P-34.1 ) ______________________________________________________________________ [ 1 ] The Court was submitted a motion to review the situation of X, born on […], 1997, under
section 95 or the Youth Protection Act . [ 2 ] At the hearing, the mother and the child are present. Me Jean-Claude Latraverse represents the youth and Me Stephanie Lachance the petitioner. The father is absent, although duly served. [ 3 ] The mother and the youth agree with the recommendation of the petitioner to place X in a specific foster home, at her sister Y and her common-law spouse, Mr. C. [ 4 ] The evidence shows that the youth is doing well at the group home in D town.
She is attending school in the community without any problems. [ 5 ] In the meantime, since the youth no longer needs to be maintained in a structured environment, she will be transferred to a foster family until the end of the school year. She knows the foster mother, who works at the group home, and she is willing to stay there. [ 6 ] After the school year, she will move to E town to live with her sister Y and her common-law spouse. The assessment of the young couple is positive. They are involved in the life of the youth and of all other siblings.
They understand their responsibilities and are very motivated to take care of the youth. [ 7 ] The evidence reveals that it is in the best interest of X to be foster cared by her sister, who can be a positive role model for her. [ 8 ] FOR THESE MOTIVES, THE COURT: [ 9 ] GRANTS the motion; [ 10 ] DECLARES that the security and development of the youth are still in danger; [ 11 ] ORDERS the placement of X, born on […], 1997, in a foster family until her majority; [ 12 ] RECOMMENDS the foster family to be Y and Mr.C; [ 13 ] ORDERS the Director of Youth Protection to supervise all visitation rights and access of the parents and all contacts with the siblings;
[ 14 ] ORDERS the Director of Youth Protection to provide aid, counsel and assistance to both parents and the child until her majority; [ 15 ] ENTRUSTS the situation of the child to the Director of Youth Protection, who shall see to the execution of the enactment. __________________________________ RENÉE LEMOINE, J.Q.C.
