An act relating to county constitutional offices; 2 amending ss. 145.051, 145.09, 145.10, and 145.11, 3 F.S.; revising the base salary used to calculate the 4 compensation of a clerk of the circuit court and 5 county comptroller, a supervisor of elections, a 6 property appraiser, and a tax collector, respectively; 7 amending s. 409.1664, F.S.; defining the term “county 8 constitutional officer employee”; providing that 9 county constitutional officer employees are eligible 10 to receive certain adoption benefits from the state; 11 authorizing county constitutional officer employees to 12 apply for the monetary benefit if certain conditions 13 exist; requiring such employees to apply to the 14 Department of Children and Families to obtain the 15 benefit; authorizing the department to adopt specified 16 rules; creating s. 445.09, F.S.; authorizing specified 17 county constitutional officers to budget for and pay 18 specified bonuses to employees, pending a specified 19 approval; amending s. 1003.48, F.S.; authorizing a 20 district school board to contract with a county tax 21 collector’s office to administer road tests on school 22 grounds at one or more schools within the district; 23 providing an effective date. 24 25 Be It Enacted by the Legislature of the State of Florida: 26 27

Section 1. Subsection (1) of

section 145.051, Florida 28 Statutes, is amended to read: 29

(1) Each clerk of the circuit court and each county 31 comptroller shall receive as salary the amount indicated, based 32 on the population of his or her county. In addition, a 33 compensation shall be made for population increments over the 34 minimum for each population group, which shall be determined by 35 multiplying the population in excess of the minimum for the 36 group times the group rate. 37 38 Pop. Section 2. Subsection (1) of

section 145.09, Florida 47 Statutes, is amended to read: 48 145.09 Supervisor of elections.— 49

(1) Each supervisor of elections shall receive as salary 50 the amount indicated, based on the population of his or her 51 county. Section 3. Subsection (1) of

section 145.10, Florida 65 Statutes, is amended to read: 66 145.10 Property appraiser.— 67

Section 4. Subsection (1) of

section 145.11, Florida 83 Statutes, is amended to read: 84 145.11 Tax collector.— 85

(1) Each tax collector shall receive as salary the amount 86 indicated, based on the population of his or her county. In 87 addition, a compensation shall be made for population increments 88 over the minimum for each population group, which shall be 89 determined by multiplying the population in excess of the 90 minimum for the group times the group rate. 91 92 Pop. Section 409.1664, Florida Statutes, is amended, 101 to read: 102 409.1664 Adoption benefits for qualifying adoptive 103 employees of state agencies, veterans, servicemembers, and law 104 enforcement officers, and county constitutional officer 105 employees.— 106

(1) As used in this section, the term: 107 (a) “Child within the child welfare system” has the same 108 meaning as provided in s. 409.166(2). 109 (b) “County constitutional officer employee” means an 110 employee of an office of a clerk of the circuit court, a county 111 comptroller, a county property appraiser, a county supervisor of 112 elections, or a county tax collector in this state. 113 (c) “Law enforcement officer” has the same meaning as 114

Florida Senate - 2023 SB 1400 33-01344C-23 20231400__ Page 7 of 12 CODING: Words stricken are deletions; words underlined are additions. provided in s. 943.10(1). 115 (d)(c) “Qualifying adoptive employee” means a full-time or 116 part-time employee of a state agency, a charter school 117 established under s. 1002.33, or the Florida Virtual School 118 established under s. 1002.37, who is not an independent 119 contractor and who adopts a child within the child welfare 120 system pursuant to

chapter 63 on or after July 1, 2015.

The term 121 includes instructional personnel, as defined in s. 1012.01, who 122 are employed by the Florida School for the Deaf and the Blind, 123 and includes other-personal-services employees who have been 124 continuously employed full time or part time by a state agency 125 for at least 1 year. 126 (e)(d) “Servicemember” has the same meaning as in s. 127 250.01(19). 128 (f)(e) “State agency” means a branch, department, or agency 129 of state government for which the Chief Financial Officer 130 processes payroll requisitions, a state university or Florida 131 College System institution as defined in s. 1000.21, a school 132 district unit as defined in s. 1001.30, or a water management 133 district as defined in s. 373.019. 134 (g)(f) “Veteran” has the same meaning as in s. 1.01(14). 135

(2) A qualifying adoptive employee, veteran, or 136 servicemember who adopts a child within the child welfare system 137 who is difficult to place as described in s. 409.166(2)(d)2. is 138 eligible to receive a lump-sum monetary benefit in the amount of 139 $10,000 per such child, subject to applicable taxes. A law 140 enforcement officer or a county constitutional officer employee 141 who adopts a child within the child welfare system who is 142 difficult to place as described in s. 409.166(2)(d)2. is 143

A 145 qualifying adoptive employee, veteran, or servicemember who 146 adopts a child within the child welfare system who is not 147 difficult to place as described in s. 409.166(2)(d)2. is 148 eligible to receive a lump-sum monetary benefit in the amount of 149 $5,000 per such child, subject to applicable taxes.

A law 150 enforcement officer or a county constitutional officer employee 151 who adopts a child within the child welfare system who is not 152 difficult to place as described in s. 409.166(2)(d)2. is 153 eligible to receive a lump-sum monetary benefit in the amount of 154 $10,000 per each such child, subject to applicable taxes.

