An act relating to student health services; providing a

short title; creating s. 1006.064, F.S.; defining the terms “feminine hygiene products” and “school building”; requiring school districts to make feminine hygiene products available, at no charge, in female restroom facilities of public school buildings; 7 providing applicability; providing an effective date. 8

WHEREAS, feminine hygiene products are a health care necessity and are not items that can be foregone or substituted easily, and

WHEREAS, access to feminine hygiene products is a serious and ongoing need in this state, and

WHEREAS, when students do not have access to affordable feminine hygiene products, they may miss multiple days of school every month, and

WHEREAS, when students have access to quality feminine hygiene products, they are able to continue with their daily lives with minimal interruption,

NOW, THEREFORE, 20

Be It Enacted by the Legislature of the State of Florida: 22

Section 1. This act may be cited as the “Learning with Dignity Act.” 25

Section

Section 1006.064, Florida Statutes, is created to read: 27 1006.064 Availability of feminine hygiene products.— 28

(a) “Feminine hygiene products” means tampons and sanitary napkins for use in connection with the menstrual cycle. 31

(b) “School building” means any facility: 32 1. That is owned or leased by a school district or over which the school board has care, custody, and control; and 34 2. In which there is a public school serving students in grades K-12. 36

(2) A school district shall make feminine hygiene products available, at no charge, in female restroom facilities of school buildings. 39

(3) This

section applies to charter schools pursuant to s. 40 1002.33(16)(a)5. 41

Section 3. This act shall take effect July 1, 2020. 42
