Section 37 paragraph 3 of the Code of Civil Procedure ) ______________________________________________________________________ WARNING: In family matters, access to the court records is restricted.
No person who has had access to a record in a family matter or in a matter regarding a change of designation of sex as it appears in a minor child’s act of birth or in a matter regarding a change of designation of sex as it appears in a minor child’s act of birth may disclose or circulate any information that would allow a party or a child whose interests are at stake in a proceeding to be identified, unless authorized by the court or by law or unless the disclosure or circulation of the information is necessary for the purpose of applying a law. ( Sections 15 and 16 C.C.P. ) [ 1 ] This case concerns the child X, aged 7.
The child is subject of motion for protection in accordance with
section 38 of the Youth Protection Act , which has yet to be settled by this Court. [ 2 ] The father subsequently filed a motion before this Court in accordance with
section 37 , paragraph 3 of the Code of civil procedure , asking to be granted custody of the child. This judgment only deals with the motion in accordance with
section 37 of the Code of civil procedure . [ 3 ] The mother opposes the motion and argues that it does not in any way settle the main issue before the Court (relating to the child’s need for protection). The Director of Youth Protection and the child’s counsel share the mother’s view and ask the Court to reject the motion. COURT OF QUEBEC’S COMPETENCY ON MATTERS RELATED TO CUSTODY [ 4 ] Before going any further, it is important to reiterate the accessory nature of the Court of Quebec’s competency when it comes to a motion for custody.
To this end, it is useful to recall the words of Judge Marie Pratte [1] : C’est en principe la Cour supérieure qui est le tribunal compétent pour décider de la garde. Mais le nouveau Code de procédure civile , dans des situations spécifiques, attribue à la Cour du Québec une compétence concurrente à celle qu’exerce la Cour supérieure.
Le troisième paragraphe de l’article 37 du nouveau Code de procédure civile prévoit à cet égard que : Lorsque la Cour du Québec est déjà saisie d’une demande en matière d’adoption ou de protection de la jeunesse, elle peut se prononcer sur les demandes qui y sont liées concernant la garde de l’enfant, son émancipation, l’exercice de l’autorité parentale ou la tutelle demandée par le directeur de la protection de la jeunesse.
La compétence de la Cour du Québec, en matière de garde, dépend donc du respect de deux conditions : le tribunal doit déjà être saisi d’une demande en matière de protection [ou d’adoption], à laquelle doit être liée la demande de garde. De façon générale, la superposition de ces deux exigences laisse clairement transparaître le caractère accessoire de la compétence de la Cour du Québec en matière de garde. Celle-ci se greffe à celle qu’elle exerce de façon exclusive en matière de protection ou d’adoption.
[ 5 ] The first condition is clearly met in this instance in that the Court is seized of a motion for protection in accordance with
section 38 of the Youth Protection Act which has yet to be settled. [ 6 ] As to the second condition, Judge Marie Pratte [2] proposes the following approach, taking into account the legislator’s intent in the context of the adoption of
section 37 of the Code of civil procedure : [14] Qu’e n est-il de la seconde condition? Le Code de procédure civile exige que la demande de garde soit liée à celle en protection. Lors de l’étude du projet de loi en commission parlementaire, en 2013, le ministre de la Justice indiquait même que les deux demandes devaient être « intimement liées » [3] . Mais dans quelles circonstances, un tel lien existe-t-il? [15] Les commentaires du ministre de la Justice fournissent une réponse.
En effet, en 2015, on l’a mentionné précédemment, la ministre précise que le tribunal pourra décider des questions accessoires « si cela lui permet de résoudre l’affaire dans l’intérêt de l’enfant » [4] . [16] Ces propos, qui témoignent de l’intention du législateur, peuvent servir de guide dans l’interprétation du texte de loi.
Le test permettant de déterminer si la demande de garde est, tel que le requiert l’article 37, liée à celle en protection, pourrait dès lors s’énoncer ainsi : le fait, pour le tribunal, de se prononcer sur la question de garde, permet-il de régler le litige principal, ou du moins un élément essentiel de la situation de l’enfant, dans l’intérêt de ce dernier? [ 7 ] In Droit de la famille – 19674 [5] , Judge Marie Pratte sumarizes the issue as follows: [11] Mais la véritable question n’est-elle pas de savoir de quelle façon, en l’espèce, la décision que le Tribunal rendrait sur la garde s’arrimerait à celle rendue en protection?
Permettrait-elle de moduler, de compléter ou de régler la situation de l’enfant, dans l’intérêt de celle-ci? [ 8 ] In the current case, the Court must therefore ask whether ruling on the issue of custody at this time would solve the main issue relating to the protection of the child, or whether it would allow to complete or reinforce the Court’s decision in relation to the motion for protection [6] ? The answer is no. The current situation with regards to the intervention of the Director of Youth Protection is causing significant tension between the parents and the impact on the child is concerning.
Determining the issue of custody at this point would do little to solve the issue. [ 9 ] While that alone is sufficient to reject the motion, it is also worth noting that contrary to what counsel for the mother argues, the issue of the child being subjected to psychological ill-treatment as a result of her exposure to the parental conflict is not new. [ 10 ] This has been alleged by the mother since the hearing of the motion for protection began more than ten months ago and is duly reflected in the case protocol that was established by the Court following a management conference with the parties.
A protocol which, incidentally, makes no mention of the father seeking custody of the child. [ 11 ] THEREFORE THE COURT: [ 12 ] REJECTS the motion for custody.
