Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le Tribunal est saisi d'une requête en révision au sens de l'article 95 de la
Loi sur la protection de la jeunesse concernant X (11 ans) et Y (9 ans), pour lesquels la Directrice de la protection de la jeunesse demande de prolonger leur maintien auprès de leur grand- mère paternelle reconnue famille d'accueil de proximité pour ses petits-enfants et ce, pour une période additionnelle de 9 mois. [ 2 ] La Directrice expose qu'elle entend au cours de cette période déposer pour le bénéfice de ces enfants une demande de tutelle en faveur de la grand-mère paternelle.
Elle demande de définir selon entente entre les parties les modalités des droits d'accès des enfants auprès de leurs parents et d'assurer concernant les rencontres mère-enfants un certain degré de supervision. [ 3 ] Elle dépose au soutien de sa demande un rapport de révision rédigé par madame [intervenante 1]. [ 4 ] La mère est absente.
Son avocate plaide que sa cliente consent au dépôt du rapport susmentionné et aux mesures recherchées. [ 5 ] Le père représenté par avocate y souscrit également. [ 6 ] L'avocate du père a tenu toutefois à faire modifier certains passages contenus au rapport de l'intervenante concernant l'état de malpropreté des lieux constaté chez le père. [ 7 ] L'intervenante reconnaît qu'effectivement la situation fut rapidement corrigée, le père ayant déménagé dans un nouveau logement dès le mois de novembre 2014.
Aussi, il visitait ses enfants durant cette période chez la grand-mère paternelle. [ 8 ] L'intervenante témoigne qu'elle n'a pas visité le logement du père mais qu'elle fait pleinement confiance à la grand-mère
paternelle qui lui précise qu'effectivement cet appartement est propre et adéquat. [ 9 ] En ce qui a trait aux différents diagnostics du père, elle lui fait ses excuses. En effet, le père ne souffre pas d'un problème de bipolarité. Il souffre plutôt d'anxiété et il est paranoïaque. [ 10 ] L'avocate des enfants souscrit au dépôt en preuve du rapport de madame [intervenante 1]. Elle acquiesce aux mesures recherchées.
Elle s'interroge toutefois sur la question des modalités des droits d'accès et sur la nécessité d'assurer une supervision de ces rencontres. [ 11 ] Le 9 juillet 2014, madame la juge Julie Beauchesne déclarait la sécurité et le développement de ces enfants encore et toujours compromis. Elle constatait: [15] The father realized that it would be hard to take care of his children on a full time basis and believes that his mother is the best person to take care of them.
She intents to be involved towards them. [16] The more concerning situation of the update is that the mother did not respect her commitments, namely that she did not get involved constantly towards her children which created a difficult situation for them. Her son even made a drawing in which he gives money to his mother so she could call him. [17] Her daughter, Y., is very anxious when she talks about her mother. She does not understand why her mother does not keep regular contact with her.
We can notice, during the mother absence, a situation of anxiety and fear. [18] Those abandonment and renewal cycle fluctuate at the same rate as her relationship. When she ends her relationship with a man, she has more time for her children. [19] The mother did not respect the visitation schedules.
She did not call her children on a regular basis nor contacted them on significant anniversaries (Christmas, birthday). [20] The social worker believes that the presence of her children fulfill her emptiness when she is not emotionally involved with a man. [ 12 ] Plus loin elle ajoute: [30] Due to the vulnerability and the weakness of those children and the mother difficulties' and the incapacity of the father to take them back on a full time basis, the Court believes that the children must stay with their paternal grandmother and this constitutes the only protection measure which answers their superior need. [31] The mother must understand that she needs to get involved to avoid hurting her children by leaving them that way. [ 13 ] La preuve non contredite révèle que la situation de la mère est demeurée inchangée.
L'intervenante témoigne que la mère est une fois de plus disparue de la vie de ses enfants au mois de septembre dernier comme à chaque année. [ 14 ] Elle n'a plus de coordonnée pour la rejoindre.
La mère, dit-elle, répète les mêmes cycles d'année en année malgré les impacts sur les enfants, éléments qui furent communiqués plus d'une fois à la mère. [ 15 ] Elle considère pertinent, malgré l'amélioration constatée au niveau des relations entre la mère et la grand-mère paternelle ainsi que le père, d'assurer un certain degré de supervision des rencontres de la mère auprès des enfants advenant que la mère se manifeste à nouveau. [ 16 ] Les enfants sont heureux lorsqu'ils voient leur mère. Ils sont tristes d'être sans nouvelle à nouveau de leur mère.
Ils la réclament. [ 17 ] L'intervenante expose que cette facette fait
partie intégrante des difficultés de la mère. Elle est incapable de demeurer stable dans ses rencontres avec ses enfants notamment lorsque la mère s'investit dans une relation amoureuse avec un nouveau conjoint. [ 18 ] La lecture du rapport de révision révèle de plus que les parents admettent qu'ils sont incapables d'assurer à plein temps une réponse aux besoins de leurs enfants. Ils acceptent de les confier à long terme à la grand-mère paternelle. [ 19 ] Dans le contexte actuel, les mesures recherchées sont dans l'intérêt de ces enfants.
