An act relating to automated license plate recognition systems; amending s. 316.0778, F.S.; prohibiting homeowners’ associations from owning or operating an automated license plate recognition system; providing an effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8

Section

Section 316.0778, Florida Statutes, is amended to read: 11 316.0778 Automated license plate recognition systems; 12 prohibited uses; records retention.— 13

(1) As used in this section, the term “automated license plate recognition system” means a system of one or more mobile or fixed high-speed cameras combined with computer algorithms to convert images of license plates into computer-readable data. 17

(2) An automated license plate recognition system may not be owned or operated by a homeowners’ association as defined in s. 720.301(9). 20

(3) In consultation with the Department of Law Enforcement, 21 the Department of State shall establish a retention

schedule for records containing images and data generated through the use of an automated license plate recognition system. The retention

schedule must establish a maximum period that the records may be retained. 26

Section 2. This act shall take effect July 1, 2020. 27
