short title; creating s. 559.972, F.S.; 5 defining terms; creating s. 559.973, F.S.; requiring 6 original equipment manufacturers to make available 7 documentation, parts, and tools required for the 8 diagnosis, maintenance, or repair of mobility devices 9 and parts for such devices; requiring original 10 equipment manufacturers of mobility devices with 11 electronic security locks to make available any 12 special documentation, parts, and tools required to 13 access and reset the locks when disabled in the course 14 of diagnosis, maintenance, or repair; creating s. 15 559.974, F.S.; providing that violation of the act is 16 an unlawful practice under the Florida Deceptive and 17 Unfair Trade Practices Act; creating s. 559.975, F.S.; 18 providing that original equipment manufacturers are 19 not required to divulge trade secrets; providing that 20 the act does not alter the terms of an arrangement 21 between an authorized repair provider and an original 22 equipment manufacturer; providing an exception; 23 limiting the liability of original equipment 24 manufacturers and authorized repair providers in 25 certain circumstances; creating s. 559.976, F.S.; 26 providing applicability; providing an effective date. 27 28 Be It Enacted by the Legislature of the State of Florida: 29

Section 1.
Part XIV of
chapter 559, Florida Statutes, 31 consisting of ss. 559.971-559.976, is created and entitled 32 “Repair of Mobility Devices.” 33

Section 559.971, Florida Statutes, is created to 34 read: 35 559.971
Short title.—This part may be cited as the “Right 36 to Repair Act for Mobility Devices.” 37

Section 559.972, Florida Statutes, is created to 38 read: 39 559.972
Definitions.—As used in this part, the term: 40 (1) “Authorized repair provider” means an individual or a 41 business that has an arrangement with the original equipment 42 manufacturer under which the original equipment manufacturer 43 grants to the individual or business a license to use a trade 44 name, service mark, or other proprietary identifier for the 45 purposes of offering the services of diagnosis, maintenance, or 46 repair of a mobility device under the name of the original 47 equipment manufacturer, or other arrangement with the original 48 equipment manufacturer to offer such services on behalf of the 49 original equipment manufacturer.
An original equipment 50 manufacturer that offers the services of diagnosis, maintenance, 51 or repair of its own mobility device, and that does not have an 52 arrangement with an unaffiliated individual or business, is 53 considered an authorized repair provider with respect to 54 mobility devices. 55 (2) “Documentation” means a manual, diagram, reporting 56 output, service code description, schematic diagram, security 57 code, password, or any other guidance or information used in 58

a) Documentation made available by the original equipment 63 manufacturer at no charge, except that when a physical copy is 64 requested, a charge may be included for the reasonable actual 65 costs of preparing and sending the copy. 66 (
b) Tools made available by the original equipment 67 manufacturer at no charge: 68 1. Without requiring authorization or Internet access for 69 use or operation of the tools. 70 2. Without imposing impediments to access or use the tools 71 to diagnose, maintain, or repair and enable full functionality 72 of digital electronic equipment. 73 3. In a manner that does not impair the efficient and cost-74 effective performance of any such diagnosis, maintenance, or 75 repair. 76 77 However, if a tool is requested in physical form, a charge may 78 be included for the reasonable actual costs of preparing and 79 sending the tool. 80 (
c) Parts made available by the original equipment 81 manufacturer, either directly or through an authorized repair 82 provider, to independent repair providers and owners at costs 83 and terms that are equivalent to the most favorable costs and 84 terms under which an original equipment manufacturer offers the 85 parts to an authorized repair provider, and that: 86 1. Accounts for a discount, rebate, convenient and timely 87

Any other incentive or preference the original 90 manufacturer offers to an authorized repair provider; or 91 b. Any additional cost or impediment the original equipment 92 manufacturer imposes on an owner or independent repair provider. 93 2.
Are not conditioned upon or do not impose a substantial 94 obligation or restriction that is not reasonably necessary for 95 enabling the owner or independent repair provider to engage in 96 the diagnosis, maintenance, or repair of equipment made by or on 97 behalf of the original equipment manufacturer. 98 3.
Are not conditioned upon an arrangement with the 99 original equipment manufacturer. 100 (4) “Independent repair provider” means an individual or 101 business operating in this state which is unaffiliated with an 102 original equipment manufacturer and which is engaged in the 103 services of diagnosis, maintenance, or repair of mobility 104 devices. 105 (5) “Original equipment manufacturer” means a business 106 engaged in selling, leasing, or supplying new mobility devices 107 designed for individuals with physical disabilities including, 108 but not limited to, power wheelchairs, manual wheelchairs, 109 mobility scooters, and power assist devices for manual 110 wheelchairs which are manufactured by or on behalf of such 111 business for sale to an individual or business. 112 (6) “Owner” means an individual or business that owns or 113 leases a mobility device purchased or used in this state. 114 (7) “Part” means any replacement part, either new or used, 115 made available by an original equipment manufacturer for 116
Florida Senate - 2026 SB 586 17-00053A-26 2026586__ Page 5 of 7 CODING: Words stricken are deletions; words underlined are additions. purposes of effecting the services of maintenance or repair of a 117 mobility device manufactured by or on behalf of, sold, or 118 otherwise supplied by the original equipment manufacturer. 119 (8) “Tool” means any software, hardware, or other apparatus 120 used for the diagnosis, maintenance, or repair of a mobility 121 device, including, but not limited to, software or any other 122 mechanism that programs a new part, calibrates functionality, or 123 performs any other function required to return the mobility 124 device to its fully functional condition, which includes any 125 updates. 126 (9) “Trade secret” has the same meaning as in s. 688.002. 127

Section 559.973, Florida Statutes, is created to 128 read: 129 559.973 Requirements.— 130
(1) For mobility devices and parts for mobility devices 131 that are sold or used in this state, an original equipment 132 manufacturer must make available to any independent repair 133 provider or owner by, on behalf of, or sold by such original 134 equipment manufacturer, on fair and reasonable terms, any 135 documentation, parts, and tools required for the diagnosis, 136 maintenance, or repair of such devices and parts, which includes 137 any updates. The documentation, parts, and tools must be made 138 available either directly by the original equipment manufacturer 139 or by an authorized repair provider. 140
(2) For equipment that contains an electronic security lock 141 or other security-related function, the original equipment 142 manufacturer must make available to an owner or independent 143 repair provider, on fair and reasonable terms, any special 144 documentation, tools, and parts required to access and reset the 145

The 147 documentation, parts, and tools may be made available through 148 appropriate secure release systems. 149

Section 559.974, Florida Statutes, is created to 150 read: 151 559.974 Enforcement.—A violation of this
part is punishable 152 under the Florida Deceptive and Unfair Trade Practices Act. 153

Section 559.975, Florida Statutes, is created to 154 read: 155 559.975 Limitations.— 156
(1) This part does not require an original equipment 157 manufacturer to divulge a trade secret to an owner or 158 independent service provider. 159
(2) This part does not alter the terms of an arrangement 160 between an authorized repair provider and an original equipment 161 manufacturer, including, but not limited to, the performance or 162 provision of warranty or recall repair work by an authorized 163 repair provider on behalf of an original equipment manufacturer 164 and pursuant to such arrangement. However, any terms that waive, 165 avoid, restrict, or limit the original equipment manufacturer’s 166 obligation to comply with this part are void. 167
(3) An original equipment manufacturer or an authorized 168 repair provider is not liable for any damage or injury caused by 169 an independent repair provider or owner to a mobility device 170 which occurs during the course of repair, diagnosis, or 171 maintenance. 172
