An act relating to health care studies; requiring the 2 Office of Program Policy Analysis and Government 3 Accountability to conduct analyses of other states’ 4 use of the combined recovery care center and 5 ambulatory surgical center model and the advanced 6 birthing center model; providing requirements for such 7 analyses; requiring the office to submit reports on 8 its findings and any recommendations to the Governor 9 and the Legislature by a specified date; requiring the 10 office to contract with a certain entity to conduct an 11 analysis of the impact of licensing specialty 12 hospitals in this state and in other states; providing 13 requirements for such analysis; requiring the office 14 to submit a report to the Governor and the Legislature 15 by a specified date; providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19
Section 1.
(1) The Office of Program Policy Analysis and 20 Government Accountability shall conduct an analysis of other 21 states’ use of the recovery care center (RCC) and ambulatory 22 surgical center (ASC) model to allow for expanded types of 23 surgeries to be performed outside of the hospital setting. The 24 office may contract with an independent entity that has 25 experience in health care economics and policy to conduct this 26 study. The office shall do, at a minimum, all of the following: 27 (
a) Determine which surgeries the other states allow an ASC 28 using an RCC to perform which may not otherwise be performed by 29 Florida Senate - 2020 SB 1888 25-01748B-20 20201888__ Page 2 of 4 CODING: Words stricken are deletions; words underlined are additions. the ASC. 30 (
b) Determine which payment methods are accepted by RCCs in 31 other states, including the types of insurance accepted and 32 whether the RCCs accept Medicaid and Medicare. 33 (
c) Compare the other states’ requirements between 34 hospitals, ASCs, and RCCs with respect to physical plant and 35 building code requirements. 36 (
d) Study the effect of the combined ASC and RCC model on: 37 1. Costs to the patient; 38 2. Costs to the state; 39 3. Quality of care, including, but not limited to, patient 40 outcomes, adverse incidents, rates of infection, and hospital 41 admission rates; and 42 4. Any other points of data the office determines to be 43 relevant to the study. 44
(2) The office shall submit a report of its findings and 45 any recommendations to the Governor, the President of the 46 Senate, and the Speaker of the House of Representatives by 47 October 1, 2021. 48
Section 2.
(1) The Office of Program Policy Analysis and 49 Government Accountability shall conduct an analysis of other 50 states’ use of the advanced birthing center (ABC) model that 51 allows higher-risk pregnancies to be delivered outside of the 52 hospital setting. The office may contract with an independent 53 entity that has experience in health care economics and policy 54 to conduct this study. The office shall do, at a minimum, all of 55 the following: 56 (
a) Determine which payment methods are accepted by ABCs in 57 other states, including the types of insurance accepted and 58 Florida Senate - 2020 SB 1888 25-01748B-20 20201888__ Page 3 of 4 CODING: Words stricken are deletions; words underlined are additions. whether the ABCs accept Medicaid. 59 (
b) Review other states’ requirements for physical plant 60 and building code requirements imposed on ABCs, noting any 61 differences compared to the requirements for hospitals offering 62 birthing services. 63 (
c) Study the effect of the ABC model on: 64 1. Costs to the patient; 65 2. Costs to the state; 66 3. Quality of care, including, but not limited to, patient 67 outcomes, adverse incidents, rates of infection, and hospital 68 admission rates; and 69 4. Any other points of data the office determines to be 70 relevant to the study. 71
(2) The office shall submit a report of its findings and 72 any recommendations to the Governor, the President of the 73 Senate, and the Speaker of the House of Representatives by 74 October 1, 2021. 75
Section 3.
(1) The Office of Program Policy Analysis and 76 Government Accountability shall contract with an independent 77 entity that has experience in health care economics and policy 78 to conduct an analysis of the impact of licensing specialty 79 hospitals in this state and in other states. The study must 80 evaluate, at a minimum, all of the following: 81 (
a) The quality of care provided at specialty hospitals and 82 the impact on the quality of care at other general hospitals. 83 (
b) The ability of specialty hospitals to maintain adequate 84 staff and the effects that the licensure of specialty hospitals 85 have on the ability of general hospitals to maintain adequate 86 staff. 87 Florida Senate - 2020 SB 1888 25-01748B-20 20201888__ Page 4 of 4 CODING: Words stricken are deletions; words underlined are additions. c) Patient volumes at specialty hospitals and at general 88 hospitals, including patient referral and utilization patterns 89 and changes in bed capacity and service volume. 90 (
d) The volume of charity care and Medicaid services 91 provided by specialty hospitals compared to general hospitals 92 and the effect that the licensure of specialty hospitals has on 93 the ability of general hospitals to provide charity care. 94 (
e) The effect that the licensure of specialty hospitals 95 has on the volume of charity care, Medicaid services, and 96 Medicare services provided by general hospitals as percentages 97 of total services, as well as a comparison of those percentages 98 and profit margins between general hospitals and specialty 99 hospitals. 100 (
f) The economic effects of licensing specialty hospitals, 101 including their financial performance and the economic effects 102 that the licensure of specialty hospitals have on general 103 hospitals. 104 (
g) The effects that the licensure of specialty hospitals 105 have on the cost of care provided by all hospitals. 106
(2) The office shall submit a report of its findings and 107 any recommendations to the Governor, the President of the 108 Senate, and the Speaker of the House of Representatives by 109 October 1, 2021. 110
