An act relating to pretrial detention; amending s. 2 907.041, F.S.; revising the definition of the term 3 “dangerous crime” to include extortion and written threats to kill; providing an effective date. 5
Be It Enacted by the Legislature of the State of Florida: 7
Section 1. Paragraph
(
a) of subsection (4) of
section 9 907.041, Florida Statutes, is amended to read: 10 907.041 Pretrial detention and release.— 11
(4) PRETRIAL DETENTION.— 12
(
a) As used in this subsection, “dangerous crime” means any of the following: 14 1. Arson; 15 2. Aggravated assault; 16 3. Aggravated battery; 17 4. Illegal use of explosives; 18 5. Child abuse or aggravated child abuse; 19 6. Abuse of an elderly person or disabled adult, or aggravated abuse of an elderly person or disabled adult; 21 7. Aircraft piracy; 22 8. Kidnapping; 23 9. Homicide; 24 10. Manslaughter; 25 11. Sexual battery; 26 12. Robbery; 27 13. Carjacking; 28 14.
Lewd, lascivious, or indecent assault or act upon or in Florida Senate - 2023 SB 482 24-00385A-23 2023482__ CODING: Words stricken are deletions; words underlined are additions. presence of a child under the age of years; 30 15. Sexual activity with a child, who is years of age or older but less than years of age, by or at solicitation of person in familial or custodial authority; 33 16. Burglary of a dwelling; 34 17. Stalking and aggravated stalking; 35 18. Act of domestic violence as defined in s. 741.28; 36 19. Home invasion robbery; 37 20. Act of terrorism as defined in s. 775.30; 38 21.
Manufacturing any substances in violation of
chapter 39 893; 40 22. Human trafficking; 41 23. Extortion in violation of s. 836.05; 42 24. Written threat to kill in violation of s. 836.10; and 43 25. Attempting or conspiring to commit any such crime; and 44 23. Human trafficking. 45
