An act relating to home medical equipment providers; 2 amending s. 400.93, F.S.; exempting allopathic, 3 osteopathic, and chiropractic physicians who sell or rent electrostimulation medical equipment and supplies in the course of their practice from certain licensure requirements; providing an effective date. 7
Be It Enacted by the Legislature of the State of Florida: 9
Section 1. Paragraph
(
l) is added to subsection (5) of
section 400.93, Florida Statutes, to read: 12 400.93 Licensure required; exemptions; unlawful acts; 13 penalties.— 14
(5) The following are exempt from home medical equipment provider licensure, unless they have a separate company, 16 corporation, or division that is in the business of providing home medical equipment and services for sale or rent to consumers at their regular or temporary place of residence pursuant to the provisions of this part: 20
(
l) Physicians licensed under
chapter or
chapter 459 and chiropractic physicians licensed under
chapter for the sale or rental of electrostimulation medical equipment and electrostimulation medical equipment supplies to their patients in the course of their practice. 25
