Article 95 - Youth Protection Act

[ 1 ] The Director of Youth Protection (Director) submits an application for a review of the decision rendered on November 22 nd , 2022, ordering that the child be reintegrated under the parents’ care and ordering supporting measures including aid, counselling and assistance for a period of six months. [ 2 ] The Directors asks the Court to order that the child be entrusted under the care of the paternal grandparents, to authorize the reintegration with the parents if the situation allows it and to order several assistance measures including aid, counselling and assistance for the child and the child’s parents for a period of nine months. [ 3 ] Previously to the hearing, the parties informed the Court that they signed an agreement.

All parties agree with the situation of compromission, and the measures sought by the Director. [ 4 ] It appears to the agreement that the parties gave their consent in a free and enlightened manner. [ 5 ] The Court concludes that the agreement signed by the parties is in the interest of the child and respects her rights.

THEREFORE, AND FOR THESE REASONS,THE COURT : [ 6 ] CONFIRMS AND DECLARES enforceable the agreement signed by the parties; [ 7 ] GRANTS the Application; [ 8 ] REVISES the decision rendered on November 22 nd , 2022; [ 9 ] DECLARES that the security and development of X born on [...], 2009 are still endangered under section 38 (1) (

b) iii. and 38 ( b ) (2) of the Youth Protection Act .; [ 10 ] ORDERS that the child be entrusted to the care of the paternal grandparents with a reintegration under the parents’ care if the situation allows it; [ 11 ] ORDERS that the child attends school on a regular basis; [ 12 ] ORDERS that the child attends all therapy appointments set; [ 13 ] ORDERS the parents to continue to attend services for their sobriety; [ 14 ] ORDERS the parents to continue to report their progress to Director of Youth Protection on a bi-weekly basis and plans set out for the child; [ 15 ] ORDERS that all contacts between the child and the parents be supervised by the Director of Youth Protection for frequency and modalities; [ 16 ] AUTHORIZES the Director of Youth Protection to obtain and share information to service providers working with the child and the child’s parents; [ 17 ] ORDERS that aid, counselling and assistance be provided to the child and the child’s parents for a period of nine (9) months ; [ 18 ] The whole, until February 1 st , 2024; [ 19 ] ENTRUSTS the situation of the child to the Director of Youth Protection for the execution of the present order. ___________________________________ LUCIE GODIN, J.C.Q.
