An act relating to public records and meetings; 2 creating s. 461.0182, F.S.; providing an exemption 3 from public records requirements for certain 4 information held by the Department of Health or the 5 Board of Podiatric Medicine pursuant to the Interstate 6 Podiatric Medical Licensure Compact; authorizing the 7 disclosure of such information under certain 8 circumstances; providing an exemption from public 9 meetings requirements for certain meetings or portions 10 of certain meetings of the Interstate Podiatric 11 Medical Licensure Compact Commission; providing an 12 exemption from public records requirements for 13 recordings, minutes, and records generated during the 14 exempt meetings or portions of such meetings; 15 providing for future legislative review and repeal of 16 the exemptions; providing statements of public 17 necessity; providing a contingent effective date. 18 19 Be It Enacted by the Legislature of the State of Florida: 20 21

Section

Section 461.0182, Florida Statutes, is created 22 to read: 23 461.0182 Interstate Podiatric Medical Licensure Compact; 24 public records and meetings exemptions.— 25

(1) A podiatric physician’s personal identifying 26 information, other than the podiatric physician’s name, 27 licensure status, and licensure number, obtained from the 28 coordinated information system, as described in Art. VIII of s. 29 Florida Senate - 2026 SB 1314 40-01338-26 20261314__ Page 2 of 4 CODING: Words stricken are deletions; words underlined are additions. 461.0181, and held by the department or the board is exempt from 30 s. 119.07(1) and s. 24(a), Art.

I of the State Constitution 31 unless the state that originally reported the information to the 32 coordinated information system authorizes the disclosure of such 33 information by law. If disclosure is so authorized, such 34 information may be disclosed only to the extent authorized by 35 the law of the reporting state. 36 (2)(

a) A meeting or portion of a meeting of the Interstate 37 Podiatric Medical Licensure Compact Commission, established in 38 Art. XI of s. 461.0181, at which the commission must discuss 39 certain sensitive and confidential matters as specified in Art. 40 XI of s. 461.1081, is exempt from s. 286.011 and s. 24(b), Art. 41 I of the State Constitution. 42 (

b) Recordings, minutes, and records generated during an 43 exempt meeting or portion of such a meeting are exempt from s. 44 119.07(1) and s. 24(a), Art. I of the State Constitution. 45

(3) This

section is subject to the Open Government Sunset 46 Review Act in accordance with s. 119.15 and shall stand repealed 47 on October 2, 2031, unless reviewed and saved from repeal 48 through reenactment by the Legislature. 49

Section 2.

(1) The Legislature finds that it is a public 50 necessity that a podiatric physician’s personal identifying 51 information, other than the podiatric physician’s name, 52 licensure status, or licensure number, obtained from the 53 coordinated information system, as described in

Article VIII of 54 s. 461.0181, Florida Statutes, and held by the Department of 55 Health or the Board of Podiatric Medicine be made exempt from s. 56 119.07(1), Florida Statutes, and s. 24(a),

Article I of the 57 State Constitution. Protection of such information is required 58 Florida Senate - 2026 SB 1314 40-01338-26 20261314__ Page 3 of 4 CODING: Words stricken are deletions; words underlined are additions. under the Interstate Podiatric Medical Licensure Compact, which 59 a state must adopt in order to become a member state of the 60 compact. Without the public records exemption, this state will 61 be unable to effectively implement and administer the compact. 62 (2)(

a) The Legislature finds that it is a public necessity 63 that any meeting of the Interstate Podiatric Medical Licensure 64 Compact Commission or the executive committee or other committee 65 of the commission held as provided in s. 461.0181, Florida 66 Statutes, in which matters specifically exempted from disclosure 67 by federal or state law are discussed be made exempt from s. 68 286.011, Florida Statutes, and s. 24(b),

Article I of the State 69 Constitution. 70 (

b) The Interstate Podiatric Medical Licensure Compact 71 requires the closure of any meeting, or any portion of a 72 meeting, of the Interstate Podiatric Medical Licensure Compact 73 Commission if the commission determines by a two-thirds vote 74 that the commission must discuss certain sensitive and 75 confidential matters as specified in

Article XI of s. 461.1081, 76 Florida Statutes. In the absence of a public meetings exemption, 77 this state would be prohibited from becoming a member state of 78 the compact. 79

(3) The Legislature also finds that it is a public 80 necessity that the recordings, minutes, and records generated 81 during a meeting held as provided in s. 461.0181, Florida 82 Statutes, which is exempt from public meetings requirements be 83 made exempt from s. 119.07(1), Florida Statutes, and s. 24(a), 84

Article I of the State Constitution. Release of such information 85 would negate the public meetings exemption. As such, the 86 Legislature finds that the public records exemption is a public 87 Florida Senate - 2026 SB 1314 40-01338-26 20261314__ Page 4 of 4 CODING: Words stricken are deletions; words underlined are additions. necessity. 88

Section 3. This act shall take effect on the same date that 89 SB ___ or similar legislation takes effect, if such legislation 90 is adopted in the same legislative session or an extension 91 thereof and becomes a law. 92
