The judgment of the Court was delivered by LEBLOND, J.A. I.
Introduction [1] On August 2, 2018, the appellant, Springfield Sports Club Inc., applied for approval to continue to operate its shooting range. The approval process is governed by the Firearms Act , S.C. 1995, c. 39 , and the Shooting Clubs and Shooting Ranges Regulations , SOR/98-212 . Pursuant to the Act , that process is delegated to the Chief Firearms Officer for the Province of New Brunswick (the “CFO”). [2] The CFO granted the approval but, for the first time in the Club’s 20-year history, she attached a series of 26
conditions. There is no indication in the record that the CFO considered whether she had any statutory authority to impose these conditions. It appears her sole basis for imposing them was to emulate a “practice” her counterpart in Nova Scotia had adopted. [ 3 ] Although it did not frame it as a discrete ground of appeal, the Club disputed the legality of these conditions. Before the Court of Queen’s Bench, it argued the issue was the reasonableness of the conditions, but, before us, it took the position the CFO lacked jurisdiction to impose conditions to her approval.
To have the issue addressed, it triggered the reference process set out in the Act . The matter was initially referred to the Provincial Court, where a judge struck out the conditions. She held conditions attached to an approval were not envisaged by the Act and, more importantly, were not compliant with the statutory scheme. She went on to find the conditions did not meet the standard of reasonableness and were not justified.
This muddled the reasons for her decision. [ 4 ] The respondent, the Province of New Brunswick as represented by the Minister of Justice and Public Safety (“Chief Firearms Officer”), in its appeal to the Court of Queen’s Bench, argued the Provincial Court judge applied the wrong “standard of review” in coming to her decision. It further argued the Provincial Court could use the reference provisions of the Act to review approvals on the same basis as reviews of refusals or revocations of licenses to transport firearms. As will be shown below, the Act does not support that position.
The Queen’s Bench judge did not address the matter referred to the Provincial Court but agreed with the Province on the applicable standard on review of the conditions and remitted the matter back to the Provincial Court for further adjudication with a directive that the CFO’s conditions of approval be reviewed under a different standard. [ 5 ] The Club appealed to this Court and, while both parties continued to focus the debate on the standard of review that applies to the justification for the conditions, the Club maintained the CFO had no authority to impose them in the first place. [ 6 ] For the reasons that follow, I would allow the appeal with costs of $2,000 payable by the Province.
II. Factual and Statutory Context A. The CFO’s powers [ 7 ] The CFO’s powers over the approval process are governed by s. 29 of the Act , which reads: Shooting clubs and shooting ranges • 29
(1) No person shall operate a shooting club or shooting range except under an approval of the provincial minister for the province in which the premises of the shooting club or shooting range are located. Approval
(2) A provincial minister may approve a shooting club or shooting range for the purposes of this Act if (
a) the shooting club or shooting range complies with the regulations made under paragraph 117(e); and (
b) the premises of the shooting club or shooting range are located in that province.

Revocation
(3) A provincial minister who approves a shooting club or shooting range for the purposes of this Act may revoke the approval for any good and sufficient reason including, without limiting the generality of the foregoing, where the shooting club or shooting range contravenes a regulation made under paragraph 117(e). Delegation
(4) A chief firearms officer who is authorized in writing by a provincial minister may perform such duties and functions of the provincial minister under this
section as are specified in the authorization. Notice of refusal to approve or revocation
(5) Where a provincial minister decides to refuse to approve or to revoke an approval of a shooting club or shooting range for the purposes of this Act, the provincial minister shall give notice of the decision to the shooting club or shooting range. Material to accompany notice

[ 8 ] Section 29(2)(
a) of the Act permits approval if the club or range complies with the regulations made under s. 117(
e) of the Act and the club’s premises are located, in this case, in New Brunswick. There is, of course, no issue with this requirement. With respect to the other, s. 117(
e) of the Act provides:
Regulations 117 The Governor in Council may make regulations (
e) regulating (
i) the establishment and operation of shooting clubs and shooting ranges, (ii) the activities that may be carried on at shooting clubs and shooting ranges, (iii) the possession and use of firearms at shooting clubs and shooting ranges, and (iv) the keeping and destruction of records in relation to shooting clubs and shooting ranges and members of those clubs and ranges[.]
