An act relating to bottled water; creating s. 500.458, 2 F.S.; requiring the Department of Environmental Protection to monitor certain consumptive use permits; 4 providing penalties for nonpayment of fees; directing the department to adopt rules; providing applicability; providing a contingent effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9

Section

Section 500.458, Florida Statutes, is created to read: 12 500.458 Bottled water; extraction monitoring; fine.— 13

(1) The Department of Environmental Protection shall monitor the consumptive use permits for all bottled water companies to ensure compliance with the limits of allowable water extraction for natural water and water from an approved source, as those terms are defined in s. 500.03. To ensure compliance, water shall be measured in gallons at the bottling facility. 20

(2) A daily fine not to exceed $500 shall be imposed for each day a company withholds payment of the fees imposed under this section. 23

(3) The department shall adopt rules under ss. 120.536(1) 24 and 120.54 to implement and enforce this section. 25

(4) This

section does not apply to bottled water companies that are permitted to extract less than million gallons per calendar year. 28

Section 2.
