An act relating to the Independent Living Task Force; 2 creating s. 420.5075, F.S.; establishing the 3 Independent Living Task Force within the Florida 4 Housing Finance Corporation for certain purposes; 5 requiring the corporation to use existing and 6 available resources to administer and support the 7 activities of the task force; providing for duties, 8 membership, and meetings of the task force; requiring 9 the members of the task force to serve without 10 compensation; requiring the task force to submit a 11 report to the Governor and the Legislature by a 12 specified date; providing for expiration of specified 13 provisions on, and the dissolution of the task force 14 by, a specified date; providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18

Section

Section 420.5075, Florida Statutes, is created 19 to read: 20 420.5075 Independent Living Task Force.— 21

(1) The Independent Living Task Force, a task force as 22 defined in s. 20.03(8), is established within the Florida 23 Housing Finance Corporation for administrative purposes only. 24 The corporation shall use existing and available resources to 25 administer and support the activities of the task force under 26 this section. 27

(2) The task force shall develop and evaluate policy 28 proposals that incentivize building contractors and developers 29 Florida Senate - 2020 SB 340 29-00538-20 2020340__ Page 2 of 4 CODING: Words stricken are deletions; words underlined are additions. to create units within mixed-use developments that may be used 30 as low-cost, supportive, and affordable housing for individuals 31 who are in need of such housing and who have a developmental 32 disability, as defined in s. 393.063, or a mental illness, as 33 defined in s. 394.455. 34

(3) The task force shall consist of the following members: 35 (

a) The executive director of the Florida Housing Finance 36 Corporation or his or her designee, who shall serve as chair of 37 the task force. 38 (

b) The director of the Agency for Persons with 39 Disabilities or his or her designee. 40 (

c) The Secretary of Children and Families or his or her 41 designee. 42 (

d) The executive director of the Department of Economic 43 Opportunity or his or her designee. 44 (

e) The Secretary of Business and Professional Regulation 45 or his or her designee. 46 (

f) The executive director of the Commission for the 47 Transportation Disadvantaged or his or her designee. 48 (

g) An individual appointed by the Governor. 49 (

h) The following members appointed by the executive 50 director of the Florida Housing Finance Corporation: 51 1. A representative from the Florida Supportive Housing 52 Coalition. 53 2. A representative from the Florida Housing Coalition. 54 3. A representative from the Florida Independent Living 55 Council. 56 4. A representative from the ARC of Florida. 57 5. A representative from the Florida League of Cities. 60 7. A representative from the Florida Association of 61 Counties. 62 8. A representative from the Association of Florida 63 Community Developers. 64 9. A representative from the Associated Builders and 65 Contractors of Florida. 66 10. A representative from the Florida Association of 67 Rehabilitation Facilities. 68 11. A representative from the Florida Developmental 69 Disabilities Council. 70 12. A representative from the banking industry who finances 71 mixed-used developments. 72 13.

A representative from the Coalition of Affordable 73 Housing Providers. 74 14. A representative from the Commercial Real Estate 75 Development Association. 76 15. An attorney who is a member in good standing of the 77 Elder Law

(4) Members of the task force shall serve without 79 compensation and are not entitled to reimbursement for per diem 80 or travel expenses. The task force shall convene its first 81 meeting by June 1, 2020, and shall meet as often as necessary to 82 fulfill its responsibilities under this section. Meetings may be 83 conducted in person, by teleconference, or by other electronic 84 means. 85

a) Identify potential barriers and opportunities in 88 existing policies, rules, or laws to incentivize building 89 contractors and developers to create low-cost, supportive, and 90 affordable housing units for individuals with developmental 91 disabilities or mental illness within mixed-use developments. 92 (

b) Recommend modifications to existing policies, rules, or 93 laws or propose new policies, rules, or laws, such as allowing 94 greater density, which would allow for the creation of low-cost, 95 supportive, and affordable housing units for individuals with 96 developmental disabilities or mental illness within mixed-use 97 developments. 98 (

c) Recommend financial and regulatory incentives to 99 encourage building contractors and developers to create low-100 cost, supportive, and affordable housing units for individuals 101 with developmental disabilities or mental illness within mixed-102 use developments. 103 (

d) Propose funding mechanisms for the development and 104 maintenance of spaces for low-cost, supportive, and affordable 105 housing units for individuals with developmental disabilities or 106 mental illness within mixed-use developments. 107

(6) The task force shall submit a report by December 1, 108 2020, to the Governor, the President of the Senate, and the 109 Speaker of the House of Representatives which includes its 110 findings, conclusions, and recommendations. 111

(7) This

section expires on, and the task force must 112 dissolve on or before, January 1, 2021. 113

Section 2. This act shall take effect upon becoming a law. 114
