An act relating to property insurance policies; 2 amending s. 627.7011, F.S.; specifying that certain 3 provisions relating to homeowners’ policies, offers of 4 replacement cost coverage, and offers of law and 5 ordinance coverage do not prohibit insurers from 6 providing specified property insurance policies by 7 including roof covering reimbursement schedules; 8 providing requirements for roof covering reimbursement 9 schedules; prohibiting application of a roof covering 10 reimbursement

schedule under certain circumstances; 11 specifying that certain provisions relating to 12 homeowners’ policies, offers of replacement cost 13 coverage, and offers of law and ordinance coverage do 14 not prohibit insurers from providing specified 15 property insurance policies by offering roof 16 reimbursement on the basis of replacement costs; 17 specifying that certain provisions relating to 18 homeowners’ policies, offers of replacement cost 19 coverage, and offers of law and ordinance coverage do 20 not prohibit insurers from providing coverage on 21 specified property insurance policies for a roof that 22 is limited to a certain value; providing that a stated 23 value sublimit of coverage may not be applied to a 24 roof in certain circumstances; providing an effective 25 date. 26 27 Be It Enacted by the Legislature of the State of Florida: 28 29 Florida Senate - 2025 SB 1746 30-01584-25 20251746__ Page 2 of 3 CODING: Words stricken are deletions; words underlined are additions.

Section 1. Paragraphs (f), (g), and (

h) are added to 30 subsection (6) of

section 627.7011, Florida Statutes, to read: 31 627.7011 Homeowners’ policies; offer of replacement cost 32 coverage and law and ordinance coverage.— 33

(6) This

section does not: 34 (

f) Prohibit an insurer, notwithstanding paragraph (1)(a), 35 from providing limited coverage on a personal lines residential 36 property insurance policy by including a roof covering 37 reimbursement schedule. If included in the policy, a roof 38 covering reimbursement

schedule must do all of the following: 39 1. Provide reimbursement for repair, replacement, and 40 installation based on the annual age of a roof covering. 41 2. Provide full replacement coverage for any roof covering 42 less than 10 years old. 43 3. Unless otherwise demonstrated to the office to be 44 actuarially justified, provide for reimbursement amounts of no 45 less than: 46 a. Seventy percent for a metal roof type. 47 b. Forty percent for a concrete tile and clay tile roof 48 type. 49 c. Forty percent for a wood shake and wood shingle roof 50 type. 51 d. Twenty-five percent for all other roof types. 52 4.

Include at the top of the schedule, in bold type no 53 smaller than 12 points, the following statement: 54 55 PLEASE DISCUSS WITH YOUR INSURANCE AGENT. YOU ARE 56 ELECTING TO PURCHASE COVERAGE ON YOUR ROOF ACCORDING 57 TO A ROOF COVERING REIMBURSEMENT SCHEDULE. ROOF IS DAMAGED BY A COVERED PERIL, YOU WILL RECEIVE A 59 PAYMENT AMOUNT FOR YOUR ROOF ACCORDING TO THE

SCHEDULE 60 BELOW. BE ADVISED THAT THIS MAY RESULT IN YOU HAVING 61 TO PAY SIGNIFICANT COSTS TO REPAIR OR REPLACE YOUR 62 ROOF. PLEASE DISCUSS WITH YOUR INSURANCE AGENT. 63 64 5. Allow for actuarially sound methods of s. 627.062 to 65 apply. 66 6. Be approved by the office. 67 7. Be provided to the insured with the policy documents at 68 issuance and renewal. 69 70 A roof covering reimbursement

schedule may not be applied to a 71 roof if there is a total loss to a primary structure in 72 accordance with the valued policy law under s. 627.702 which is 73 caused by a covered peril. 74 (

g) Prohibit an insurer that provides roof reimbursement on 75 the basis of a roof covering reimbursement

schedule from also 76 offering roof reimbursement on the basis of replacement costs. 77 (

h) Prohibit an insurer, notwithstanding paragraph (1)(a), 78 from providing coverage on a personal lines residential property 79 insurance policy by limiting coverage for a roof to a stated 80 value sublimit of coverage. A stated value sublimit of coverage 81 may not be applied to a roof if there is a total loss to the 82 primary structure in accordance with the valued policy law under 83 s. 627.702 which is caused by a covered peril. 84

Section 2. This act shall take effect July 1, 2025. 85
