Date of hearing: 19 April 2023 REASONS OF HEALY J.A. I [ 5 ] Sexual activity occurred mid-morning between the appellant and the complainant on 9 March 2018. The trial judge first dismissed, summarily, a motion that the arrest of the appellant without warrant was unlawful and a breach of

section 9 of the Charter. Second, the trial judge was persuaded beyond reasonable doubt that the complainant did not consent to that activity with the appellant. He also found no reasonable doubt in the appellant’s defence that he mistakenly believed that she consented to the sexual activity in question with him. [2] He found the appellant guilty on one count of sexual assault. [3] The appellant submits two grounds of appeal against this finding. II Context [ 6 ] It was daylight when the appellant returned to the bedroom assigned to him in the house of a friend with whom he was staying.

The complainant was sleeping in the bed. The appellant removed his clothes, except for his boxers, and got into the bed beside the complainant. She was on her side and faced away from him. He began to touch her in a sexual manner. She began slowly to waken. Intercourse followed for about two minutes before she ended the encounter due to the beginning of her period. She rose from the bed and from the bathroom called to “M.” (her boyfriend) to join her in the shower. [ 7 ] Eleven days later the appellant was arrested without warrant at his college. He was taken to a police station. He declined to consult counsel.

In a video-taped interview he made an incriminating statement. At trial the entire statement was admitted in evidence on the basis that it was free and voluntary. III First ground [ 8 ] The appellant submits that the trial judge erred in law by refusing to hold a voir dire on a motion that the arrest and detention without warrant were unlawful, and a violation of

section 9 of the Charter, that compelled exclusion of the appellant’s statement. The judge ruled that the motion had no reasonable chance of success. This ground cannot succeed unless the appellant demonstrates that in law a judge is obliged to conduct a voir dire when the validity of the arrest and detention is challenged. As formulated, this ground does not address the validity of the arrest and detention or the admissibility of evidence.

It is concerned with procedural considerations when a motion is made to challenge these issues. [ 9 ] No general rule compels a court to conduct a voir dire on any occasion that a party raises a question that requires consideration of preliminary facts by the trier of law, in the absence of the trier of fact, [4] to determine a matter of procedure or evidence for the trial of facts in issue. [5] Examples include objections and questions concerning the exercise of police powers, the admissibility of evidence, the competence of a witness or the application of privilege.

Whether to conduct a voir dire ultimately lies in the discretion of the trial judge and will be governed by prudence and the avoidance of the risk of prejudice to the parties. [6] For some issues, notably the admissibility of confessions, the conduct of a voir dire is aptly considered a rule of practice but it is not absolute. [7] Whether a party may ask for a voir dire might be subject to procedural requirements such as notice but the judge retains the authority to decide whether to adjudicate a preliminary question in the absence of the trier of fact .

That authority includes the discretion to dismiss a motion that is manifestly frivolous. [8] The exercise of this discretion is often a function of case management that applies to any preliminary question, constitutional or otherwise, unless the issue warrants a hearing in the absence of the trier of fact. [9] The refusal to conduct a voir dire is in effect a decision that the substance of the preliminary question is without merit. [ 10 ] In the present case the trial judge concluded that the application by the appellant was without merit because it contradicted the plain meaning and effect of section 495(3). [ 11 ] The appellant argues that this Court should conclude that the authority to arrest and detain without warrant is lawful only if the peace officer has reasonable and probable grounds to believe in the actual or imminent commission of an indictable offence and that such measures are necessary in the public interest and to ensure appearance in court.

He argues that these three conditions are cumulative and that unless all of them are satisfied arrest and detention without warrant under

section 495 are unlawful. He submits that

section 495 of the Criminal Code does not excuse arrest and detention without warrant for an indictable offence [10] unless there are reasonable grounds to believe that such measures are necessary in the public interest and to ensure the attendance of the suspect in court. [ 12 ] Section 495(3) has not recently been considered by this Court [11] and it has not been analysed by the Supreme Court of Canada. There are decisions elsewhere to the effect that section 495(3) excuses non-compliance with the restrictive conditions in section

495(2). [12] [ 13 ] The appellant rightly claims that

section 495 is intended in part to prevent unnecessary arrest and detention without warrant. It is a central part of the legislative design to promote means to issue legal process in criminal matters with no more restriction of personal liberty than is necessary. The excuse allowed by section 495(3) nevertheless provides express recognition that as a practical matter it is often not possible for a peace officer to judge whether arrest and detention without warrant is necessary at the time when that decision is taken.

