An act relating to resilience planning; creating s. 2 380.0934, F.S.; creating the Florida Master P3 3 Infrastructure Authority for a specified purpose; 4 providing goals for the authority; providing the terms 5 of membership of the authority; requiring members to 6 serve without compensation but be reimbursed for 7 certain expenses; requiring the authority to appoint 8 an executive director, establish rules, meet a certain 9 number of times per year, and elect specified 10 officers; providing for the composition of the 11 authority; providing requirements for the authority; 12 requiring that all projects submitted for inclusion in 13 the Statewide Flooding Sea Level Rise Resilience Plan 14 must have a 5-year implementation timeline; providing 15 an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19

Section 380.0934, Florida Statutes, is created 20 to read: 21 380.0934 Florida Master P3 Infrastructure Authority.— 22 (1)(

a) There is created within the Department of 23 Environmental Protection the Florida Master P3 Infrastructure 24 Authority to oversee the planning, contracting, and execution of 25 projects that address flooding and sea level rise to coastal and 26 inland communities in this state pursuant to s. 380.093(5). The 27 goals of the Florida Master P3 Infrastructure Authority are to: 28 1.

Create a unified statewide approach for funding, 33 developing, and maintaining such projects, in collaboration with 34 private sector partners. 35 (

b) The Florida Master P3 Infrastructure Authority members 36 shall initially be appointed for a term of 4 years. Thereafter, 37 each member shall be appointed for a term of 4 years from the 38 date of appointment, except that a vacancy must be filled by 39 appointment for the remainder of the term. The members of the 40 authority shall serve without compensation, but shall be 41 reimbursed for all necessary expenses in the performance of 42 their duties, including travel expenses, in accordance with s. 43 112.061.

The authority shall appoint an executive director, 44 establish rules of procedure for conducting its meetings, meet 45 at least semiannually, and elect a chair, a vice chair, and a 46 secretary for 1-year terms. The authority shall be composed of 47 the following six members: 48 1. One representative from the Department of 49 Transportation, appointed by the Secretary of Transportation. 50 2. One representative from the department, appointed by the 51 Secretary of Environmental Protection. 52 3.

One representative from the Division of Emergency 53 Management, appointed by the director of the Division of 54 Emergency Management. 55 4. The Chief Resilience Officer. 56 5. The Chief Scientist. 57 6. c) The Florida Master P3 Infrastructure Authority shall: 61 1. Acquire at-risk coastal and flood-prone properties for 62 projects that address flooding and sea level rise to coastal and 63 inland communities in this state pursuant to s. 380.093(5) using 64 measures including, but not limited to, property buyout programs 65 for voluntary relocation in high-risk zones. 66 2. Induce investments from the private sector for such 67 projects by offering incentives, including, but not limited to: 68 a. Long-term revenue-sharing agreements, such as toll 69 collection, lease arrangements, or energy savings. 70 b.

Tax credits. 71 c. Expedited permitting for construction necessary for such 72 projects. 73 3. Engage local governments, community leaders, and 74 residents during the project planning and execution phases and 75 incorporate their feedback in the project. 76 4. Partner with in-state vocational schools and 77 apprenticeship programs to train workers in specialized 78 resiliency construction. 79 5. Publish biannual progress reports, including project 80 milestones, expenditures, and public benefits on the 81 department’s website.

The authority shall also create an online 82 dashboard for real-time updates on project execution. 83 6. Employ an independent certified accounting firm to audit 84 funds, accounts, and financial records for the projects. 85 7. d) The department may provide administrative and staff 88 support services relating to the meetings of the authority. 89

(2) Notwithstanding an extension from the department, all 90 projects that address flooding and sea level rise to coastal and 91 inland communities in this state pursuant to s. 380.093(5) must 92 have a 5-year implementation timeline to ensure timely 93 completion. 94

Section 2. This act shall take effect upon becoming a law. 95
