Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). ______________________________________________________________________ [ 1 ] La présente est la confirmation écrite de la décision rendue oralement le 8 décembre 2014. [ 2 ] La Cour est saisie conformément à l'article 38 de la
Loi sur la protection de la jeunesse d'une demande visant à faire déclarer que la sécurité et/ou le développement des enfants X , Z et Y sont compromis pour les motifs apparaissant particulièrement au troisième paragraphe de la déclaration. [ 3 ] Essentiellement, dans la situation de l'enfant X , la Directrice de la protection de la jeunesse allègue : "3.
The security or the development of the child is considered to be in danger for the following reasons: 3.1 from April 2010 until November 2010, the child was the subject of a voluntary measures agreement due to issues of the mother's substance abuse, gambling and emotional instability as it appears more fully from said agreement; 3.2 from February 18, 2014 until August 18, 2014, the child and siblings, Z and Y , were subject to a voluntary measures agreement
due to issues of the child being exposed to violence and issues regarding the mother's instability as it appears more fully from said agreement; 3.3 the child is seriously and repeatedly subjected to behaviour on the part of the parents that could cause her harm and the child's parents fail to take the necessary steps to put an end to the situation, more particularly but not restrictively in that:
a) the mother and Mr. D have a conflictual relationship;
b) the child and the siblings were numerous times exposed to screaming, fighting, separating and reuniting between the mother and Mr. D ;
c) the child suffered an accidental head injury during a couple fight between the mother and Mr. D ;
d) the mother's partner, Mr. D , has a longstanding involvement with the Director of Youth Protection, with his own children due to issues of supervision, physical discipline, neglect and risk of sexual abuse;
e) Mr. D utilized inappropriate disciplining on the child (ex: verbally degrading, pinching, blaming, smacking);
f) in or around December 2013, the mother obtained a religious divorce from Mr. D ;
g) since the divorce, Mr. D continues to be in the family home regularly; 3.4 there is a serioius risk that the parents do not meet the child's basic needs in failing to give the child the care required by the child's physical or mental health, or not allowing the child to receive such care, more particularly but not restrictively in that:
a) Z is deaf and has cochlear hearing implants;
b) the mother and Mr. D have not followed through in following the recommendations from the [school A], for Z ;
c) the mother and Mr. D have not ensured that Z uses his implants as advised by the professionals, thereby seriously compromising the child's language development;
d) the mother and Mr. D have missed numerous audiology appointments for A ;
e) the mother has difficulties meeting her parental responsibilities due to the continuous domestic conflct, financial and emotional instability;
f) the mother has not been consistent in collaborating with the various community services involved with the family." [ 4 ] Essentiellement, dans la situation des enfants Z et Y , la Directrice de la protection de la jeunesse allègue : "3.

titre de mesure principale, la Directrice de la protection de la jeunesse recommande de maintenir les enfants dans le milieu familial maternel pour une période d'une année, en plus d’autres mesures visant à corriger la situation de compromission, tel qu'il appert au procès-verbal de l'audition. [ 6 ] La mère consent aux recommandations de la Directrice. [ 7 ] Le père de X , monsieur C , est absent de l'audition. [ 8 ] Le procureur mandaté pour représenter les enfants se dit en accord avec les mesures recherchées par la Directrice. [ 9 ] De consentement et pour valoir preuve, la Directrice de la protection de la jeunesse a versé aux dossiers des enfants Z et Y les pièces suivantes: - D-1 : Birth certificate; - D-2: Voluntary measures agreement from February 18, 2014 to August 18, 2014; - D-3: Superior court judgment by the Honorable Chantal Corriveau, dated August 25, 2010; - D-4: Court report written by [Social Worker 1] , dated August 11, 2014; - D-5: Addendum to court report written by [Social Worker 1] , dated November 19, 2014; - D-6: En liasse, reports from the [School A], dated June 2013, November 2013, June 2014 and November 2014. [ 10 ] De consentement et pour valoir preuve, la Directrice de la protection de la jeunesse a versé au dossier de l'enfant X les pièces suivantes: - D-1 : Birth certificate; - D-2: Voluntary measures agreement from February 18, 2014 to August 18, 2014; - D-3: Superior court judgment by the Honorable Chantal Corriveau, dated August 25, 2010; - D-4: Court report written by [Social Worker 1] , dated August 11, 2014; - D-5: Addendum to court report written by [Social Worker 1] , dated November 19, 2014; - D-6: En liasse, reports from the [School A], dated June 2013, November 2013, June 2014 and November 2014. - D-7: Voluntary measures agreement from April 21st, 2010 to November 1st, 2010. [ 11 ] En plus de cette preuve documentaire, le Tribunal a entendu les témoignages de la mère, madame B ainsi que de la personne autorisée par la Directrice de la protection de la jeunesse, madame [intervenante 1] .
ANALYSE DE LA PREUVE ET DÉCISION [ 12 ] La Directrice de la protection de la jeunesse est d'abord intervenue dans la situation de l'enfant X en 2010 alors que la mère présentait des problèmes de consommation de drogue ainsi que de jeu et manifestait également une instabilité émotionnelle. [ 13 ] La Directrice a de nouveau été saisie de la situation des trois enfants au début de cette année à l'effet que ceux-ci étaient exposés à des situations de violence conjugale et que la mère démontrait beaucoup d'instabilité. [ 14 ] Le père de X demeure présentement [au pays A] et n'est pas impliqué dans la vie de celle-ci.