This is most apparent where the power to arrest and detain without warrant for an indictable offence is exercised in relation to an offence that is about to be committed (section 495(1)( a )).

It is also apparent when a peace officer acts upon information received from others without having personal knowledge of the circumstances at issue. [ 14 ] The excuse provided in section 495(3) has analogues in other sections that seek to minimise reliance on powers of arrest and detention without warrant and to maximise swift release on the least restrictive conditions. [13] The Code elsewhere provides in various contexts for the excuse, justification or extension of police powers beyond their defined scope in recognition that such tolerance is reasonable to accommodate the exigencies and even reasonable error in law enforcement.

Examples include the use of force, [14] search and seizure in exigent circumstances [15] and the seizure of contraband not specified in a search warrant. [16] [ 15 ]

Section 495 provides as follows: 495.

(1) A peace officer may arrest without warrant: (

a) a person who has committed an indictable offence or who, on reasonable grounds, he believes has committed or is about to commit an indictable offence; […]

(2) A peace officer shall not arrest a person without warrant for […] (

b) an offence for which the person may be prosecuted by indictment or for which he is punishable on

summary conviction, […] in any case where (

d) he believes on reasonable grounds that the public interest, having regard to all the circumstances including the need to: (

i) establish the identity of the person, (ii) secure or preserve evidence of or relating to the offence, or 495.

(3) Notwithstanding subsection (2), a peace officer acting under subsection (1) is deemed to be acting lawfully and in the execution of his duty for the purposes of: (

a) any proceedings under this or any other Act of Parliament; and (

section is clear. Section 495(1) authorises arrest and detention without warrant if a peace officer has reasonable and probable grounds to believe that a person has committed, or is about to commit, an indictable offence. Section 495(2) stipulates that this authority “shall not” be exercised except in the public interest and to ensure attendance in court.

If the limitations in section 495(2) are not observed, section 495(3) deems the exercise of this power nevertheless lawful “ unless in any such proceedings it is alleged and established by the person making the allegation that the peace officer did not comply with the requirements of subsection (2) .” The appellant argues that this Court should adopt a strict

interpretation of section 495(2) and a strict

interpretation of section 495(3). [ 17 ] Section 495(2) excuses an exercise of the power of arrest without warrant that does not comply with the conditions stated in section 495(1). That excuse is qualified by the limitation in section 495(3), which provides expressly that if a person arrested without warrant alleges and establishes that if the arresting officer did not comply with the limitations in paragraphs 495(2)( d ) “and” ( e ) [17] the arrest is not excused and therefore not lawful.

The purpose of these provisions is to minimise the incidence of arrest without warrant with reference to criteria of necessity. [ 18 ] Section 495(3) explicitly reserves to a person arrested without warrant the opportunity to challenge the lawfulness of the arrest upon allegation and proof. That opportunity can only be undertaken by proceeding in the absence of the trier of fact. A decision to deny a voir dire is a decision to deprive the arrested person of the opportunity that section 495(3) provides.

A judge might conclude in such a voir dire that the claim advanced under 495(3) is manifestly frivolous, or otherwise without merit, but this conclusion cannot be reached without first conducting a hearing in the absence of the trier of fact. It follows that a judge cannot summarily refuse to conduct a voir dire on the ground that it would be manifestly frivolous to do so unless the applicant is first given the opportunity to demonstrate that the motion is not manifestly frivolous.

To allow a decision of that kind would condone a peremptory decision to deprive an arrested person of the opportunity to allege and establish that the conditions of section 495(2) were not satisfied. Such a decision would nullify the plain meaning of section 495(3).

