An act relating to automatic renewal subscription cancellations; creating s. 501.166, F.S.; defining terms; requiring businesses that offer automatic renewal subscriptions to provide consumers with certain methods to cancel the service; declaring that violations are unfair trade practices and subject to the Florida Deceptive and Unfair Trade Practices Act; 8 providing applicability; providing an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11

Section

Section 501.166, Florida Statutes, is created to read: 14 501.166 Cancellation of automatic renewal subscriptions for goods or services.— 16

(1) As used in this section, the term: 17

(a) “Automatic renewal subscription” means an agreement to provide any of the following goods or services for a specified time and price which is automatically renewed at the end of a definite term for a subsequent term unless the consumer cancels the agreement: 22 1. Online magazines, journals, or periodicals. 23 2. Online media players. 24 3. Mobile applications. 25 4. Social networking services. 26 5. Internet game services. 27

(b) “Internet game service” means an online service that provides information, software, data, text, photographs, 29 Florida Senate - 2022 SB 1104 5-00573A-22 20221104__ CODING: Words stricken are deletions; words underlined are additions. graphics, audio, or video which may be accessed by a consumer on a paid subscription basis for the purpose of allowing that consumer to play a single-player or multiplayer game through the Internet or to download a game for that consumer to play offline. The term does not include online gambling or other gaming in which a person participates to win money. 35

(c) “Mobile app” means a software application designed to be operated on a mobile device, such as a smartphone. 37

(d) “Online media player” means an online service that delivers audio or video content. 39

(e) “Social networking service” means an online service that facilitates the building of social relations and the sharing of information among specified groups of people. 42

(2) A business that offers an automatic renewal subscription to a consumer in this state shall present that consumer with an easily accessible disclosure of the methods that consumer may use to cancel the subscription. One method must provide for online cancellation of the subscription by any means of communicating information over a computer network. 48

(3) A violation of this

section is a deceptive and unfair trade practice and constitutes a violation of the Florida Deceptive and Unfair Trade Practices Act under

part II of this chapter. 52

(4) This

section applies to an agreement entered into or renewed after July 1, 2022, under which a business makes an automatic renewal subscription offer to a consumer in this state. 56

Section 2. This act shall take effect July 1, 2022. 57