[ 9 ] The relevant provisions of the Regulations are the following: 1 The
definitions in this
section apply in these Regulations. […] approved means approved under
section 29 of the Act. […] agréé Agréé conformément à l’article 29 de la Loi. d) with respect to each operator, each owner of the shooting range, and each employee of the shooting range who handles firearms (
i) his or her name, address and phone number, and (ii) the number of his or her licence to possess firearms or, if one does not exist, his or her date of birth.
a) ses noms, adresse et numéro de téléphone ainsi que, le cas échéant, son numéro de télécopieur et son adresse de courrier électronique;
b) l’emplacement du champ de tir et les directions pour s’y rendre par route;
c) les heures d’ouverture prévues du champ de tir;
(2) The request for approval of a shooting range must be accompanied by the following documentation: […] (
b) a copy of the proposed safety rules; […] (
f) evidence that the design and operation of the shooting range meets at least the requirements set out in
section 5[.] […] 3
Compliance with Safety Standards and Other Obligations 5 The operator of an approved shooting range shall ensure that the discharge of firearms on the shooting range does not endanger the safety of persons at the shooting range or in the portion of the surrounding area described in paragraph 3(2)(a), by taking appropriate measures, including ensuring that (
a) the design and operation of the shooting range (
i) is such that projectiles discharged from firearms will not leave the shooting range if they are discharged there in accordance with the safety rules, and (ii) promotes the safety of all persons on the shooting range, including by accommodating any adaptation that may be appropriate given the nature of the shooting activities that may take place and the type and calibre of firearms that may be used there; (
b) the shooting range has an adequate warning system to warn persons that they are entering a shooting range and to inform them, when such is the case, that shooting activities are taking place at that time; (
c) appropriate safety rules for the shooting range are applied that are consistent with the nature of the shooting activities that may take place and the type and calibre of firearms that may be used there; (
d) the safety rules are posted in a conspicuous place on the shooting range; and (
e) if more than one person is simultaneously engaged in shooting activities on the shooting range, a person acts as the range officer.
i) d’une part, de sorte que les projectiles tirés d’armes à feu ne sortent pas du champ lorsqu’ils y sont tirés conformément aux règles de sécurité, (ii) d’autre part, pour promouvoir la sécurité des personnes s’y trouvant, notamment en y effectuant toute adaptation qui peut être appropriée compte tenu du genre de tir qui peut s’y dérouler et des types et calibres des armes à feu qui peuvent y être utilisés;
b) un système d’avertissement adéquat soit en place pour avertir les personnes qu’elles entrent dans un champ de tir et, le cas échéant, que des activités de tir y sont en cours;
c) des règles de sécurité appropriées soient mises en vigueur au champ de tir, lesquelles conviennent au genre de tir qui peut s’y dérouler et aux types et calibres des armes à feu qui peuvent y être utilisés;
d) les règles de sécurité soient affichées à un endroit bien en vue au champ de tir;
[ 10 ] As this scheme applies here, the Act limits the CFO’s authority on approval of a shooting range to ensuring the applicant meets specific operational requirements in its application.
The CFO’s jurisdiction is limited to ensuring the key information in the application is accurate and that the shooting range complies with the Regulation. [ 11 ] This is in stark contrast to the express authority given to a chief firearms officer, in ss. 58 and 58.1 of the Act , to impose conditions, for instance, on a licence or an authorization to carry or transport firearms. Sections 58 and 58.1 state:
Conditions 58
(1) A chief firearms officer who issues a licence, an authorization to carry or an authorization to transport may attach any reasonable condition to it that the chief firearms officer considers desirable in the particular circumstances and in the interests of the safety of the holder or any other person. Exception — licence or authorization 58
(1.1) However, a chief firearms officer’s power to attach a condition to a licence , an authorization to carry or an authorization to transport is subject to the regulations. […] Conditions – licence issued to business 58.1
(1) A chief firearms officer who issues a licence to a business must attach […] conditions to the licence [.] [Emphasis added.]
[ 12 ] The authority of a chief firearms officer to impose conditions to an authorization to carry or transport firearms is confirmed by ss. 61(2) and (3), which state:
Form of authorizations 61
(2) An authorization to carry, authorization to transport, authorization to export or authorization to import may be issued in the prescribed form — which form may be in writing or electronic — or in the prescribed manner, and include the prescribed information, including any conditions attached to it. Condition attached to licence 61
(3) An authorization to carry or authorization to transport may take the form of a condition attached to a licence. Forme : autorisations 61
[ 13 ] Although there is no dispute that the Club met all the requirements for approval of its renewal application, on January 7, 2019, the CFO approved the operation of its shooting range subject to 26 conditions. Those that are the subject of the appeal before us are: a. The range operators are responsible for enforcing all operating conditions as noted below (condition 1); b. It is the responsibility of the range operator to ensure compliance with
section 6 of the shooting clubs and shooting ranges regulations (condition 2); c. The approved operational hours of this range are from dawn to dusk. No nighttime shooting permitted (condition 3); d. Targets shall not be placed on top of the backstops and the centre of the target shall not be more than 1.5 m above the range floor (condition 15); e. Targets shall not be placed on the range floor to be shot at and shall not be positioned so that projectiles shot at the targets will strike the range floor (condition 16); f.
