An act relating to fee waivers for students living in 2 a recovery residence; amending s. 1009.26, F.S.; 3 authorizing each Florida College System institution, 4 career center operated by a school district, and 5 charter technical career center to waive out-of-state 6 fees for students living in a recovery residence; 7 providing eligibility criteria for such students; 8 prohibiting tuition and fees charged to a student 9 granted the waiver from exceeding the tuition and fees 10 charged to a resident student; requiring a student to 11 provide written or electronic verification of his or 12 her residence; providing requirements for such 13 verification; providing an eligibility period for 14 students who provide the required verification; 15 providing for the renewal of the out-of-state fee 16 waiver; providing a statewide limit on such waivers; 17 requiring each Florida College System institution, 18 career center operated by a school district, and 19 charter technical career center to report to the State 20 Board of Education the number and value of all such 21 waivers granted annually; requiring the board to adopt 22 rules; providing an effective date. 23 24 Be It Enacted by the Legislature of the State of Florida: 25 26

Section 1. Subsection (21) is added to

a) Each Florida College System institution, career 30 center operated by a school district under s. 1001.44, and 31 charter technical career center under s. 1002.34 may waive out-32 of-state fees for students who currently live in a recovery 33 residence, as defined in s. 397.311, and are employed in this 34 state and work at least 20 hours per week. 35 (

b) Tuition and fees charged to a student granted an out-36 of-state fee waiver under this subsection may not exceed the 37 tuition and fees charged to a resident student. 38 (c)1. To receive an out-of-state fee waiver under this 39 subsection, a student must provide written or electronic 40 verification that he or she currently resides in a recovery 41 residence, as defined in s. 397.311, to the Florida College 42 System institution, career center operated by a school district 43 under s. 1001.44, or charter technical career center under s. 44 1002.34 where he or she is enrolled. Such verification must be: 45 a.

A lease agreement signed by the student and the operator 46 of the recovery residence; or 47 b. An affidavit signed by a certified recovery residence 48 administrator or clinical supervisor, as defined in s. 397.311. 49 2. A student who provides the verification required under 50 subparagraph 1. remains eligible for the out-of-state fee waiver 51 for 1 academic year. 52 3. To renew his or her out-of-state fee waiver, a student 53 must maintain a cumulative 2.5 grade point average or higher on 54 a 4.0 scale and resubmit his or her verification pursuant to 55 subparagraph 1. 56 (d)1.

Each Florida College System institution, career center 59 operated by a school district under s. 1001.44, and charter 60 technical career center under s. 1002.34 shall report to the 61 State Board of Education the number and value of all fee waivers 62 granted annually under this subsection. 63 (

e) The State Board of Education shall adopt rules to 64 administer this subsection. 65

Section 2. This act shall take effect July 1, 2022. 66
