An act relating to public schools; creating s. 2 1002.44, F.S.; authorizing public schools in this 3 state to enroll a student who meets certain attendance 4 criteria on a part-time basis, subject to space and 5 availability; providing for full-time equivalent 6 student membership; providing construction; amending 7 s. 1002.394, F.S.; authorizing funds awarded under the 8 Family Empowerment Scholarship Program to be used for 9 contracted services provided by a public school or 10 school district; providing construction; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15

Section

Section 1002.44, Florida Statutes, is created to 16 read: 17 1002.44 Part-time public school enrollment.— 18

(1) Any public school in this state, including a charter 19 school, may enroll a student who meets the regular school 20 attendance criteria of s. 1003.01(13)(b)-(

e) on a part-time 21 basis, subject to space and availability according to the 22 school’s capacity determined pursuant to s. 1002.31(2)(b). 23

(2) Students attending a public school on a part-time basis 24 pursuant to this

section shall generate full-time equivalent 25 student membership as described in s. 1011.61(1)(b). 26

Section 2. Paragraph (

a) of subsection (4) of

section 30 1002.394, Florida Statutes, is amended to read: 31 1002.394 The Family Empowerment Scholarship Program.— 32

(4) AUTHORIZED USES OF PROGRAM FUNDS.— 33 (

a) Program funds awarded to a student determined eligible 34 pursuant to paragraph (3)(

a) may be used for: 35 1. Tuition and fees at an eligible private school; or 36 2. Transportation to a Florida public school in which a 37 student is enrolled and that is different from the school to 38 which the student was assigned or to a lab school as defined in 39 s. 1002.32 if the student is determined eligible pursuant to 40 subparagraph (3)(a)1. or subparagraph (3)(a)2.; or 41 3. Contracted services, including classes, provided by a 42 public school or school district. A student who receives 43 services under a contract pursuant to this subparagraph is not 44 considered enrolled in a public school for eligibility purposes 45 under subsection (6). 46

Section 3. This act shall take effect July 1, 2022. 47
