Section

Section 145.012, Florida Statutes, is amended to 36 read: 37 145.012 Applicability.—This

chapter applies to all 38 officials herein designated in all counties of the state, except 39 those officials whose salaries are not subject to being set by 40 the Legislature because of the provisions of a county home rule 41 charter and except officials (other than the property appraiser, 42 clerk of the circuit court, superintendent of schools, sheriff, 43 supervisor of elections, and tax collector who if qualified 44 shall receive in addition to their salaries a special 45 qualification salary as provided in this chapter) of counties 46 which have a chartered consolidated form of government as 47 provided in

chapter 67-1320, Laws of Florida. 48

Section

Section 145.031, Florida Statutes, is amended to 49 read: 50 145.031 Board of county commissioners.— 51 (1)(

a) Each member of the board of county commissioners of 52 a noncharter county shall receive as salary the amount 53 indicated, based on the population of his or her county. In 54 addition, compensation shall be made for population increments 55 over the minimum for each population group, which shall be 56 determined by multiplying the population in excess of the 57 minimum for the grouping times the group rate. 58

b) Effective October 1, 2025, the population of the county 70 as of April 1, 2025, shall be used to calculate the group rate 71 under this subsection. 72

(2) Each No member of a governing body of a chartered 73 county or a county with a consolidated form of government shall 74 receive as salary the amount provided in the county charter. If 75 a county charter authorizes the governing body to set its salary 76 by ordinance, each member of the governing body shall receive as 77

(3) Notwithstanding the provisions of this

section or s. 82 145.19, each member of the board of county commissioners may 83 reduce his or her salary rate on a voluntary basis. 84

Section 3. Subsection (2) of

section 145.19, Florida 85 Statutes, is amended, and subsection (3) is added to that 86 section, to read: 87 145.19 Annual percentage increases based on increase for 88 state career service employees; limitation; exception.— 89

(2) Each fiscal year, the salaries of all officials listed 90 in this chapter, s. 1001.395, and s. 1001.47, except members of 91 boards of county commissioners, shall be adjusted. The adjusted 92 salary rate shall be the product, rounded to the nearest dollar, 93 of the salary rate granted by the appropriate

section of this 94 chapter, s. 1001.395, or s. 1001.47 multiplied first by the 95 initial factor, then by the cumulative annual factor, and 96 finally by the annual factor. The Department of Management 97 Services shall certify the annual factor and the cumulative 98 annual factors. Any special qualification salary received under 99 this chapter, s. 1001.47, or the annual performance salary 100 incentive available to elected superintendents under s. 1001.47 101 shall be added to such adjusted salary rate. The special 102 qualification salary shall be $2,000, but may shall not exceed 103 $2,000. 104

(3) The salary adjustment for each member of a board of 105 county commissioners of a noncharter county or a charter county 106

As of October 1, 2025, 109 any future adjustment shall be made only as provided in s. 110 145.20. 111

Section

Section 145.20, Florida Statutes, is created to 112 read: 113 145.20 Referendum to increase salary, retirement benefits, 114 or other compensation.— 115

(1) A board of county commissioners may not increase the 116 salary, any retirement benefit, or any other type of 117 compensation paid to its members unless such increase is 118 approved by a majority of the electors of the county voting in a 119 referendum held at a general election during a presidential 120 election year. The election costs of the referendum shall be 121 paid by the county. 122

(2) This

section does not apply to any increase in a 123 retirement benefit received as part of the governing body’s 124 participation in the Florida Retirement System. 125

Section 5. Subsection (10) is added to

section 166.021, 126 Florida Statutes, to read: 127 166.021 Powers.— 128 (10)(

a) The governing body of a municipality may not 129 increase the salary, any retirement benefit, or any other type 130 of compensation paid to its members unless such increase is 131 approved by a majority of the electors of the municipality 132 voting in a referendum held at a general election during a 133 presidential election year. The election costs of the referendum 134 shall be paid by the municipality. 135

b) This subsection does not apply to any increase in a 136 retirement benefit received as part of the governing body’s 137 participation in the Florida Retirement System 138

Section

Section 189.0165, Florida Statutes, is created 139 to read: 140 189.0165 Special districts; compensation of members of 141 governing body.— 142

(1) Notwithstanding any other provision of law, the 143 governing body of a special district may not increase the 144 salary, any pension or other retirement benefit, or any other 145 type of compensation paid to members of the governing of a 146 special district unless such increase is approved by a majority 147 of the electors of the special district voting in a referendum 148 held at a general election during a presidential election year. 149 The election costs of the referendum shall be paid by the 150 special district. 151

(2) This

section does not apply to any increase in a 152 retirement benefit received as part of the governing body’s 153 participation in the Florida Retirement System. 154

(3) This

section does not authorize a referendum to 155 increase the salary, any pension or retirement benefit, or any 156 other type of compensation paid to members of the governing body 157 of a special district if the special district’s charter 158 prohibits such members from receiving compensation or benefits. 159

Section 7. This act shall take effect October 1, 2025. 160
