An act relating to termination of pregnancies; 2 amending s. 390.0111, F.S.; clarifying that certain 3 penalties relating to the unlawful termination of a 4 pregnancy do not apply to the pregnant woman who 5 terminates the pregnancy; providing effective dates. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9
Section 1. Paragraph (
a) of subsection (10) of
section 10 390.0111, Florida Statutes, is amended to read: 11 390.0111 Termination of pregnancies.— 12
(10) PENALTIES FOR VIOLATION.—Except as provided in 13 subsections (3), (7), and (12): 14 (
a) Any person who willfully performs, or actively 15 participates in, a termination of pregnancy in violation of the 16 requirements of this
section or s. 390.01112 commits a felony of 17 the third degree, punishable as provided in s. 775.082, s. 18 775.083, or s. 775.084. This paragraph does not apply to the 19 pregnant woman who terminates the pregnancy. 20
Section 2. Effective 30 days after any of the contingencies 21 described in
section 9 of
chapter 2023-21, Laws of Florida 22 occurring, paragraph (
a) of subsection (10) of
section 390.0111, 23 Florida Statutes, as amended by
section 4 of
chapter 2023-21, 24 Laws of Florida, is amended to read: 25 390.0111 Termination of pregnancies.— 26

section commits a felony of the third 31 degree, punishable as provided in s. 775.082, s. 775.083, or s. 32 775.084. This paragraph does not apply to the pregnant woman who 33 terminates the pregnancy. 34
