An act relating to fees; amending s. 741.327, F.S., as revived, reenacted, and amended by SB ___; requiring the Department of Children and Families to assess and collect an annual certification fee from batterers’ 5 intervention programs and certain persons attending certified batterers’ intervention programs; requiring certification and user fees to be deposited in the Domestic Violence Trust Fund for a specified purpose; 9 providing a contingent effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12

Section

Section 741.327, Florida Statutes, as revived, 14 reenacted, and amended by SB ___, is amended, to read: 15 741.327 Certification and monitoring of batterers’ 16 intervention programs; rules; fees.— 17

(1) Pursuant to s. 741.32, the Department of Children and Families shall certify and monitor batterers’ intervention programs and assess and collect certification and user fees. 20

(2) The department shall adopt by rule procedures to administer this section, including, but not limited to, 22 procedures related to all of the following: 23

(

a) The development of criteria for the approval, 24 suspension, or rejection of certification of batterers’ 25 intervention programs. 26

(

c) The assessment and collection of fees for individuals who are ordered by the court to complete, or who voluntarily enroll in, a certified batterers’ intervention program. 32

(3) The fees assessed and collected under this

section shall be deposited in the Executive Office of the Governor’s Domestic Violence Trust Fund established in s. 741.01 and shall be directed to the Department of Children and Families to fund the cost of certifying and monitoring batterers’ intervention programs. 38

Section 2. This act shall take effect on the same date that SB ___ or similar legislation takes effect, if such legislation is adopted in the same legislative session or an extension thereof and becomes a law. 42
