An act relating to construction materials mining activities; amending s. 552.30, F.S.; specifying a ground vibration limit for construction materials mining activities within mile of certain areas; 5 authorizing the State Fire Marshal to modify the standards, limits, and regulations for the use of explosives in connection with such construction materials mining activities; providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12

Section 1. Subsection (4) is added to

section 552.30, 14 Florida Statutes, to read: 15 552.30 Construction materials mining activities.— 16 (4)(

a) Beginning July 1, 2024, and notwithstanding any other law, rule, or ordinance, the ground vibration limit for construction materials mining activities within mile of residentially zoned areas may not exceed 0.15 inches per second. 20

b) Notwithstanding this

section or any other law, rule, or ordinance, the State Fire Marshal may modify the standards, 22 limits, and regulations for the use of explosives in connection with construction materials mining activities within mile of residentially zoned areas, including, but not limited to, the temporary cessation of blasting. 26

Section 2. This act shall take effect July 1, 2024. 27
