An act relating to federal law enforcement agency records; amending s. 119.01, F.S.; revising the general state policy on public records to include certain federal law enforcement agency records; 5 amending s. 119.011, F.S.; revising

definitions; 6 creating s. 119.013, F.S.; requiring certain federal law enforcement agencies to comply with the public records requirements of this state; providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12

Section 1. Subsection (1) of

section 119.01, Florida Statutes, is amended to read: 15 119.01 General state policy on public records.— 16

(1) It is the policy of this state that all state, county, 17 and municipal records, and the records of federal law enforcement agencies that are not subject to the Freedom of Information Act and which have physical offices located in this state, are open for personal inspection and copying by any person. Providing access to public records is a duty of each agency. 23

Section 2. Subsections (2) and (5) of

section 119.011, 24 Florida Statutes, are amended to read: 25 119.011

Definitions.—As used in this chapter, the term: 26 (2) “Agency” means any state, county, district, authority, 27 or municipal officer, department, division, board, bureau, 28 commission, or other separate unit of government created or Florida Senate - 2023 SB 310 14-00776-23 2023310__ CODING: Words stricken are deletions; words underlined are additions. established by law, including, for the purposes of this chapter, 30 the Commission on Ethics, the Public Service Commission, and the Office of Public Counsel;, and any other public or private agency, person, partnership, corporation, or business entity acting on behalf of any public agency; and any federal law enforcement agency that is not subject to the Freedom of Information Act and which has a physical office located in this state. 37 (5) “Custodian of public records” means the elected or appointed state, county, or municipal, or federal officer charged with the responsibility of maintaining the office having public records, or his or her designee. 41

Section 119.013, Florida Statutes, is created to read: 43 119.013 Federal law enforcement agency records.—A federal law enforcement agency that is not subject to the Freedom of Information Act and that has a physical office located in this state shall comply with the public records requirements of this state. 48

Section 4. This act shall take effect July 1, 2023. 49
