An act relating to a review under the Open Government Sunset Review Act; amending s. 502.222, F.S., which provides an exemption from public records requirements for a dairy industry business’ trade secrets held by the Department of Agriculture and Consumer Services; 6 removing the scheduled repeal of the exemption; 7 providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section

Section 502.222, Florida Statutes, is amended to read: 13 502.222 Information relating to trade secrets confidential.—The records of the department regarding matters encompassed by this

chapter are public records, subject to

chapter 119, except that any information that would reveal a trade secret, as defined in s. 812.081, of a dairy industry business is confidential and exempt from s. 119.07(1) and s. 19 24(a), Art. I of the State Constitution. If the department determines that any information requested by the public will reveal a trade secret, it shall, in writing, inform the person making the request of that determination. The determination is a final order as defined in s. 120.52. This

section is subject to the Open Government Sunset Review Act in accordance with s. 25 119.15 and shall stand repealed on October 2, 2021, unless reviewed and saved from repeal through reenactment by the Legislature. 28

Section 2. This act shall take effect October 1, 2021. 29