At the discretion of the chief firearms officer, the shooting range may be inspected to ensure continued compliance with the requirements referred to in the regulations, and to maintain public safety requirements (condition 25); and g. The use of exploding targets is not authorized on this shooting range (condition 26). [ 14 ] The Court raised, motu proprio , two issues with counsel and gave them full opportunity to address both. They are:
a) whether the CFO has the authority to impose conditions to an approval under s. 29; and
b) whether the reference process set out in ss. 74 to 76 could be engaged to seek to have the conditions struck.
[ 15 ] After hearing arguments, I conclude nothing in s. 29 of the Act or the Regulations gave the CFO any authority to attach conditions to her approval of the Club’s application. The Act instead limits the CFO’s authority on approval to ensuring an application meets certain operational requirements. Of course, should the Club contravene the Act or a regulation, the Minister or the CFO may revoke the approval under s. 29(3).
This ensures the protection of the public and preserves the Minister’s or CFO’s authority over the Club. [ 16 ] Moreover, I conclude the reference process set out in ss. 74 to 76 should not have been engaged to challenge the imposition of the conditions. My analysis follows. B. The Provincial Court’s jurisdiction [ 17 ] The relevant portions of ss. 74 and 76 are the following: Reference to judge of refusal to issue or revocation, etc. 74
(1) Subject to subsection (2), where (
a) a chief firearms officer or the Registrar refuses to issue or revokes a licence, registration certificate, authorization to transport, authorization to export or authorization to import, […] (
c) a provincial minister refuses to approve or revokes the approval of a shooting club or shooting range for the purposes of this Act, the applicant for or holder of the licence, registration certificate, authorization or approval may refer the matter to a provincial court judge in the territorial division in which the applicant or holder resides. Decision by provincial court judge 76 On the hearing of a reference, the provincial court judge may, by order, Renvoi 74
(
a) confirm the decision of the chief firearms officer, Registrar or provincial minister; (
b) direct the chief firearms officer or Registrar to issue a licence, registration certificate or authorization or direct the provincial minister to approve a shooting club or shooting range; or (
c) cancel the revocation of the licence, registration certificate, authorization or approval or the decision of the chief firearms officer under
a) confirmer la décision du contrôleur des armes à feu, du directeur ou du ministre provincial;
b) enjoindre au contrôleur des armes à feu ou au directeur de délivrer le permis, le certificat d’enregistrement ou l’autorisation ou enjoindre au ministre provincial de conférer l’agrément au club de tir ou au champ de tir;
[ 18 ] These provisions frame the Provincial Court’s jurisdiction. They bear close examination to determine if this matter could be the subject of a reference in the first place. I note that, although this was not in the record before us, counsel confirmed the record before the Provincial Court judge contained the written delegation referenced in s. 29(4). That is therefore not an issue before the Court. [ 19 ] Section 74(1)(
a) deals strictly with situations where the CFO “refuses to issue or revokes a licence,” which is not what occurred in this case. Section 74(1)(
c) deals with situations where the provincial minister “refuses to approve or revokes the approval of a shooting club or shooting range,” which did not occur either. Neither provision applies here. [ 20 ] It is important to appreciate the Club’s application culminated in an approval, not a refusal or a revocation.
Section 74 addresses only refusals and revocations, not approvals. Moreover, the approval of the Club’s shooting range is neither a “licence” nor an “authorization.” These situations are governed by s. 70(1), which states:
Revocation of licence or authorization 70
(1) A chief firearms officer may revoke a licence, an authorization to carry or an authorization to transport for any good and sufficient reason including, without limiting the generality of the foregoing, (
a) where the holder of the licence or authorization […] (ii) contravenes any condition attached to the licence or authorization[.] [Emphasis added.]
