on the same date that SB ___ or similar legislation takes effect, if such legislation is adopted in the same legislative session or an extension thereof and becomes a law. 22
