An act relating to the use of artificial intelligence by state agencies; defining terms; requiring the Florida Digital Service to conduct a certain study; 4 requiring the Florida Digital Service to submit a certain written report to the Governor and the Legislature by a specified date; providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Artificial intelligence study.— 12

(1) As used in this act, the term: 13

(a) “Artificial intelligence” means any of the following: 14 1. An artificial system that performs tasks under varying and unpredictable circumstances without significant human oversight or that can learn from experience and improve performance when exposed to data sets. 18 2. An artificial system developed in computer software, 19 physical hardware, or other context that solves tasks requiring human-like perception, cognition, planning, learning, 21 communication, or physical action. 22 3. An artificial system designed to think or act like a human, including cognitive architectures and neural networks. 24 4.

A set of techniques, including machine learning, 25 designed to approximate a cognitive task. 26 5. (b) “State agency” means any separate agency or unit of state government created or established by law and includes, but is not limited to, an authority, a board, a branch, a bureau, a commission, a department, a division, an institution, an office, 34 an officer, or a public corporation. 35

(2) The Florida Digital Service shall conduct a study that addresses the impact of state agencies procuring, implementing, 37 or operating artificial intelligence-powered technology. The study must include, but need not be limited to, all of the following: 40

(

a) A list of state agencies that use artificial intelligence. 42

(

b) The purposes for each state agency’s use of artificial intelligence. 44

(

c) The cost for each agency to procure, implement, and operate artificial intelligence-powered technology. 46

(3) No later than March 1, 2027, the Florida Digital Service shall submit a written report to the Governor, the President of the Senate, and the Speaker of the House of Representatives which contains the results of the study performed pursuant to subsection (2). 51

Section 2. This act shall take effect upon becoming a law. 52