Le père putatif de Z et de Y , monsieur D , serait toujours présent dans la situation familiale malgré le divorce religieux obtenu par la mère au mois de décembre 2013. [ 15 ] Ce dernier est connu de la Directrice de la protection de la jeunesse pour son implication dans des situations de violence ou de méthodes éducatives déraisonnables à l'égard de ses propres enfants nés d'une autre mère.
Il est impliqué dans le présent dossier dans des situations de violence conjugale et de mauvais traitements à l'égard de l'enfant X . [ 16 ] La Directrice a d'abord proposé à la mère ainsi qu'à monsieur D des mesures volontaires qui se sont échelonnées du 18 février 2014 jusqu'au 18 août dernier.
Malgré l'intervention de la Directrice les conflits entre les parents ont persisté et la situation financière de la mère est toujours précaire. Elle démontre encore beaucoup d'instabilité et ne collabore pas non plus avec les différents services communautaires qui lui ont été proposés. [ 17 ] L'enfant Z souffre de surdité et nécessite des implants cochléaires. Il fréquente [l’école A] mais les parents ne collaborent pas avec cette école et négligent l'utilisation des implants pour Z . Ils manquent également des rendez-vous en audiologie. De plus le milieu de vie familial est plutôt chaotique et désorganisé. La mère voulait aller vivre à Ville B mais a changé d'idée. Elle veut maintenant
retourner aux études. [ 18 ] L'intervenante sociale, madame [intervenante 1] , n'a pas eu de contacts avec le père putatif, monsieur D , depuis le milieu du mois de septembre dernier. On ne connaît donc pas son implication actuelle au niveau familial. Il s'avère important cependant que la mère se stabilise dans un milieu de vie à plus long terme et que ses enfants, et en particulier Z , reçoivent tous les soins et services nécessaires à leur bon développement.
Elle doit donc collaborer de façon étroite avec l'intervenante au dossier ainsi qu'avec les différents professionnels qui prodiguent des soins et services à Z ainsi qu'aux autres enfants. [ 19 ] Celle-ci consent aujourd'hui aux mesures recommandées par la Directrice et il est clairement dans l'intérêt des trois enfants que ces mesures puissent s'appliquer au cours de la prochaine année.
En plus des services et des soins à être prodigués au jeune Z , il est important que X puisse fréquenter l'école de façon régulière et que Y puisse fréquenter la garderie où il a été intégré au mois d'août dernier et ce, de façon régulière. La mère devra de plus aviser l'intervenante sociale de l'éventuel retour de monsieur D à son domicile afin que des mesures adéquates soient prises pour que les enfants ne soient plus exposés à des scènes de violence conjugale et que X ne soit pas exposée non plus à de mauvais traitements physiques ou psychologiques.
PAR CES MOTIFS, LE TRIBUNAL: [ 20 ] DECLARES that the security and development of the three (3) children are considered compromised according to the
section 38 of the Youth Protection Act; CONCERNING Y and Z [ 21 ] ORDERS that both children remain entrusted to their mother; [ 22 ] ORDERS that the mother ensure that the children are not exposed to any type of violence, verbal or physical; [ 23 ] ORDERS that the mother participate in a psychological assessment with parental capacity component; [ 24 ] RECOMMENDS that Mr.
D , the putative father, participate in a psychological assessment with parental capacity component; [ 25 ] ORDERS that the mother consistently follow the recommendations made by treating professionals, both in regard to Z 's language development needs, and other needs of the family; [ 26 ] RECOMMENDS that the mother participate in professional therapeutic counseling to promote healthy relationship capacity, and to promote safe and positive parenting; [ 27 ] RECOMMENDS that the putative father, if he comes back in the situation of the children, participate in professional therapeutic counseling to promote healthy relationship capacity, and to promote safe and positive parenting skills; [ 28 ] ORDERS the mother, according to her consent, to advise the Director of Youth Protection if Mr.
D comes back in the situation of the children and if he comes back home; [ 29 ] AUTHORIZES the Director of Youth Protection to obtain and share informations with all service providers for the family, to ensure relevant and necessary treatment interventions; [ 30 ] ORDERS that a person working for the A Youth and Family Centres or for any other establishment or organism provide aid, counsel and assistance to the children and their family for a period of one (1) year; CONCERNING X [ 31 ] ORDERS that the child remain entrusted to her mother; [ 32 ] ORDERS the mother to ensure that the child is not exposed to any type of violence, verbal or physical; [ 33 ] ORDERS that the mother ensure that X is never alone with Mr.
D without another responsible adult present; [ 34 ] ORDERS , according to her consent, that the mother participate in a psychological assessment with parental capacity component; [ 35 ] ORDERS that the mother consistently follow the recommendations of treating professionals involved with the family; [ 36 ] RECOMMENDS that the mother participate in professional therapeutic counseling to promote healthy relationship capacity, and to promote safe and positive parenting skills; [ 37 ] AUTHORIZES the Director of Youth Protection to obtain and share information with all service providers for the family, to ensure relevant and necessary treatment interventions; [ 38 ] ORDERS that a person working for the A Youth and Family Centres or for any other establishment or organism provide aid, counsel and assistance to the child and her family for a period of one (1) year; And [ 39 ] ENTRUSTS the situation of the three (3) children to the Director of Youth Protection A, who shall then see that the measures are carried out.