[ 19 ] These observations are not only consistent with the decision of the Supreme Court in Haevischer [18] but are compelled by it. Haevischer was decided after the judgment in which the trial judge refused to conduct a voir dire given his view that the appellant’s motion had no reasonable chance of success. Haevischer affirms that a voir dire may be summarily dismissed if the claim advanced is manifestly frivolous on its merits, which necessarily implies that the claim to be heard must first be considered. It does not allow

summary dismissal of the opportunity to conduct a voir dire and it categorically precludes

summary dismissal when this opportunity is expressly acknowledged in a provision such as section 495(3). This provision and the decision in Haevischer ensure that an arrested person has at least the opportunity to advance the claim that his application alleging an unlawful arrest be heard to demonstrate that it is not manifestly frivolous. [19] It is, to say the least, redundant to note that this observation is self-evident where the opportunity coincides with the assertion of a constitutional right by an arrested person. [ 20 ] In the present case the trial judge was apprised of the appellant’s request for a voir dire to challenge the compliance of investigators with

section 495 of the Code. The substance of that challenge was not manifestly frivolous. The appellant was arrested in his college eleven days after the alleged offence and taken to a police station. There was no apparent basis on which to believe that the public interest (section 495(2)( d )) or the risk of non-attendance in court (section 495(2)( e )) justified arrest without warrant. The judge’s

summary refusal to conduct a voir dire to test the appellant’s challenge deprived the appellant of the opportunity to allege and establish non-compliance that is guaranteed by the plain terms of section 495(3) in accordance with a viable

interpretation of the limitations on the power of arrest without warrant in section 495(2). [ 21 ] The appellant’s first ground must succeed with an order for a new trial. [ 22 ] The respondent urged the Court to apply the proviso under section 686(1)( b )(iii) of the Criminal Code . The provision cannot apply in this case because the error cannot be considered harmless. The Court cannot conclude that the outcome of the trial would have been the same in the absence of the error.

IV Second ground [ 23 ] The appellant’s second ground is that in his analysis of the mens rea required for the offence of sexual assault the judge erred in law in basing his decision on irrelevant factors and in neglecting entirely to consider various elements of evidence supporting the defence of honest but mistaken belief in consent by the complainant. [ 24 ] In view of the Court’s conclusion concerning the first ground of appeal it is inappropriate to examine the second ground. V [ 25 ] I propose that the Court allow the appeal and order a new trial. PATRICK HEALY, J.A.

I [5] L’appelant et la plaignante ont eu une relation sexuelle en milieu de matinée le 9 mars 2018. Le juge du procès a d’abord rejeté

sommairement une requête alléguant que l’arrestation de l’appelant sans mandat était illégale et constituait une violation de l’article 9 de la Charte . Ensuite, le juge du procès s’est dit convaincu hors de tout doute raisonnable que la plaignante n’avait pas consenti à la relation

sexuelle avec l’appelant. Il a en outre conclu que le moyen de défense de croyance erronée mais sincère au consentement de la plaignante aux rapports sexuels en cause, invoqué par l’appelant, ne soulevait aucun doute raisonnable [21] . Le juge a déclaré l’appelant coupable d’agression sexuelle [22] . L’appelant soulève deux moyens d’appel à l’encontre de cette déclaration. II Contexte [6] Il fait jour lorsque l’appelant retourne à la chambre qui lui a été assignée dans la maison d’un ami chez qui il demeure. La plaignante est endormie dans le lit.

L’appelant se déshabille, mais garde son caleçon, et s’allonge dans le lit derrière la plaignante. Elle est couchée sur le côté et lui fait dos. Il commence à la toucher de façon sexuelle. Elle se réveille tranquillement. S’ensuit un rapport sexuel d’environ deux minutes, auquel elle met fin en raison du début de ses menstruations. Elle sort du lit et se rend à la salle de bain où elle appelle un certain « M… » (son petit ami) pour qu’il la rejoigne dans la douche. [7] Onze jours plus tard, l’appelant est arrêté sans mandat au collège qu’il fréquente. On l’amène au poste de police.

Il ne se prévaut pas de son droit de consulter un avocat. Dans le cadre d’un interrogatoire enregistré sur vidéo, il fait une déclaration incriminante. Au procès, l’intégralité de la déclaration est admise en preuve comme ayant été faite de façon libre et volontaire. III Premier moyen [8] L’appelant soutient que le juge du procès a erré en droit en refusant de tenir un voir-dire pour entendre une requête alléguant l’illégalité de son arrestation et de sa détention, ainsi que la violation de l’article 9 de la Charte, lesquelles commandaient l’exclusion de sa déclaration.

