P-34.1 R.S.Q. ) ______________________________________________________________________ [ 1 ] Mrs [Social Worker 1], delegate of the Director of Youth Protection A, asks the Court to review the decision rendered on March 24, 2011 by the undersigned concerning the youth X, born on […], 1996. She is asking to pursue the placement in a group home for a period of eight months, and thereafter, a placement in a foster family until her majority. [ 2 ] At the hearing, the mother and the youth are present. The youth is assisted by Me Angela Tommasel. The father is absent.
Me Valérie Martel represents the petitioner. [ 3 ] The youth and the mother disagree with the recommendations even if they admit most of the allegations. A revision report, a psychological report and an observation report are filed. The mother and the social workers testify. [ 4 ] The Court has evidence of the following facts. [ 5 ] Mrs C withdrew her consent to foster the youth after the last three-month placement of X at the reception center as it has been ordered. The youth needs a supervision that she cannot provide. [ 6 ] The two oldest sisters of X have left town to pursue their studies.
Since, the youth has expressed her wish to move closer to her extended family, up North.
A meeting took place between the youth, her mother, the petitioner and the delegate from Cree Social Services, Mrs [Social Worker 2]. [ 7 ] Meanwhile, a place was available for X at the A reception centre and group home and two members of the extended family expressed their availability to receive the youth on a long-term basis, but they needed to be evaluated by the Cree social worker, Mrs [Social Worker 2]. [ 8 ] The mother now accepts that the youth be placed up North, but she is still not collaborating with social services.
She is currently residing in Town C, but refuses to give her address. [ 9 ] The father is not involved, does not collaborate and has been aggressive during some phone conversations. [ 10 ] The evaluation made by the psychologist, Mr Pierre Barrette, provides a precise picture of the youth's behaviour and her needs. It also explains the reasons for the failure of the reintegration of X at Mrs A's place.
Mr Barrette declares : … X est une adolescente qui présente une faible estime d'elle-même, qui est peu portée à faire de l'introspection, et qui est habitée par une certaine charge agressive en réaction aux blessures affectives résultant de l'absence de liens d'attachement sécurisants. La présence d'antécédents de consommation abusive de drogue et alcool et l'émergence de certains comportements d'opposition chez l'adolescente
semble s'inscrire dans une dynamique de fonctionnement relevant d'une problématique d'attachement de type anxieux-évitant. Compte tenu de la dynamique particulière de l'adolescente, nous sommes d'avis que toute démarche visant la réinsertion de l'adolescente en famille d'accueil risque d'être vouée à l'échec à court ou moyen terme.
Un contexte de vie familiale risque de susciter à nouveau chez X un certain malaise en raison de son appréhension d'être à nouveau victime de rejet et de malaises, et ainsi favoriser l'émergence de comportements d'opposition et/ou d'indifférence face aux règles en vigueur dans le milieu de vie. Afin de venir en aide à l'adolescente, nous sommes d'avis que toute démarche de réinsertion chez des membres de sa fratrie ou en foyer de groupe doit être accompagnée d'un suivi psychologique.
Une telle démarche doit viser les objectifs suivants : 1) aider X à expérimenter un certain mieux être à l'intérieur d'une relation d'intimité et de confiance; 2) développer une meilleure estime d'elle-même; 3) encourager l'introspection, l'empathie, ainsi qu'une meilleure prise de conscience de ses besoins et fragilités ( risque de développer un problème de consommation important ), ainsi que des moyens pour y répondre de façon adéquate; 4) procurer à X suffisamment de rétroaction afin d'amenuiser sa tendance à distorsionner la réalité; 5) aider X à trouver des moyens appropriés pour exprimer ses sentiments de colère plutôt que de les refouler et de réagir par des accès de colère; 6) aider X à se donner des objectifs de vie et la supporter afin qu'elle fasse montre de persévérance dans les moyens qu'elle doit déployer pour atteindre ses buts. [ 11 ] Actually at the group home, X is able to respect most of the rules.
Over the past months, she was caught sniffing hairspray and has escaped once. Even if she has good contact with the educator, she does not reveal herself, never talked of her past, her feelings, her anger or even her frustrations. She does not project herself in the future. But even with those observations, the educator considers that the youth is ready to attend a foster family. At this point, the Court disagrees with that, considering the whole evidence. [ 12 ] Adding to that, in her report, Mrs [Social Worker 2] declared that she evaluated two relatives family as requested by the client.
But, those two were not recommended and she proceeded later to evaluate another uncle Mr D and his wife Mrs E . They seem to be appropriate, but they do not know the youth. She never had relationship with them. The youth's situation is too fragile to force such relationship. [ 13 ] Consequently, considering that since September, X attends school Town D, made friends and is involved in sports' group, the Court considering the seriousness of her difficulties, orders that she remain in a reception centre until the end of the school year.
The Court also makes the recommendation that she evolve in a group home if her situation allows it. [ 14 ] FOR THESE MOTIVES, THE COURT : [ 15 ] GRANTS the petition; [ 16 ] DECLARES that the security and development of X are still compromised; [ 17 ] ORDERS the placement of the youth X in a reception center until the end of the school year followed by a placement in a foster family until her majority; [ 18 ] RECOMMENDS that the youth be placed in a group home; [ 19 ] ORDERS the Director of Youth Protection to provide a psychological follow-up to the youth for the duration requested by the professional; [ 20 ] ORDERS the Director of Youth Protection to supervise the visits and contacts between the parents, the uncle and the youth; [ 21 ] ORDERS the Director of Youth Protection to provide aid, counsel and assistance to the youth and her parents until the youth's majority; [ 22 ] ORDERS any police officer to collaborate in the execution of the present judgment; [ 23 ] ENTRUSTS the youth's situation to the Director of Youth Protection for the purpose of executing this enactment. __________________________________ DENYSE LEDUC, J.C.Q.
