An act relating to developmental disabilities; 2 providing a
short title; amending s. 393.063, F.S.; 3 revising the definition of the term “developmental disability”; providing an effective date. 5
Be It Enacted by the Legislature of the State of Florida: 7
Section 1. This act may be cited as “Lincoln’s Law.” 9
Section 2. Subsection (12) of
section 393.063, Florida Statutes, is amended to read: 11 393.063
Definitions.—For the purposes of this chapter, the term: 13 (12) “Developmental disability” means a severe, chronic disability of an individual which: 15
(
a) Is attributable to a mental or physical impairment or combination of mental and physical impairments. 17
(
b) Is manifested before the individual attains years of age. 19
(
c) Is likely to continue indefinitely. 20
(
d) Results in substantial functional limitations in three or more of the following areas of major life activity: 22 1. Self-care. 23 2. Receptive and expressive language. 24 3. Learning. 25 4. Mobility. 26 5. Self-direction. 27 6. Capacity for independent living. 28 7. (
e) Reflects the individual’s need for a combination and sequence of special, interdisciplinary, or generic services, 31 individualized supports, or other forms of assistance which are of lifelong or extended duration and are individually planned and coordinated. 34 An individual from birth to years of age who has a substantial developmental delay or specific congenital or acquired condition may be considered to have a developmental disability without meeting three or more of the criteria described in paragraphs 39 (a)-(
e) if the individual, without services and supports, has a high probability of meeting such criteria later in life disorder or syndrome that is attributable to intellectual disability, 42 cerebral palsy, autism, spina bifida, Down syndrome, Phelan-43 McDermid syndrome, or Prader-Willi syndrome; that manifests before the age of 18; and that constitutes a substantial handicap that can reasonably be expected to continue indefinitely. 47