Ils reçoivent réponse à l'ensemble de leurs besoins de la part de leur grand-mère paternelle. [ 20 ] POUR CES MOTIFS, LE TRIBUNAL: [ 21 ] GRANTS the motion; [ 22 ] DECLARES that the security and the development of the children X and Y are still in danger: [ 23 ] REVISES and EXTENDS the Court order rendered on July 9, 2014 in the present file; [ 24 ] ORDERS that the children X and Y be entrusted to a foster family chosen by the Director of Youth Protection for a period of nine (9) months; [ 25 ] ACKNOWLEDGES that it is the foster family of proximity of Mrs.
C, the paternal grandmother of the children; [ 26 ] ORDERS that the modalities of the contacts between the father and the children X and Y be established following agreement between the parties;
[ 27 ] ORDERS that the modalities of the contacts between the mother and the children X and Y be established following agreement between the parties, including a degree of supervision; [ 28 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to the children X and Y and their family for a period of nine (9) months; [ 29 ] ORDERS that the parents of the children X and Y take an active

Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] The Court is seized of a motion for review under
section 95 of the Youth Protection Act concerning X (11 years old) and Y (9 years old). The Director of Youth Protection is asking that they be kept with their paternal grandmother, who was recognized as a kinship foster family for her grandchildren, for an additional period of 9 months. [2] The Director explained that, during that period, she intends to file a tutorship request on behalf of the paternal grandmother, for the children’s benefit.
She asked that the terms and conditions of the parents’ rights of access to the children be defined by agreement between the parties, and that a certain degree of supervision be ensured during visits between the mother and the children. [3] In support of her request, the Director filed a review report prepared by [intervenante 1]. [4] The mother was absent.
Her attorney argued that her client consented to the filing of the above report and to the measures sought. [5] The father, who was represented by an attorney, also consented to them. [6] However, the father’s attorney wanted certain passages in the caseworker’s report to be amended, i.e. those concerning the state of uncleanliness noted at the father’s home. [7] The caseworker acknowledged that the situation was in fact quickly corrected, as the father moved to a new dwelling in November 2014.
In addition, during that period, he visited his children at the paternal grandmother’s home. [8] The caseworker testified that, although she has not visited the father’s dwelling, she has full confidence in the paternal grandmother, who told her that that apartment is clean and adequate. [9] The caseworker apologized to the father regarding the various diagnoses made about him: he does not suffer from a bipolar condition, but from anxiety and paranoia. [10] The children’s attorney agreed to the filing as evidence of the report prepared by [intervenante 1]. She agreed to the measures sought.
However, she had questions about the terms and conditions of the rights of access and the need to ensure that those visits are supervised. [11] On July 9, 2014, Julie Beauchesne J. declared that the children’s security and development were still in danger. She made the following observations: [15] The father realized that it would be hard to take care of his children on a full time basis and believes that his mother is the best person to take care of them.

[ sic ] [12] Further on, she added: [30] Due to the vulnerability and the weakness of those children and the mother difficulties’ and the incapacity of the father to take them back on a full time basis, the Court believes that the children must stay with their paternal grandmother and this constitutes the only protection measure which answers their superior need. [31] The mother must understand that she needs to get involved to avoid hurting her children by leaving them that way. [ sic ] [13] The uncontradicted evidence showed that the mother’s situation has remained unchanged.
The caseworker testified that, in September 2015, the mother once again disappeared from the children’s lives, as she does every year. [14] The mother’s contact information is no longer known.
The caseworker said that the mother keeps repeating the same cycles over the years, despite the impact on the children, of which she was made aware more than once. [15] The caseworker believes that, should the mother return, it would be appropriate to ensure a certain degree of supervision during her visits with the children, despite the improvements noted in the relations between the mother, the paternal grandmother and the father. [16] Seeing their mother makes the children happy. They are sad to once again be in a situation where they do not hear from her.
They want to see her. [17] The caseworker explained that that element is an integral part of the mother’s difficulties. She is unable to be consistent in her visits with her children, particularly when she begins a romantic relationship with a new spouse. [18] In addition, as revealed in the review report, the parents admitted that they were unable to ensure that their children’s needs were met on a full-time basis. They agreed to entrust the children to the paternal grandmother for the long term. [19] In the current context, the measures sought are in the children’s interest.
Their paternal grandmother sees to all of their needs. [20] THEREFORE, THE COURT: [The following passage appears in English in the original French-language judgment.] [21] GRANTS the motion; [22] DECLARES that the security and the development of the children X and Y are still in danger: [23] REVISES and EXTENDS the Court order rendered on July 9, 2014 in the present file; [24] ORDERS that the children X and Y be entrusted to a foster family chosen by the Director of Youth Protection for a period of nine (9) months; [25] ACKNOWLEDGES that it is the foster family of proximity of Mrs.