[ 21 ] The reference process has no application to the review of the CFO’s approval and ought not to have been engaged even though conditions were attached. This was instead a matter for judicial review under Rule 69 of the Rules of Court . [ 22 ] Under the Act , the Provincial Court judge had no authority to conduct the hearing of the reference prescribed by s. 75 and to order any of the relief set out in s. 76 to deal with the CFO’s conditional approval.
This is consistent with the lack of authority vested in a chief firearms officer to impose conditions as part of an approval. [ 23 ] The Provincial Court judge framed her decision as a “standard of review” decision.
The judge ought to have refused to conduct the reference hearing as the matter of the CFO’s conditional approval was not properly referred to her court under the Act and she had no inherent jurisdiction to “review” it. [ 24 ] Although there was much debate before us about the juristic effect of a reference hearing, resolution of that debate is best left to another day, when ss. 74 to 76 of the Act are clearly in play. C. Appeal to the Court of Queen’s Bench [ 25 ] The appeal to the Court of Queen’s Bench is governed by s. 77 of the Act which states:
Appeal to superior court 77
(1) Subject to
section 78, where a provincial court judge makes an order under paragraph 76(a), the applicant for or holder of the licence, registration certificate, authorization or approval, as the case may be, may appeal to the superior court against the order. Appeal by Attorney General
(2) Subject to
section 78, where a provincial court judge makes an order under paragraph 76(
b) or (c), (
a) the Attorney General of Canada may appeal to the superior court against the order, if the order is directed to a chief firearms officer who was designated by the federal Minister, to the Registrar or to the federal Minister; or (
b) the attorney general of the province may appeal to the superior court against the order, in the case of any other order made under paragraph 76(
b) or (c).
titre par le ministre fédéral;
[ 26 ] Section 77(1) of the Act sets out the jurisdiction of the superior court on appeal from a reference decision and provides that the licence holder may appeal against an order made by the reference judge under s. 76(a). Section 77(2) provides that the Attorney General may appeal against an order made under s. 76(
b) or (c). No such order was made here. The powers conferred on the superior court under s. 79 are silent on conditions of approval. Section 79(2) provides: Burden on applicant 79
(2) A superior court shall dispose of an appeal against an order made under paragraph 76(
a) by dismissing it, unless the appellant establishes to the satisfaction of the court that a disposition [dismissing the appeal] referred to in paragraph (1)(
b) is justified.
[ 27 ] In this matter, the Court of Queen’s Bench judge therefore lacked jurisdiction to refer the matter back to the Provincial Court because the reference process was not available.
D. Further appeal to the Court of Appeal [ 28 ] Finally, this Court’s jurisdiction on further appeal is governed by s. 80, which states: Appeal to court of appeal 80 An appeal to the court of appeal may, with leave of that court or of a judge of that court, be taken against a decision of a superior court under
section 79 on any ground that involves a question of law alone. [ 29 ] An appeal to this Court can only be made with leave and on a question of law. The appeal raises two such questions:
a) whether the reference process set out in ss. 74-76 of the Act was properly engaged, which I conclude it was not; and
b) whether there is any statutory authority permitting the CFO to impose conditions on an approval under s. 29, which I conclude there is not. III. Conclusion and Disposition [ 30 ] I would grant leave to appeal and allow the Club’s appeal. Since the CFO had no authority to impose conditions on her approval of the Club’s application, the Court of Queen’s Bench lacked jurisdiction to refer the matter back to the Provincial Court. Accordingly, I would vary the CFO’s approval to strike out the conditions. [ 31 ] I would order the respondent pay costs on appeal in the amount of $2,000.
(6) A notice given under subsection (5) must include reasons for the decision disclosing the nature of the information relied on for the decision and must be accompanied by a copy of sections 74 to 81.
Regulations 117 The Governor in Council may make regulations (
e) regulating (
i) the establishment and operation of shooting clubs and shooting ranges, (ii) the activities that may be carried on at shooting clubs and shooting ranges, (iii) the possession and use of firearms at shooting clubs and shooting ranges, and (iv) the keeping and destruction of records in relation to shooting clubs and shooting ranges and members of those clubs and ranges[.]
definitions in this
section apply in these Regulations. […] approved means approved under
section 29 of the Act. […]
operator means a person approved under subsection 29(1) of the Act to operate either a shooting club or a shooting range. […] Request for Approval of Shooting Range 3
(1) A person who wishes to establish and operate a shooting range shall submit a request for approval to the provincial minister and provide the following information in the request: (
a) the applicant’s name, address, phone number and, if applicable, facsimile number and electronic mail address; (
b) the location of the shooting range, including road directions to reach it; (
c) the proposed hours of operation of the shooting range; and (
d) with respect to each operator, each owner of the shooting range, and each employee of the shooting range who handles firearms (
i) his or her name, address and phone number, and (ii) the number of his or her licence to possess firearms or, if one does not exist, his or her date of birth.