Le juge a déterminé que la requête n’avait aucune chance raisonnable de succès. On ne peut faire droit à ce moyen, à moins que l’appelant ne démontre que le juge est contraint, en droit, de tenir un voir-dire lorsque la validité de l’arrestation et de la détention est contestée. Tel qu’il est formulé, ce moyen ne traite ni de la validité de l’arrestation et de la détention ni de l’admissibilité de la preuve.

Il porte sur des considérations d’ordre procédural relatives aux requêtes qui visent à contester ces questions. [9] Il n’existe aucune règle générale obligeant le tribunal à tenir un voir-dire chaque fois qu’une

partie soulève une question exigeant que le juge du droit examine des faits préliminaires en l’absence du juge des faits [23] afin de trancher une question de procédure ou de preuve se rapportant aux faits en litige [24] . Les objections et questions concernant l’exercice des pouvoirs policiers, l’admissibilité de la preuve, l’habileté d’un témoin ou l’application du secret professionnel en sont des exemples. La décision de tenir ou non un voir-dire relève en définitive du pouvoir discrétionnaire du juge du procès et sera régie par la prudence et le souci d’éviter aux parties de subir un préjudice [25] .

Pour certaines questions, notamment l’admissibilité des confessions, la tenue d’un voir-dire sera considérée à juste

titre comme une règle de pratique, mais celle-ci n’est pas absolue [26] . La possibilité pour une

partie de demander la tenue d’un voir-dire peut être assortie de certaines exigences procédurales, comme celle de transmettre un avis, mais le pouvoir de déterminer si une question préliminaire sera tranchée en l’absence du juge des faits appartient au juge. Ce pouvoir comprend le pouvoir discrétionnaire de rejeter une requête manifestement frivole [27] . L’exercice de ce pouvoir discrétionnaire relève souvent de la gestion de l’instance et s’applique à toute question préliminaire, d’ordre constitutionnel ou autre, sauf si celle-ci doit être entendue en l’absence du juge des faits [28] .

Le refus de tenir un voir-dire correspond en fait à une conclusion portant que l’essence de la question préliminaire est sans fondement. [10] En l’espèce, le juge du procès a conclu que la demande de l’appelant était sans fondement parce qu’elle entre en contradiction avec le sens ordinaire du paragraphe 495(3) C.cr . et avec son effet. [11] L’appelant soutient que notre Cour devrait conclure que le pouvoir d’arrêter et de détenir sans mandat n’est légal que si l’agent de la paix a des motifs raisonnables de croire qu’un acte criminel a réellement été commis ou s’apprête à l’être et que ces mesures sont nécessaires dans l’intérêt public et pour assurer la présence au tribunal.

Il fait valoir que ces trois conditions sont cumulatives et que si elles ne sont pas toutes satisfaites, l’arrestation et la détention effectuées sans mandat aux termes de l’article 495 sont illégales. Il affirme que l’

article 495 du Code criminel n’autorise pas l’arrestation et la détention sans mandat pour un acte criminel [29] , sauf s’il existe des motifs raisonnables de croire que ces mesures sont nécessaires dans l’intérêt du public et pour garantir que le suspect se présentera au tribunal. [12] Notre Cour ne s’est pas penchée récemment sur le paragraphe 495(3) [30] et cette disposition n’a pas non plus été analysée par la Cour suprême du Canada. Des décisions rendues par d’autres juridictions indiquent que le paragraphe 495(3) excuse le non-respect des conditions restrictives imposées par le paragraphe 495(2) [31] . [13] L’appelant affirme à juste

titre que l’article 495 vise en

partie à prévenir les arrestations et détentions sans mandat qui ne sont pas nécessaires. L’une des principales intentions du législateur est de favoriser des moyens d’engager des procédures judiciaires criminelles qui ne restreignent la liberté individuelle que dans la mesure nécessaire. L’excuse prévue au paragraphe 495(3) constitue néanmoins une reconnaissance expresse du fait que, dans la pratique, il n’est souvent pas possible pour l’agent de la paix de juger si l’arrestation et la détention sans mandat sont nécessaires au moment même où il prend cette décision.