A 155 qualifying adoptive employee of a charter school or the Florida 156 Virtual School may retroactively apply for the monetary benefit 157 provided in this subsection if such employee was employed by a 158 charter school or the Florida Virtual School when he or she 159 adopted a child within the child welfare system pursuant to 160

chapter 63 on or after July 1, 2015. A veteran or servicemember 161 may apply for the monetary benefit provided in this subsection 162 if he or she is domiciled in this state and adopts a child 163 within the child welfare system pursuant to

chapter 63 on or 164 after July 1, 2020. A law enforcement officer may apply for the 165 monetary benefit provided in this subsection if he or she is 166 domiciled in this state and adopts a child within the child 167 welfare system pursuant to

chapter 63 on or after July 1, 2022. 168 A county constitutional officer employee may apply for the 169 monetary benefit provided in this subsection if he or she is 170 domiciled in this state and adopts a child within the child 171 welfare system under

chapter 63 on or after July 1, 2023. 172

a) Benefits paid to a qualifying adoptive employee who is 173 a part-time employee must be prorated based on the qualifying 174 adoptive employee’s full-time equivalency at the time of 175 applying for the benefits. 176 (

b) Monetary benefits awarded under this subsection are 177 limited to one award per adopted child within the child welfare 178 system. 179 (

c) The payment of a lump-sum monetary benefit for adopting 180 a child within the child welfare system under this

section is 181 subject to a specific appropriation to the department for such 182 purpose. 183

(3) A qualifying adoptive employee must apply to his or her 184 agency head, or to his or her school director in the case of a 185 qualifying adoptive employee of a charter school or the Florida 186 Virtual School, to obtain the monetary benefit provided in 187 subsection (2). A veteran, or servicemember, or county 188 constitutional officer employee must apply to the department to 189 obtain the benefit.

A law enforcement officer must apply to the 190 Department of Law Enforcement to obtain the benefit. 191 Applications must be on forms approved by the department and 192 must include a certified copy of the final order of adoption 193 naming the applicant as the adoptive parent. Monetary benefits 194 shall be approved on a first-come, first-served basis based upon 195 the date that each fully completed application is received by 196 the department. 197

(4) This

section does not preclude a qualifying adoptive 198 employee, veteran, servicemember, or law enforcement officer, or 199 county constitutional officer employee from receiving adoption 200 assistance for which he or she may qualify under s. 409.166 or 201

(5) Parental leave for a qualifying adoptive employee must 204 be provided in accordance with the personnel policies and 205 procedures of his or her employer. 206

(6) The department may adopt rules to administer this 207 section. The rules may provide for an application process such 208 as, but not limited to, an open enrollment period during which 209 qualifying adoptive employees, veterans, servicemembers, or law 210 enforcement officers, or county constitutional officer employees 211 may apply for monetary benefits under this section. 212

Section

Section 445.09, Florida Statutes, is created to 213 read: 214 445.09 Bonuses for employees of county constitutional 215 officers.—Notwithstanding any other law, a clerk of the circuit 216 court, a county comptroller, a county supervisor of elections, a 217 county property appraiser, and a county tax collector may budget 218 for and pay a hiring or retention bonus to an employee if such 219 expenditure is approved by: 220

(1) The board of county commissioners in the respective 221 budgets of the clerk of the circuit court, the comptroller, and 222 the supervisor of elections, and the property appraiser. 223

(2) The Department of Revenue in the respective budgets of 224 the property appraiser and the tax collector. 225

Section

Section 1003.48, Florida Statutes, is amended to 226 read: 227 1003.48 Instruction in operation of motor vehicles; road 228 tests.— 229

(1) A course of study and instruction in the safe and 230

Florida Senate - 2023 SB 1400 33-01344C-23 20231400__ Page 11 of 12 CODING: Words stricken are deletions; words underlined are additions. lawful operation of a motor vehicle shall be made available by 231 each district school board to students in the secondary schools 232 in the state. The secondary school shall provide preferential 233 enrollment to a student who is in the custody of the Department 234 of Children and Families if the student maintains appropriate 235 progress as required by the school.

As used in this section, the 236 term “motor vehicle” has the same meaning as in s. 320.01(1)(a) 237 and includes motorcycles and mopeds. Instruction in motorcycle 238 or moped operation may be limited to classroom instruction. The 239 course may not be made a part of, or a substitute for, any of 240 the minimum requirements for graduation. 241

(2) In order to make such a course available to any 242 secondary school student, the district school board may use any 243 one of the following procedures or any combination thereof: 244 (

a) Use instructional personnel employed by the district 245 school board. 246 (

b) Contract with a commercial driving school licensed 247 under

chapter 488. 248 (

c) Contract with an instructor certified under

chapter 249 488. 250

(3) District school boards shall earn funds on full-time 251 equivalent students at the appropriate basic program cost 252 factor, regardless of the method by which such courses are 253 offered. 254

(4) For the purpose of financing the driver education 255 program in the secondary schools, there shall be levied an 256 additional 50 cents per year to the driver license fee required 257 by s. 322.21. The additional fee shall be promptly remitted to 258 the Department of Highway Safety and Motor Vehicles, which shall 259

(5) The district school board shall prescribe standards for 262 the course required by this

section and for instructional 263 personnel directly employed by the district school board. A 264 certified instructor or licensed commercial driving school is 265 sufficiently qualified and is not required to meet any standards 266 in lieu of or in addition to those prescribed under

chapter 488. 267

(6) The district school board may contract with the county 268 tax collector for a tax collector employee to administer road 269 tests on school grounds at one or more schools within the 270 district. 271

Section 8. This act shall take effect July 1, 2023. 272
