An act relating to mandatory remand to custody upon 2 conviction of dangerous crimes; providing a short 3 title; creating s. 903.0472, F.S.; requiring a court 4 to remand a person found guilty of a dangerous crime 5 to custody immediately; requiring such person to 6 remain in custody pending sentencing or further 7 proceedings without the possibility of release on 8 bond; prohibiting a court from granting postconviction 9 bond or other release for a person found guilty of a 10 dangerous crime; providing applicability; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15
Section 1. This act may be cited as “Missy’s Law.” 16
Section
Section 903.0472, Florida Statutes, is created 17 to read: 18 903.0472 Mandatory remand to custody upon conviction of 19 dangerous crimes.— 20
(1) Notwithstanding any provision in this
chapter to the 21 contrary, upon a finding of guilt of any person of a dangerous 22 crime as defined in s. 907.041(5)(a), the court shall remand the 23 person to custody immediately, and the person shall remain in 24 custody pending sentencing or further proceedings without the 25 possibility of release on bond. 26
(2) A court may not grant postconviction bond or other 27 release for a person who has been found guilty of, or who has 28 entered a plea of guilty or nolo contendere to, a dangerous 29 Florida Senate - 2026 SB 928 33-01138-26 2026928__ Page 2 of 2 CODING: Words stricken are deletions; words underlined are additions. crime as defined in s. 907.041(5)(a). 30
(3) This
section applies regardless of whether the person 31 intends to appeal or has filed a notice of appeal. 32
(4) This
section does not apply if the finding of guilt 33 that formed the basis of the remand has been: 34 (
a) Vacated; 35 (
b) Reversed on appeal; 36 (
c) Set aside by judgment of acquittal; or 37 (
d) Otherwise nullified. 38
