An act relating to public records; amending s. 2 626.171, F.S.; providing an exemption from public 3 records requirements for cellular telephone numbers 4 relating to records of certain insurance-related 5 licensures held by the Department of Financial 6 Services; providing retroactive applicability; 7 providing for future legislative review and repeal of 8 the exemptions; providing a statement of public 9 necessity; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13

Section 1. Subsection (8) is added to

section 626.171, 14 Florida Statutes, to read: 15 626.171 Application for license as an agent, customer 16 representative, adjuster, service representative, or reinsurance 17 intermediary.— 18 (8)(

a) Cellular telephone numbers collected by the 19 department pursuant to subsection (2) are exempt from s. 20 119.07(1) and s. 24(a), Art. I of the State Constitution. This 21 exemption applies to cellular telephone numbers held by the 22 department before, on, or after the effective date of the 23 exemption. 24 (

b) This subsection is subject to the Open Government 25 Sunset Review Act in accordance with s. 119.15 and shall stand 26 repealed on October 2, 2029, unless reviewed and saved from 27 repeal through reenactment by the Legislature. 28

Section 2. The Legislature finds that it is a public 29 Florida Senate - 2024 SB 1078 18-00862A-24 20241078__ Page 2 of 2 CODING: Words stricken are deletions; words underlined are additions. necessity that all cellular telephone numbers collected by the 30 Department of Financial Services pursuant to s. 626.171(2), 31 Florida Statutes, be exempt from public records requirements. 32 The Legislature finds that the unintentional publication of such 33 information may subject the filer to identity theft, financial 34 harm, or other adverse impacts.

Without the public records 35 exemption, the effective and efficient administration of the 36 electronic filing system, which is otherwise designed to 37 increase the ease of filing records, would be hindered. For 38 these reasons, the Legislature finds that it is a public 39 necessity to exempt such information from public records 40 requirements. 41

Section 3. This act shall take effect upon becoming a law. 42
