An act relating to the statute of limitations for sexual offenses; amending s. 95.11, F.S.; eliminating the statute of limitations period for civil actions for certain sexual offenses; providing applicability; 5 providing an effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8

Section 1. Subsection (9) of

section 95.11, Florida Statutes, is amended to read: 11 95.11 Limitations other than for the recovery of real property.—Actions other than for recovery of real property shall be commenced as follows: 14

(9) SEXUAL BATTERY OFFENSES ON VICTIMS UNDER AGE 16.— 15

(

a) An action related to

an act constituting a violation of s. 794.011 involving a victim who was younger than under the age of at the time of the act may be commenced at any time. This paragraph subsection applies to any such action other than one which would have been time barred on or before July 1, 2010. 20

(

b) Except as provided in paragraph (a), an action related to

an act constituting a violation of s. 365.16, s. 365.161, s. 22 794.011, s. 798.02, s. 800.02, s. 800.03, s. 800.09, s. 800.101, 23 s. 825.1025, s. 827.071, s. 847.0135, s. 847.0141, s. 847.0147, 24 s. 847.201, s. 847.002, s. 847.011, s. 847.012, s. 847.013, s. 25 847.06, or s. 847.07 may be commenced at any time. This paragraph applies to any such action based on

an act constituting such a violation taking place on or after January 28 1, 2018, and to an action based on

Section 2. This act shall take effect upon becoming a law. 33
