section 2803 of the Civil Code of Quebec ; « Celui qui veut faire valoir un droit doit prouver les faits qui soutiennent sa prétention. Celui qui prétend qu'un droit est nul, a été modifié ou est éteint doit prouver les faits sur lesquels sa prétention est fondée. » [ 3 ] CONSIDERING the provisions of
section 2804 of Civil Code of Quebec ; « La preuve qui rend l'existence d'un fait plus probable que son inexistence est suffisante, à moins que la loi n'exige une preuve plus convaincante. » [ 4 ] CONSIDERING the provisions of
section 1463 of Civil Code of Quebec ; « Le commettant est tenu de réparer le préjudice causé par la faute de ses préposés dans l'exécution de leurs fonctions; il conserve, néanmoins, ses recours contre eux. [ 5 ] CONSIDERING that the damages established by Plaintiff to its driveway have been caused by the truck driver working for the Defendant; [ 6 ] CONSIDERING the Court is convince that Plaintiff proved partially the points mentioned in his action; FOR THESE REASONS, THE COURT: [ 7 ] GRANTS Plaintiff's action partially; [ 8 ] CONDEMNS the Defendant to pay to the Plaintiff the amount of $450 with interest at the rate of 5% per year and the additional indemnity provided by
