Be It Enacted by the Legislature of the State of Florida: 7
Section 1. Subsection (28) of
section 258.39, Florida Statutes, is amended to read: 10 258.39 Boundaries of preserves.—The submerged lands included within the boundaries of Nassau, Duval, St. Johns, 12 Flagler, Volusia, Brevard, Indian River, St.
Lucie, Charlotte, 13 Pinellas, Martin, Palm Beach, Miami-Dade, Monroe, Collier, Lee, 14 Citrus, Franklin, Gulf, Bay, Okaloosa, Marion, Santa Rosa, 15 Hernando, and Escambia Counties, as hereinafter described, with the exception of privately held submerged lands lying landward of established bulkheads and of privately held submerged lands within Monroe County where the establishment of bulkhead lines is not required, are hereby declared to be aquatic preserves. 20 Such aquatic preserve areas include: 21
(28) Estero Bay Aquatic Preserve, the boundaries of which are generally: All of those sovereignty submerged lands located bayward of the mean high-water line being in Sections 13, 14, 24 15, 16, 17, 18, 21, 22, 23, 24, 25, 26, 27, 35, and 36, Township 25 South, Range East; and in Sections 19, 20, 28, 29, and 34, 26 Township South, Range East, lying north and east of Matanzas Pass Channel; and in Sections 19, 30, and 31, Township 28 South, Range East; and in Sections 6, 7, 17, 18, 19, 20, 29 Florida Senate - 2024 SB 1210 33-01374-24 20241210__ CODING: Words stricken are deletions; words underlined are additions. 29, 30, 31, and 32, Township South, Range East; and in Sections 1, 2, 3, 11, 12, 13, 14, 24, and 25, Township South, 31 Range East, in Lee County, Florida.
Any and all submerged lands conveyed by the Trustees of the Internal Improvement Trust Fund prior to October 12, 1966, and any and all uplands now in private ownership are specifically exempted from this preserve. 35 Any and all submerged lands theretofore conveyed by the Trustees of the Internal Improvement Trust Fund and any and all uplands now in private ownership are specifically exempted from this dedication. 40