Cela est d’autant plus évident lorsque le pouvoir d’arrêter et de détenir sans mandat pour un acte criminel est exercé relativement à une infraction qui est sur le point d’être commise (al. 495(1) a )).

Cela est également évident lorsqu’un agent de la paix agit sur la foi de renseignements reçus de tiers sans avoir de connaissance directe des faits en cause. [14] Le Code contient certaines dispositions analogues au paragraphe 495(3) , qui visent à minimiser le recours aux pouvoirs d’arrestation et de détention sans mandat et à favoriser une mise en liberté assortie des conditions les moins privatives de liberté [32] . Par ailleurs, le Code , dans divers contextes, prévoit des excuses, des justifications et des élargissements des pouvoirs policiers au-delà de leur

portée définie, reconnaissant ainsi qu’il est raisonnable de tenir compte des contraintes en matière d’application de la loi et même de tolérer les erreurs raisonnables. Mentionnons par exemple l’usage de la force [33] , les perquisitions et saisies en cas de situations urgentes [34] et la saisie de biens de contrebande non visés par un mandat de perquisition [35] . [15] L’article 495 est ainsi libellé : 495.

(1) Un agent de la paix peut arrêter sans mandat :

a) une personne qui a commis un acte criminel ou qui, d’après ce qu’il croit pour des motifs raisonnables, a commis ou est sur le point de commettre un acte criminel; […]

(2) Un agent de la paix ne peut arrêter une personne sans mandat : […]

b) soit pour une infraction pour laquelle la personne peut être poursuivie sur acte d’accusation ou punie sur déclaration de culpabilité par procédure

sommaire; […] dans aucun cas où :

b) de toutes autres procédures, à moins qu’il n’y soit allégué et établi par la personne qui fait cette allégation que l’agent de la paix ne s’est pas conformé aux exigences du paragraphe (2). will fail to attend court in order to be dealt with according to law. […]

(3) Notwithstanding subsection (2), a peace officer acting under subsection (1) is deemed to be acting lawfully and in the execution of his duty for the purposes of: (

a) any proceedings under this or any other Act of Parliament; and (

b) any other proceedings, unless in any such proceedings it is alleged and established by the person making the allegation that the peace officer did not comply with the requirements of subsection (2). [16] La structure de cet

article est claire. Le paragraphe 495(1) autorise l’arrestation et la détention sans mandat si un agent de la paix a des motifs raisonnables de croire qu’une personne a commis ou est sur le point de commettre un acte criminel. Le paragraphe 495(2) énonce que ce pouvoir « ne peut » être exercé si ce n’est dans l’intérêt public et dans le but d’assurer la présence de la personne au tribunal.

Si les limites énoncées au paragraphe 495(2) ne sont pas respectées, le paragraphe 495(3) considère tout de même que le pouvoir a été exercé légalement « à moins qu’il n’y soit allégué et établi par la personne qui fait cette allégation que l’agent de la paix ne s’est pas conformé aux exigences du paragraphe (2) ». L’appelant soutient que la Cour devrait adopter une interprétation restrictive du paragraphe 495(2) et du paragraphe 495(3). [17] Le paragraphe 495(2) autorise l’exercice du pouvoir d’arrestation sans mandat qui ne respecterait pas les conditions énoncées au paragraphe 495(1).

Cette autorisation est assortie des limites énoncées au paragraphe 495(3) , qui prévoit expressément que si une personne arrêtée sans mandat allègue et établit que l’agent de la paix ne s’est pas conformé aux limites des alinéas 495(2)

d) « et » e ) [36] , l’arrestation n’est pas autorisée et n’est donc pas légale. L’objet de ces dispositions est de minimiser le nombre d’arrestations sans mandat en renvoyant au critère de nécessité. [18] Le paragraphe 495(3) accorde expressément à la personne arrêtée sans mandat la possibilité de contester la légalité de son arrestation en alléguant et en faisant la preuve de son illégalité. On ne peut se prévaloir de cette possibilité qu’en procédant en l’absence du juge des faits.