a) ses noms, adresse et numéro de téléphone ainsi que, le cas échéant, son numéro de télécopieur et son adresse de courrier électronique;
b) l’emplacement du champ de tir et les directions pour s’y rendre par route;
c) les heures d’ouverture prévues du champ de tir;
(2) The request for approval of a shooting range must be accompanied by the following documentation: […] (
b) a copy of the proposed safety rules; […] (
f) evidence that the design and operation of the shooting range meets at least the requirements set out in
section 5[.] […] 3
Compliance with Safety Standards and Other Obligations 5 The operator of an approved shooting range shall ensure that the discharge of firearms on the shooting range does not endanger the safety of persons at the shooting range or in the portion of the surrounding area described in paragraph 3(2)(a), by taking appropriate measures, including ensuring that (
a) the design and operation of the shooting range (
i) is such that projectiles discharged from firearms will not leave the shooting range if they are discharged there in accordance with the safety rules, and (ii) promotes the safety of all persons on the shooting range, including by accommodating any adaptation that may be appropriate given the nature of the shooting activities that may take place and the type and calibre of firearms that may be used there; (
b) the shooting range has an adequate warning system to warn persons that they are entering a shooting range and to inform them, when such is the case, that shooting activities are taking place at that time; (
c) appropriate safety rules for the shooting range are applied that are consistent with the nature of the shooting activities that may take place and the type and calibre of firearms that may be used there; (
d) the safety rules are posted in a conspicuous place on the shooting range; and (
e) if more than one person is simultaneously engaged in shooting activities on the shooting range, a person acts as the range officer.
i) d’une part, de sorte que les projectiles tirés d’armes à feu ne sortent pas du champ lorsqu’ils y sont tirés conformément aux règles de sécurité, (ii) d’autre part, pour promouvoir la sécurité des personnes s’y trouvant, notamment en y effectuant toute adaptation qui peut être appropriée compte tenu du genre de tir qui peut s’y dérouler et des types et calibres des armes à feu qui peuvent y être utilisés;
b) un système d’avertissement adéquat soit en place pour avertir les personnes qu’elles entrent dans un champ de tir et, le cas échéant, que des activités de tir y sont en cours;
c) des règles de sécurité appropriées soient mises en vigueur au champ de tir, lesquelles conviennent au genre de tir qui peut s’y dérouler et aux types et calibres des armes à feu qui peuvent y être utilisés;
d) les règles de sécurité soient affichées à un endroit bien en vue au champ de tir;
74 à 76 sont les suivantes : Reference to judge of refusal to issue or revocation, etc.
Decision by provincial court judge Renvoi 74
76 On the hearing of a reference, the provincial court judge may, by order, (
a) confirm the decision of the chief firearms officer, Registrar or provincial minister; (
b) direct the chief firearms officer or Registrar to issue a licence, registration certificate or authorization or direct the provincial minister to approve a shooting club or shooting range; or (
c) cancel the revocation of the licence, registration certificate, authorization or approval or the decision of the chief firearms officer under
section 67.
a) confirmer la décision du contrôleur des armes à feu, du directeur ou du ministre provincial;
b) enjoindre au contrôleur des armes à feu ou au directeur de délivrer le permis, le certificat d’enregistrement ou l’autorisation ou enjoindre au ministre provincial de conférer l’agrément au club de tir ou au champ de tir;
(2) Subject to
section 78, where a provincial court judge makes an order under paragraph 76(
b) or (c), (
a) the Attorney General of Canada may appeal to the superior court against the order, if the order is directed to a chief firearms officer who was designated by the federal Minister, to the Registrar or to the federal Minister; or (
b) the attorney general of the province may appeal to the superior court against the order, in the case of any other order made under paragraph 76(
b) or (c).
titre par le ministre fédéral;
(2) A superior court shall dispose of an appeal against an order made under paragraph 76(
a) by dismissing it, unless the appellant establishes to the satisfaction of the court that a disposition [dismissing the appeal] referred to in paragraph (1)(
b) is justified.
80, où on peut lire ceci : Appeal to court of appeal 80 An appeal to the court of appeal may, with leave of that court or of a judge of that court, be taken against a decision of a superior court under
section 79 on any ground that involves a question of law alone.