La décision de refuser de tenir un voir-dire est une décision qui prive la personne arrêtée de la possibilité offerte par le paragraphe 495(3) . Un juge pourrait conclure, à l’occasion d’un tel voir-dire, que la demande présentée au

titre du paragraphe 495(3) est manifestement frivole ou par ailleurs sans fondement, mais cette conclusion ne peut être tirée sans avoir préalablement tenu d’audience en l’absence du juge des faits. Il s’ensuit qu’un juge ne peut pas refuser

sommairement de tenir un voir-dire au motif qu’il serait manifestement frivole de le faire sans avoir d’abord offert au requérant la possibilité de démontrer que sa requête n’est pas manifestement frivole. Permettre un tel refus reviendrait à tolérer que soit rendue une décision péremptoire privant une personne ayant fait l’objet d’une arrestation de la possibilité d’alléguer et d’établir que les conditions énoncées au paragraphe 495(2) n’ont pas été respectées.

Une telle décision ferait perdre au paragraphe 495(3) son sens ordinaire. [19] Non seulement ces observations sont conformes à l’arrêt Haevischer [37] de la Cour suprême, mais cet arrêt les rend en outre nécessaires. Haevischer a été rendu après la décision du juge du procès de ne pas tenir de voir-dire au motif qu’il était d’avis que la requête de l’appelant n’avait aucune chance raisonnable de succès. Cet arrêt confirme qu’il est possible de rejeter

sommairement une demande de voir-dire si le fondement de celle-ci est manifestement frivole, ce qui implique nécessairement que cette demande soit d’abord entendue. Il ne permet pas d’écarter

sommairement la possibilité de tenir un voir-dire, et il empêche catégoriquement de le faire si une disposition prévoit expressément cette possibilité, comme le fait le paragraphe 495(3) . Cette disposition et l’arrêt Haevischer assurent qu’une personne arrêtée a au moins la possibilité de faire valoir que sa demande, alléguant l’illégalité de son arrestation, devrait être entendue afin de démontrer qu’elle n’est pas manifestement frivole [38] .

Il serait pour le moins redondant de souligner que cette observation va de soi si la personne qui a été arrêtée revendique en outre un droit constitutionnel. [20] En l’espèce, le juge a été informé que l’appelant sollicitait la tenue d’un voir-dire dans le but de déterminer si les enquêteurs s’étaient conformés à l’

article 495 du C.cr . Sur le fond, cette demande n’était pas manifestement frivole. L’appelant a été arrêté onze jours après l’infraction alléguée alors qu’il se trouvait au collège, puis il a été amené au commissariat. Il n’y avait aucune raison apparente de croire que cette arrestation sans mandat était justifiée par l’intérêt public (al. 495(2) d )) ou par le risque qu’il ne se présente pas au tribunal (al. 495(2) e )). Le refus

sommaire du juge de tenir un voir-dire pour évaluer la contestation de l’appelant a privé ce dernier de la possibilité d’alléguer et d’établir la non-conformité de son arrestation, ce qui lui est garanti par les termes clairs du paragraphe 495(3) selon une interprétation viable des limites imposées au pouvoir d’arrestation sans mandat énoncées au paragraphe

495(2). [21] Il convient d’accueillir le premier moyen d’appel et d’ordonner un nouveau procès. [22] L’intimé prie la Cour d’appliquer la disposition réparatrice prévue au sous-alinéa 686(1) b )iii) C.cr . L’application de cette disposition n’est pas appropriée en l’espèce, car l’erreur ne saurait être considérée comme inoffensive. La Cour ne peut conclure que l’issue du procès aurait été la même n’eût été cette erreur.

IV Deuxième moyen [23] Le deuxième moyen d’appel soulevé par l’appelant est que, dans son analyse de la mens rea requise pour l’infraction d’agression sexuelle, le juge a erré en droit en fondant sa décision sur des facteurs non pertinents et en négligeant complètement de prendre en compte divers éléments de preuve à l’appui de la défense de croyance erronée mais sincère au consentement de la plaignante. [24] Compte tenu de la conclusion de la Cour concernant le premier moyen d’appel, il ne serait pas approprié d’examiner le second. V [25] Je suis d’avis d’accueillir l’appel et d’ordonner un nouveau procès.
